  1. Inform the Director of Academic Admissions or Designated School Official (DSO) where you have obtained your SEVIS (I-20). This way the DSO (your previous school) will change your SEVIS (I-20) record to reflect your status that you are now an LPR.

    Well I spoke to school official and he says in the system it shows that my I-20 or student status is terminated and he can't change it. He promised to make a phone call and see if he can do anything about this.

    I am PR since nov 2009. since then I have entered the US 5 times. First 3 times was with no issues at all. Last 2 times I was stopped for the secondary questioning. It is not a big deal, but I have to wait couple hours for them to review my papers. So second time I found out what was the problem. It appears that my studens status shows in the system as terminated, so I get stopped for secondary review. Obviously student status is no longer relevant since I am a PR now. The CBP officer apologised for this confusion and let me go. But I am pretty sure this is still in the system. How can I clear this out of system, since I travel quite often to the US and would not want to waste time at the airport.

    I called Kentucky Consular Center. Was told to call the embassy to reschedule interview. Call the embassy, and interview is reschedule with out any problem.

    A friend of mine wass selected in DV2011 and I helped him with all the paperwork to send to Kentucky office.

    Now he recieved letter today December 31st, saying that he had an interview schedules for December the 1st. So the mail seems to be delivered later by at least 2 months. They erased the date on the stamp of the envelope when it was delivered to him.

    My question is what can be done for him. In the letter it says he can get his visa till September 30th 2011. What can we do now

    Also he got married last few months back. Can he add his wife to get the via and what is the process.

  5. If I am reading your timeline correctly, you became a Alabama resident in late 2009, so for 2009 you should have filed a part-year resident Alabama tax return with your spouse. Normally income earned BEFORE becoming a resident of a state is exempt, but some states, as I know California does, do not exempt "foreign earned" income even if you have not actually resided there yet because you are filing a joint return (you would need to check with Alabama taxing authority on this). But you and your wife are getting the benefit of "married" tax rates and exemptions/deductions. And on your Federal Income Tax return you are definitely entitled to exempt your income up to the stated limit (around $80,000) before any is tax.

    So yes..it is definitely possible you have to pay tax on the state level on your foreign earnings...and being a green card holder you have no way around it.

  6. I am dealing with the same thing, as I have been living in Spain for the last few years. If you only earned 18000 dollars you should have been exempt from the federal taxes (I think anyone who earns under 70000 dollars abroad is exempt) but they can still get you on the state taxes. It depends on the state, but some will consider you a resident simply because you own a house or car there, even if you don´t live there at all (which was my case).

    Yeah I was exempt from federal tax. It's just the state tax I had to pay.

  7. Well I did declare myself as the resident of Alabama since I am a green card holder, but I only lived like 2 months out of the year. I was a full resident in my home country where i did pay taxes. So if I file this year as a part time resident, could that have a bad effect on my permanent resident status and then applying for citizenship in future?

    I hope this is the right place to post. I am a permanent resident since October 2009. Due to no job in the US i currently work in my home country. But try to visit the US every 3-4 months.

    Well to maintain permanent residency we all know that we have to file taxes. Taxes for 2009 I just filed about a month ago. Also I was sure since i paid taxes in my home country I would not have to pay anything in the US. But after filing Alabama taxes as the Alabama full-time resident I end up paying almost 800 dollars (with some penalties) on 18000$ foreign income.

    So my question is that correct? the income that was taxes in other country still has to be taxed one more time in the US? In 2010 I made about 3 times more, and I have a feeling i will have to pay additional 2k on something I already paid taxes on.

    I am sure there are some of you who have been in similar situation. Any input is very appreciated.

  9. i hope its gonna be cr1 anyways ..iam just terrified of how long its taking and i feel like its not gonna end ,i dun really know what to do ..its taking too long ..and my lawyer is telling me that he can't do anything until there is a decision made..i swear i feel that my lawyer is the one whom is making it late for whatever reason..if there is anything i can do please tell me about it .iam going nuts.

    My guess would be is that ur case going through additional background name check. Give it a little more time and the decision will be made on your case. Your lawyer really can't do anything. Contact your congressman, but then you will get a reply something like your case with FBI or something. There is nothing really they can do at this point as well. Just be a little more patience, even though I know it is really hard. Went through all this myself.

  10. when I married my wife she was 16 and I was 25. when she filed for me she was 18. At the visa interview the officer asked me what was her age when we got married. Then he said WOW and looked really shocked , and asked if that was legal. I told him it was legal in Alabama :). few minutes later i was approved for IR-1 visa.

