  1. Hey guys, just to let you know we had our appointment today at the Boston office and we are APPROVED!

So the low-down..we go to the JFK building and go through the x-ray security, and then to the room on the letter. They tell us to go to another room and the guy takes my interview notice and tells me to go back to the original room. So w wait, and its filling up with loads of people and quite a few have lawyers..getting nervous...

And we finally get called after what seems like an eternity but was probably about 15 minutes and I'm pretty sure we got the same guy as Beantownbabe cos he mentioned he was on his 3rd career. We had to take the oath to tell the truth and then we sat down and he had all the paperwork we had sent on the desk. He asked us for birth certificates, passports, my EAD, my I-94. He asked us for each other's dates of birth, some bills with our names on them and confirmed a few details already on the form. I brought much more than this but that's all he asked for After a lot of stamping and signing places he then asked the 'are you a terrorist' questions, and it was difficult to keep a straight face in all honesty. And he took out the large red stamp pad and stamped approved right on the form.

He then mentioned about removing conditions and said we were to wait for a letter back in the waiting room and to have a nice day! So we got the letter after about 30 minutes wait and that's it!

Thank you so much to all the visa journey members who have helped us with questions we've had over this confusing process. No doubt we will see many of you over in the removing conditions forum in 18 months time! Good luck with upcoming interviews and speedy approvals to all!

  4. Hi,

I originally came to the US on an H1B visa, and married last year and began AOS. My H1B visa is still valid until April 09, but I have been approved for my EAD. Up til now I understood that I could come and go on my H1B and visit home with no problem.

Because I now have EAD does this in any way cancel out the H1B? I'm just curious as I didn't file for AP at the same time as AOS (wasn't eligible) and I don't want to be stuck here or vice versa try to go home and come back and screw everything up.

    cheers

The EAD is not a visa (not good for travel) so I'd hang on to the H1B.

So the H1B is still valid and I could come and go on that? It doesn't get cancelled or superseded by the EAD?

I think so. My understanding is UNLESS your H1B becomes invalid (laid off from the current employer or expiration day arrives) or you chose to use EAD (have 2nd job or change employer w/o transfering H1B), H1B continues to be valid and can be used for international travel without obtaining AP. (I have not confirmed with an immigration attorney, so please correct me if my understanding is not correct).

I am also adjusting from H1B (effective until the end of this September) and have not applied for AP. But I would probably apply for AP at the end of June (3 months before the expiration of H1B) if my interview will not be scheduled by then as approval of AP seems to take 3 months and I do not want to be stuck in the US during family emergency, etc.

Correct, if you want your H1/L1 to remain valid and run its course then do not use the EAD. The day you do, your work visa becomes invalid.

So I think I'll hold off giving my employer the EAD so I can still travel just in case of emergencies, and I should have my GC interview before the H1B expires. All should be good and legal (crosses fingers)

  7. Congratulations Alxmrt, Shieun and Necko! EAD's and AP's are rolling in for October filers - whoever said they must be clearing off desks before Christmas must have been right. Gradually we'll all get there - hang in there all who are waiting - soon, SOON!

    Shieun, have a great trip!

I guess us later October filers will hear some good news in the New Year..seems about the 60 day mark is when people are hearing things are moving forward.

    Patience is a virtue......

  8. :crying:

I filed the I-130 on the 25th of Nov 2008. Received on the 26th. Check Cleared on the 6th of December. I still haven't heard from the USCIS. No NOA. Its been more than 20 Days now. Does it take that much time. I am waiting for the NOA1, since i have to apply for the AOS, that I couldn't file with the I-130. Anybody else experienced delays. Most of the timelines I read on topics here receive their NOA's within a week.

Huh? Why not file everything at once? ie I-485, I-765, I-131 etc.

I blame holiday mailings for delayed NOA
