My timeline is very similar to yours. Have your case been transferred to CSC and if yes than when?? Also did you go through background checks, and that's the reason it took so long for approval?

well my sister was in exactly same situation. At the first visit she stayed there for 2 weeks and after her mother in law mailed the green to her. So i dont think there was anything illegal or she just wasn't caught.
She did go back after 12 months. They didn't ask any questions. But before that we found out that there is a 6 months rule. You shouldn't be outside of the USA for more than 6 months.
Now she travels to the US every 6 months, but last time she was questioned why she is not living in the USA. She told them that her USC husband works overseas and she stays with him.
So I really doubt that they will deny you entry even though you stayed outside of the US for more than 6 months, but at the same time just be prepared to answer few questions.

From what I understand it can take anywhere form 3 months to a pretty long time. I'm going through this right now. It's been almost 2 months for me.
The good news is that FBI and USCIS are working hard to clear up the backlog that they have so hopefully it won;t be longer than 3 months that they have promised us.

well the way I see that application is not denied, it's just name checks are taking too long. There are couple people here who had there applications pending for over 2 years. But eventually it got approved if everything is ok. And from what I understood, they have tried calling and contacted, congressman, but that didn't help. they just been waiting for name checks to be complete.
I was put on name check also, but only a month ago. And as of right now they say it will take 3 months. But i don't believe that, especially after your story. So if you could share with us your experience in little more detaile, give us your timeline and steps you've done so far with their outcomes, me and few others who are on name checks over here would appreciate that.

Filed in Feb 08 as well. No approval yet. Transferred to CSC from VSC on Aug 26th. About a month ago from senators office we were told that case is going though background checks. Were told not to inquire for another 90 days.
Calling USCIS is also useless. Last time they told us same thing, that case is with FBI going through background checks, and they dont know when it will be done.
Have no choice, but waitng.

since u mailed your I-129f in June it could move your application date from Jan to Jun. So that means you are not outside of processing time. This is not necessary true, but I wanted to file I-129f around same time as you, but was told that this will happen.
I filed in Feb 08, and still not approved. case is at background checks at the moment.

Nevermind. Just made it after 5th try. Officer said it's still with FBI.

One question I have is why they won't let my wife to talk to the officer. The talk about some f@#$ing service request and we have to wait for like 30 days to hear about the case. She told them that we are outside of processing time and things like that, but no use. They said that service request is the procedure they have to follow, and they can't transfer us to the officer. We tried calling several times today.

Man I'm in the same situation. From senators office I was told that they have started background check, and was told not to inquire for 3 months. But every time my wife would try to call USCIS they would not let her talk to the officer. So what is the trick to make that happen. And when you did talk to the officer, you just explained the situation and they sent the letter to CSC?
I've heard that these background checks take forever in some cases. In my case i lived in states for 8 years and dont have any criminal records. So really hope it won't take too long. So I would also try to do anything to speed it up at least a little but and not to get stuck in there forever some people do.

I'm not sure, but I believe they go by the date you filed K-3. So you considered to be July filer. I might be wrong so confirm it. I read it somewhere while back, because wanted to file K-3 as well, but then changed my mind because of this.

Number from the back of the check is not always accurate. So use only the number from NOA1. Also I remember that last year around this time a lot of people at VSC could not view their case status online for several months. And then big group of people were added to the system all on the same date. But sometimes I wish I could not access my case online, because I got sick and tired of checking it everyday and not seeing approval.

Well after reading all these replies it's very hard to stay positive. And I guess I just have to get ready for a long wait. Although I already waited for more than 9 months.

284 days and still waiting. Just found out that case is going through background check. Was told not to inquire for 90 more days. Something tells me that it will take way more than 90 days

so is it the FBI background check??? if yes how long on average it take? and does anybody been stuck in those checks for a long time while been on I-130 stage not after the interview?
what should I expect? how much longer should i wait? just really upset now with this situation. just feel like i will never get the approval. It's already been more than 9 month since I've applied.

Just heard back from senator. They said that our I-130 is going through background checks. Anybody had background checks with USCIS and how long did it take??
I've heard of AP and AR after the interview, and know kn some cases it takes years, but what about USCIS?

Mrs Z., I filled out my timeline...not that there is much to fill out, I`m still at the first stage after over a year. My husband did contact USCIS over 30 days ago and they opened a request but still no answer from them. He called 3 times last week and didn`t manage to talk to anyone helpful. All they say is to wait. I feel we are stuck in a rutt and this is never going to happen. I will mention to my husband about contacting his congressman.
I guess if the 90 day after being transferred thing is the standard....we should hear something in november.
It`s not like I have a bad life here in Canada, it`s actually pretty good. But, I did not get married to the one I love to keep being away from him. Between being able to get vacation time and high air travel prices, we really don`t see much of eachother. Talking on the phone is one thing, but we need more... I think we`ve been patient enough.
Wow. I thought I was the only one at VJ who has been transferred and not approved yet. I was also transferred on 26th had million touched but no approval. Tried calling them but no success. They keep telling us to wait more. Although once they said there was correspondence on Oct 16 but we have not received anything in mail, so I guess they just dont know what they were talking about. I will wait few more weeks but then will have to contact congressman again.
Since we got similar timeline, if you don't mine please let me know if you get any news on your case.

Well it does not say anything online besides that case is still pending. Just wonder what else could they possibly mail if it's not RFE. I guess I just have to be patient and wait little more.

well i'm one of the few who had been transferred from VSC to CSC and not been approved yet. I had several touches though.
we called USCIS and best we could get out of them is that there was correspondence on October 16th. have not received anything in mail soon. But was wondering if this could be a RFE. So my question is, when there is an RFE does it say that when you check the case status online?

if you read this thread somebody mentions that there was a case that had 5 months waived at the interview out of 2 years of HRR: http://www.visajourney.com/forums/index.php?showtopic=37200
When I was applying I had 18 months to complete the 2 year HRR. Now I have only 7 months left, but since my I-130 is not approved after being pending for more than 10 months, I guess I dont need to worry about it by time I get my interview. Hope this works out fine for you.
Also what did you right on DS-230 about 2 years HRR? I think there is a question about it.
