Been a while, but now that everything has settled I wanted to update those interested:

The writ of mandamus was successful - after the defense filed a MTD there was some back and forth between our attorney and theirs, but ultimately the judge did NOT grant the MTD and in fact ruled that a decision needed to be made on our case (the decision on whether or not to grant a K1 visa to my fiancee following her in-person interview many months back). Two days after this ruling we received the long-awaited email from the embassy indicating our AP had finished and it was time to pick up my fiancee's visa. 

Fast forward a few weeks and we are now safely together in US and got married about 2 weeks ago (very shortly after we arrived, just to be extra careful!).

I don't envy anyone still sitting in AP, but I hope that our case can at least shed some light / give hope to those who need it. 

Our MTD hearing was postponed by the judge until March 5, 2025. No reason was given. In AP now for 9 months. Will update when we get any more news.

Yes, the defendants filed a Motion To Dismiss (MTD) early December, exactly two months after we filed the lawsuit. Our lawyer then filed a response (called a Memorandum in Opposition to the MTD)  a week later, picking apart their argument piece by piece very nicely (it seemed to me the defense just copy/pasted standard paragraphs with little coherence in their MTD). There is a hearing set beginning of February for the judge to either approve the MTD or reject the MTD and require the defendants to adjudicate our visa. 

Hey, we're in the same boat. Fiancee interviewed in Poland earlier this year and we've been in AP for about 6 months. We filed a WOM at the 4 month mark and we're supposed to hear back from the defendants within a couple weeks from now. I'll post updates in case anyone is interested in how this works out for us.

Sep 12th filers here - we're also still waiting. Hopefully we'll get an update soon! I'll be sure to keep everyone posted.

We are September '22 filers, California service center (started in Texas but got transferred apparently.

We submitted an expedite request in February which was of course promptly denied, and now our application status just says "expedite request denied".

Hoping that its just showing the most recent activity on our application and not some final state of things. I will update when we hear back in case others are in the same boat.