  11. Un Freaking believable, All our paperwork was perfect to my knowledge. Zheng had so much support at Guangzhou from other Visa goers and they help to verify again our paper work and evidence. The interviewer asked my Fiancee 2 questions which she answered them perfect. She speaks very good English and she tried to present my EOR letter at the interview and other sufficient evidence but they did not want to accept anything and gave her a white slip. I am very successful and have made so much freaking money in this country and paid so much taxes in this country and this makes me furious that they would treat me like sh#$%, and they treat her like sh#$%, then it is as if my country who I can’t imagine how much I have paid in taxes would not accept any of our evidence. Like most of you we have spent over a year in our relationship committed and in love and it comes down to this B.S. #######. What Freaking proof do they need with a white slip,, , no offense, I am American Indian and I did everything next to NOT being WHITE, so #######, is this why I have a WHITE SLIP, USA is still in the Freaking south, it's now USA called Arizona, can't give an American Indian a break who loves a Chinese Woman.

    Point is Now American Indian will have to prove they are from USA, hmmm, I think I will move to China to be with the woman I love.

    I am so sorry and sad for this news... Any word on what was in the white slip? Sometimes they'll give a 'call in letter' to give more evidence, but it's white, as well.

    Any word on 'who' the VO was? (gender, apprx age, hair color, ethnicity)

    What’s hard, I know why it is hard, because I am not Freaking white in USA, this is why, the USA use the Navajo language to Fu#@$% Japan and now USA Fu#@$% cheat me and Zheng and now I hope the world can see American Indians were removed from this planet long ago. I would rather live in China with Zheng then go through this again.

My wife and I married in 2008 and she arrived in US Nov 2009 after 3 months she could not adapt to living in US and wanted to go home so I bought her a ticket after three more months she told me that she would not return to US so I flew to her country and got a divorce.three more months later she has changed her mind and wants to return will she have a problem at reentry she has a two year green card that is valid. Upon my return(USC) I got searched and questioned by CBP and they made copies of documents from my divorce I told them the truth.I was there for three hours before they let me in. Any thoughts for my Ex

    Just curious. Why were you searched and questioned for so long? Is it because of the divorce?

    Also another question. A permanent resident with 10 year GC who is divorced now, returning after 5 months? Could that cause any problems at the border? I know the marital status is not important anymore, but still.

  13. My I-130 took 14 months to be approved. Every time my senator/congressman tried contacting USCIS I would get the same answer. The case is with FBI and we should not inquire for another 90 or 180 days. So I guess your background check is taking longer. By the way in my case there were another person with same name last name and even birthday.

    And as Darnell said search this forum. There was a user who successfully filed a lawsuit.

    Good luck and try to stay positive. You might get an approval anytime even if they say to wait for another 90 days.

  14. I will give you my opinion. I was in the similar situation. When I filed my I-130 I had only 6 months out of 2 years requirement completed. And I'm glad that I have filed earlier and didnt wait. With additional background name checks and etc. it took over 14 months for my I-130 to be approved. So I would say you could go ahead and file everything now and go all the way to the interview.

    Don't think anybody will consider it as you are commuting the fraud if the 2 year home residency is not fulfilled. If this 2 years still be an issue, you will be notified by NVC (there were cases here on VJ), and then during the interview the officer will tell you the choices you got (like waiver or just coming back when the home residency is fulfilled). If there are only several months left out of 2 years then the officer still might issue the visa. I have read cases here on VJ where up to 6 months were forgiven. But again depends on how lucky you are. In my case during the interview the officer didnt seem to be concerned about my J1 visa. I actually mentioned it myself as the reason why I came back home. But during this 2 years I have traveled several times to Europe and nobody went through my passport counting every trip that I was out of my home country.

    I'm LPR in US and I got married in India 7months ago. Now I would like to apply I-130 for my spouse. Can I file I-130 from US-Embassy - Delhi? Or else can I apply for citizenship then I file I-130 once I go back to US? Which makes the process faster?? Is there any other immediate way to process the visa to bring my spouse to US with me? I was living in the USA for 6 years...

    Do I have to wait 3months to start naturalization process for my absence in US over 7-8months?

