  1. I have just received a letter from the US embassy in Dublin.

    I am worried because I just realized that I have a short version of the birth certificate...it seems to never get friggin' easier!!!!!!!!!!!!!!! Well I will have the long version bt I won't make it to get the certified translation on time!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! What do I do?

    I lived with my au pair programme family in NY for 3 mnths, switched families and lived in Chicago for 2 months, then my situation got very bad(I was being abused by the family) and left on my own. Friends from Poland helped me out. I lived with them for 6 months then met my fiance, we moved in together for a year. Then some problems came up at home so I went back to Poland. I am living in Ireland now. We filed for fiance visa, got approved and March 3rd I have my interview.

    The attorney is saying that I'll be ok, since D/S was stamped in my passport and there is no anlawful presence since neither IJ or adjdicator has found of the violation. Thats the story (short version).

    Just wanted to find out if anyone here has experienced and interview with similar past.

    I appreciate any info!

    No, there was no finding of violation and left usa on own accord.

    My understanding of Duration os Status is that a violation must be found by an adjudicator or an immigration judge.

    Yes, this is the case law on D/S. Had you been through such an interview for a K-1? Do you know someone who has??

    No, not at all.

    Hmm. Then did you remain in the USA, after you concluded your Au Pair owrk? If you depart the US before a determination is made, then there is no period of unlawful status.

    Yes, left the aupair early and stayed beyond a year. No determination or appearance before an immigration judge or adjudicator. We have researched all this and have supporting opinion from our atty. We are interested in the "real world" interview Q&A from the interview. Can you help???

  5. I am starting to freak out. For the inteview- do I bring my own birth certificate plus my fiance's (US citizen)? Or they only need mine? Sorry if it's another of these crazy questions!

    It is you who is applying for the visa...so the 'focus' if you will is on you....it should only be your BC that you must take to the interview. The consulate could ask for just about anything, and if you have a copy of the USC's BC by all means take it with you, but I doubt it will be needed.

    Actually that's what I thought, but sometimes I (and all of us here) get overwhelmed with all of this. And my perfectionism is coming out...

  6. I have been in the US on a J1 visa for 13 months and then some more. I have an attorney representing me in the process and he is saying that I dont need a police certificate from the US. I was searching one time on visa journey regading this topic and someone asked the consulate that question. They said you don't need PC from the US. I cant seem to find the source of that info here

  7. Hey, Tik got her packet 3 and it doesn't say anything about a Medical Exam..do they tell you about that when they send the interview date?

    I got my medical information in packet 3. It all depends on what the consulates rules are. They are different for different consulates. Some embassies require the medical exam to be done on the same day as the interview.

    You'll probably be the second case. First medical, then interview on the same day. The info will be included with the packet 4. Don't worry its a peace of cake.

  8. I went through a similar thing when I came home from England last time. It hurts like hell to be apart from the one you love so much! Glen and I spend every day on Skype together, but we've only been lucky enough to be together in person every 3-6 months. I haven't seen him since October 8.

    But you know what? The next time I see him will be when he's coming home FOR GOOD! We've been a couple since November, 2005. We started our Visa process in April, 2007. It's been a very long journey, but rest assured, it does end eventually... but really, it will be just the beginning. (L)

    PS I cant believe its taking them so long! It must be soooooooooooooooo hard to deal with not being together for this long!

  10. Every time I drop my love off at the airport I feel like this. The last time 1 month ago was the worst. I couldn't calm down, standing there and looking at him walk through security... For the rest of the day I felt like nothing makes sense, life lost its flavour, nohing really maters, felt like DEPRESSION. For the next week I put myself to sleep just crying for hours. And I didn't have anyone to talk to- I live with one roomate and she works nights, so when I got home from work there was noone to talk to. That just made me feel more lonely...

    A couple weeks later I am feeling better. Right now we're waiting for our interview date which should be in around 4 weeks.

