  1. For the K-1 you provide the I-134 Affidavit of support to your fiancee to take to visa interview, you do not send it to USCIS with the petition.

    At this stage USCIS cares less about your financial picture.

    In our case I make well above 125% poverty line so showed ZERO in the bank, they do not need to know these things if income alone is enough to provide support.

    The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

    In our case this what the I-134 included.

    • I-134 signed and notarized.

    • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

    • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

    • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

    • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
    My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

    If you are missing things like W2, then get simple IRS transcripts they are FREE from the IRS, and substitute nicely for IRS Returns.

    You will require a letter from your employer stating your yearly income. We got a letter from our bank stating the total amount of deposits for the past 12 months, when the account was opened and the current balance. The balance has no bearing on the Affidavit of Support.

    You need not mention your bank account or any assets, if your income alone is sufficient. An employer letter is nice. I had one but pay stubs are evidence enough when you've you now work for the same employer from which last year's reported income was derived. Or even not, provided they show YTD income.

    Hi pushbrk....as always, great info. I will not have a problem getting a lettter from my employer and also submitting copies of my pay stubs. By the time he goes in for his interview, I would've filed my 2007 returns and also have my W-2's by then. I feel so much better knowing that I do not have to mention my bank account and property values and just put Zero on those lines.

  3. Hi!

    I was wondering if the USCIS looks at how much money I have in the bank. Do I have to state it or is it optional? I make well over the US poverty threshhold for a household of 3 (including my fiance). I also have 401k account that I can liquidate, if need be - so should I state the 401k on "other personal property"?

    I'm just a bit nervous about the bank balance because what I have in there is not much. I can get the letter from my employer, my vested 401k statement, and my w-2's (if necessary). So having 2 out of the 4....would that suffice? I am assuming they look at how much annual income I make and not really the bank balance, correct?

    I wondering if anyone knows if I need to submit my birth certificate from my country of origin? I'm a USC by naturalization. Should I submit both birth cert & naturalization cert or would the certificate of naturalization suffice?

    I am also going to submit my US passport. Do I need to have my fiance copy the first page of his passport and submit?

  5. I have a question on the G-325A form. My fiance goes by his mother's last name since she is unmarried, although he has a stepfather but he never assumed his last name. Should he put down his biological father's name and last name on the "father's name" field or his stepfather's name (who raised him)?

    Please help....we're a bit confused as what to use on the Father's name.

    There are no step-parent questions on the G325a. He should list his father. Also, you say he "goes by" his mother's last name. What is his actual legal name on birth certificate and passport? That is his name.

    It is best to read carefully, interpret literally and answer accurately. No "goes by's" only "is".

    He uses his mother's maiden name since she is unmarried and all her kids use her name instead of their biological father's name (I know, not typical here but I guess it happens). I will have him write his biological father's name where it asks for the father's name. Thank you so much for the info...makes sense now.

    Well, we've actually been trying to find persons with their SO from St. Lucia as well. I've only been able to find two profiles but they didn't post much and don't really use the site anymore... There are a few other members from the EC whom have used the Bridgetown Embassy and they've been a big help.

    The only problem I've had so far with the embassy is that their packet 3 instructions were a bit misleading... You can read the details in the following thread: http://www.visajourney.com/forums/index.php?showtopic=90499 ...

    It's all been ironed out though. We're just waiting for the interview appointment.

    By the way-- fill in your timeline so that we can have an idea of how far you are in the process. It can also give you a rough estimate of you adjudication date, based on the results of other VJ members.

  8. Should not for USCIS they are more concerned with your US address so that they can mail you things. The consulate is concerned with the foreign address, make sure to have your fiancee's PH number on the petition, the consulate should call to confirm the foreign address.

    Include the phone number and simply use the address that will get a package to her visa DHL or other courrier. Otherwise, no worrries. FYI, there are no street addresses in Carmel, CA.