    Then what's the processing time for naturalization? My Physical presence is not there during these 7months of marital life, do I need to wait for 3more months when I get back to US and start naturalization process?? :crying:

    Please reply me ASAP...

    well i can't really advise anything. but how long ago were you out of the US for over 7-8 months? Doesn't that violate the continuous residence requirement? if it does then you will have to wait much longer than 3 months to apply for naturalization. But again I might be wrong. Somebody please confirm this.

  16. Hello everyone, I hope someone can help me. :-)

    My fiancé and I are getting married this month and we're just starting on our research on what we have to do in order to get the AOS going.

    I am currently here on a J-1 visa and am completing an internship. According to my visa and the DS-2019 I am not subject to the 2 year home residence requirement. That makes sense to me - I am not receiving any government funding.

    My big worry is my previous J-1 visa. I studied at a university here in the States and I received a student loan/ grant from my home country Germany (Bafög, if anyone knows what I'm talking about.. :-)).

    Even on that visa and DS-2019 there was no remark regarding any 2 year rule. I am still worried I may be subject to it though.. Does anyone have experience with that? I read that the entry on the Visa (or DS-2019) may be inaccurate and the USCIS investigates the whole subject a little more thoroughly than the Embassy employees that issue the J-1 visas.

    I tried researching if Bafög is considered government funding or not and couldn't find any information..

    I am despereate for some information regarding my worries and who knows, maybe someone who received Bafög and applied for AOS while here on a J-1 visa will read this. ;-)

    Even though your current J-1 visa does not have 2 year HRR, this doesn't meant that you HRR from previouse J1 visa is voided. I was in on F1 visa after having J1 visa and had to go back home to fullfil the HRR. You are getting the correct information. Even if your visa stamp or DS-2019 has no remarks, doesn't mean that USCIS will not find out about the 2 years. They do contact the Embassy and investigate this type of things during AOS process. I was told that by my immigration lawyer. Also there are cases of people who had J1 visas with out 2 year HRR but had hard times with USCIS during AOS.

    Now you can apply for a waiver. I am not familiar with Bafog grants and how strict they are. If you can get a no objection letter from them then waiver from the US department of state should not be a problem. In my case, my program was funded by US government so I could pretty much forget about waiver unless I could prove a hardship to a US citizen.

  17. I was on J1 as well but my FBI name check took too long so I did complete the 2 year residency requirement by time I had my interview. I was searching a lot over here and online about this type of situation. From what I understand is that your visa will not be denied but you will be told at the interview to obtain J1 waiver or wait till your 2 years are completed. Also there were cases reported where ppl still had 5-6 months to complete their home residency but they were granted visa anyway.

  18. Hey MythaG - it hasn't arrived yet? well - yer still within the 'normal' window of waiting, after POE date - don't sweat that part (yet).

    But - there's been 2 cases reported here on VJ (this thread has one instance ) where the beneficiary had to go into an ASC office, to have the fingerprints captured for Biometrics. I have only 2 points about this :

    1. is this new REQUIRED process for all? or

    2. I don't know if it's for ALL, or if for CERTAIN COUNTRIES, or if it's RANDOM, or if there was a bad fingerprint scan at the Consulate/Embassy.

    Keep an eye on yer postal mail. and good luck !

    I have entered this past Sunday and wasn't told anything about this new process. Anyway is it possible to call USCIS to fingd out about the new process. Because I was gonna leave and travel on my IR1 visa in case GC takes too long to arrive, but now even dont know what to do with this new biometrics thing.

    So I was waiting to have a successful POE before sharing my expirence with everybody.

    So after 14 months my I-130 was approved. NVC was pretty fast and I had my interview scheduled for October 29th in Tbilisi, Georgia.

    Interview went fine. I was just asked few standard questions, like where and when I met my wife, how I proposed to her and what did attract me in her. Also asked me about my previous stays in the USA and if I had any problems with law during those stays. He didn't seems really care about those questions, but it was just a standard procedure from what I understand. He was taking notes on everything I was saying.

    Then he asked if I used any different name or had a brother in the states, which I didn't. He said there was exactly same person with the same name and I think same date of birth. I guess that's what caused the 6 months long FBI name check. Well after asking all the questions he said everything was ok and I could pick up my visa the next day.

    POE in Atlanta was smooth as well. They took me to the green room. Took the envelop. Didn't ask a single question. Just fingerprints and signature for GC. Then the lady told me it will take 3-6 month for GC to arrive, but also added that it usually takes much less than that. I was out of there in like 10 mins.

    I would like to thank everybody in this forum for your assistance and support during my immigration. Don't know what I would do with out you guys.
