    I am from Germany and currently here on a J1 Visa. Me and my boyfriend (American) wanna get married. Do I have to return to Germany to get the K3 visa? Or can I just stay here and change my Visa status from here? And how long will it take to get the K3?

    Unless you have a home stay requirement attached to your J1 visa, you can PROBABLY simply marry and stay. I say probably because it depends on whether your decision to marry and stay occured before or after your latest entry to the USA.

    Did you first check if there is a home residency requirement on your J1. This is a very important issue in your case . Find that out before doing anything else.

    Me and my wife have not seen each other for over a year.

    Mainly because of my job. Where I'm never home and always work offshore and have no exact dates of being home. Once I'm home I can leave offshore anytime again. Also this entire time I was gonna go back to the USA as soon as I was getting my visa but the unexpected FBI name check which took over 6 months made this separation even longer for us.

    So please let me how bad can that affect me at the interview at the end of Sept. All this time we of course talked on the phone everyday and have lots of emails and chat logs to submit.

  3. My interview date is September 29th. I have to wait for 2 more months. Well I have been in this process for 18 months already so I guess 2 more months wont make any difference. Plus the embassy in Tbilisi, Georgia process immigration visas on Tuesdays only. Luckily there are 5 Tuesdays in September, otherwise I could have to wait for Oct interview.

    so just like imaisha said I have started to watch if the date of checklist on automated system will change.

    So today it did change from July 9th to July 11th. I called and the lady asked me if i mailed Ds-230 part II. I know i did, because it has been mentioned here many times to mail it but not to sign it. Then she said that nothing is needed and they are waiting on some processing here before completing the case. She didnt mention final review but just said some processing. Now I hope this is not AP because I already had a 6 months FBI name checks at USCIS making it total of 13 months for my I-130 to be approved.

    Any idea?

    Also I just received an email from NVC with a checklist. And it was asking for DS-230 package. Was generated on 11th not 9th. So not sure what was mailed on 9th then.

    Well today I got the automated message saying that my documents have been reviews and the checklist had been mailed on July 9th.

    I called to find out what was the problem and I was told that the AOS was accepted, and now DS-230 is reviewed and it will take like another week. She said the system has a problem and sometimes gives this message when DS-230 is not reviewed completely yet. So anybody else had this problem??? Is this a false RFE??? Should i be worried??

    Please share your experience.

    Little confused.

    Ok my wife dont work at all live with her grand parents. I want my aunt who lives in a different state to fill out I-864A. Can she do that? I thought she can, but now I see in form I-864a they only talk about households? for example what I put in relationship to sponsor?

    I just talked to ppl at NVC.

    I asked if Choice of Agent and Aos bill have been generated. She said AOS bill was mailed today to my wife.

    1) So can I go ahead and pay AOS bill online? Since I got the NVC case number.

    2)Regarding Choice of agent, I was told that it is not generated yet and to wait couple more weeks?? is that true? aren't they generated together with AOS ?

  8. My wife called me today to say that she received the approval letter from USCIS.

    We filed our I-130 in Feb 2008.

    After being transferred to Cali, FBI checks and add mailing additional evidence we finally got it our petition approved. It was a long wait for us. Just hope that the rest of the journey will be much faster .

    Good luck to everyone who is still waiting. Just be patient and don't let this process affect you life.

  9. Has anyone ever received a call from senator or letter from USCIS stating that case is with the officer and the decision should be made within 90 days.

    I was on FBI name check for almost 6 months. In the begining of March we received letter saying that my wife need to send them proof of citizenship.

    We mailed it. Case status online was not updated showing that there any activity on the case, but we have received that letter.

    So anybody ever had a similar update from USCIS ?? And did it take 90 days or less?

  10. I noticed exactly same thing back in August. Some of canadians had to go through additional background checks.

    I might be wrong, but I think previous long stays or frequent visits to the USA may triggers additional background checks. In my case I lived in the USA for over 7 years (plus I'm from the Muslim country), and now my case is with FBI since Nov 08. It's been almost 13 months that my I-130 is pending with USCIS and I was recently told nto to inquire on my my case for another 6 months.

    #$%^ USCIS and FBI!!!!!!!!!!!

    It is absolutely radiculous!!! You have to call to USCIS and request them for the immediate expedite, because you are out of range for waiting. Call right away, speak with the customer service representative and tell them that you must be approved in October 2008!!! Good luck to you!

    It makes no sense to call them. They just keep telling us to wait and there is nothing they can do about it. Same response we get form congressman's office. This just a complete bullshit.