    I know you'll feel better, and soon you'll be together! This is a very good time to just get busy, maybe visit some websites and check out what kinds of decoration you want for your wedding, look for a location. When you're busy time goes faster!

    Hope you feel better already after you've seen how many people replied to your post! You're not alone, there's a lot of us with similar experiences!

  11. I was just wondering if anyone else has experiences touches after NOA2. We received approval on 2/14/08 and have shown a touch every day since (including today, Sunday).....

    Congrats as well on your NOA2...yeah it does look like we are neck-in-neck. I actually don't even know what a touch is, or how to see if i have one. Sorry I am answering you with a question...lol...but are you guys gathering things for the papers before they get to Peru? Or are you waiting? Also, when are we supposed to turn in the sponsor paper (and proof of being employeed, bank statements, etc). Good Luck!

    A touch is regisered on the USCIS website. You need to be loged in to the website (they ask you for case number, and you create a username and a password- that way you can see if they are even reading your case at the moment- or doing almost anything).

    After NOA2 you should be gathering papers right away- like the proof of relationship, police certificates etc. You will need them for the interview. You don't send them.

    After NOA2 your case will be forwarded to the embassy in your counry and the embassy sends you a packet (3). The instructions will tell you what to do.

    You don't send the affidavit of support or the documents supporting it, but take it to the interview. Just read the instructions carefully!

    Right now it's tme to gather documents like; birth certificate, police certificate, evidence of relationship, affidavit of support, and get ready for the interview!

  12. Hah that was fast... Yeah it was actually my dad who recommended this site to me... 7 months? Really..? So it's not different from country to country..? No matter where your fiance is from, it takes the same amount of time? I mean, that sounds wonderful to me... Definitely better than what I've been hearing... I was seriously considering tranferring to a school in Canada, becoming a citizen there and then filing under their laws. Apparently they're much more relaxed over there haha. I was beginning to think that might be quicker :D Also nice to hear I'm not the only petitioner on her under the age of 30 (no offense ^_^). Thanks for your input!

    That's pretty much accurate. If you look up immigration timelines- for K1 you should get an idea of how it goes for different people from different countries.

    Can you please advise how correct is the expected date of NOA2 approval that is calculated by Visa Journey.

    On my case it says March 30.

    1 The problem is that i m in software and my compay is planning to send me abroad.I am not sure if i should go or not because if this timeline is correct then i might be soon going to US.Generally,after NOA2,how long does it take to get the visa.Please advise whether i should stay in my home country?

    2 Also what is there in packet 3 and 4.Do i have to go to in person to the embassy for these packets

    3 Does anyone know how much is the waiting time for the interview if my embassy is in Delhi,India?

    4 How long does it take to get the passport back after stampig

    The NOA2 comes differetly for all of us. Lately there has been aroun 4 months wait time from NOA1 to NOA2. After that the case goes to NVC and from NVC to the consulate in your country. Sometimes it takes a week for the consulate to send you the packet 3 sometimes more. It all deends. It's very hard to advise on that! I think you should stay commited to the visa process but your whole world shouldn't revolve around it. You might go crazy.

    It seems that you should be going to the US around 7-8 months since the NOA1 date.

    Packet 3 contains documents(again- depending on the consulate): checklist for the documents you need to bring to the interview, notification of readiness- which you need to sign to let the counsulate know that you are ready to interview with them, Affidavit of Support form,DS 156K, and DS 230 PART 1, also sometimes Medical Examination Information sheets.

    Packet 4 includes an INVITATION to the interview-with the interview date. Sometimes consulates issue a packet 3 and 4 together. It all depends.

    I can't advise you on you going or staying n your home country. That should be your decision.

  15. I assume its because its being forwarded to the NVC

    I have received a touch after the consulate in Dublin has sent me the packet 3 and after I have sent back the packet 3. Now I'm waiting for the last packet (4) with the interview date, and had a touch last week. First I started to worry! Then someone on the forum has said that if there was anything wrong they would notify you (e-mail).

    Everything is ok. They register a touch even if they move your files from one cabinet to another!
