I am planning to. my H1B doesn't expire till end of year. any idea how long ap takes? thanks

Hi, just wondering what everyone else's progress is. I am currently on my H1B but married to USC. AOS was filed in Sept 2022. I received my EAD in Jan 2023.
Is the next step the interview then GC? if so, how long is the typical wait time.
if my H1B expires, can I technically still work in the US since I have my EAD? for traveling purposes I would just need to apply for advanced parole?

thanks, if I-130 is still pending then I should?

If spouse is US citizen and I'm on the h1B. do we need to file taxes as "married filing jointly"?

Hi I have received a rejection notice and my whole package was sent back.
The AOS package included:
- I-485 (outdated version was sent)
- I-864
- I-131
- I-765
This was the rejection notice for I-485
rejection notice for all the other forms:
I see that each form have been stapled and some printed text at the bottom also initialed by a person.
is a new cover letter needed?
My question is do I send back all the forms as is (stapled by USCIS with the rejection notice on each form) with the updated I-485?
I also realized that there are newer editions that came out for some or the other forms. do i need to send newest edition even if the expire date is next year? the package that was sent back also included the envelope postal date that I send it on.

Hi,
When do I need to submit I-693? Is it supposed to be submitted with the AOS package? thanks
-
on the USCIS site it says:
Also include a copy of every Form 1099, schedule, and any other evidence of reported income.
Is this needed if I have included tax return transcript, last 6 months of paystubs, and employment verification letter?

I was in school in 2019, do I need to provide letter regarding the missing year? thanks

For form i-864 it says "have you filed a federal income tax return for each of the three most recent tax years?" do they mean 2021, 2020, and 2019? or just most recent years?
I did not have income/filed in 2019 but I have a tax return for 2018. so can I use 2021, 2020, and 2018?

Do I have to write the reference number anywhere on the i-485 form?

I am currently on h1B work visa and have filed i-130 online in Aug 2022.
I am planning to submit i-485 soon. when mailing the i-485 do I need to include the original i-130 receipt. What other documents do I need to include so that it’s considered filed concurrently?
Are there any other documents needed other than I-130 and I-485?
What is the approximate timeline? Thanks

I am currently on H1b (and married to a USC). I have recently submitted the i-130 online.
I will be filing the i-485 soon.
- Since I filed i-130 online do I only need to include the i-130 receipt with i-485? Is there a place to fill out receipt number inside of form i-485
Are there any other forms I need since I am currently on H1b?
- do I need to wait to file these other forms?
- such as i-131 and i-765

what is needed under the additional proof of marriage section. so we don't have an extensive history on the joint bank account since we just opened one a month ago. and for the lease my spouse has already renewed so my name is not on it. what other info can I provide for proof of marriage? thanks

Is a lawyer needed for I130 & I485? Will it speed up the process?

I will add that the one advantage holding a long term non immigrant visa gives you over other married couples (where the alien beneficiary is in the USA on a visitor status) is that you don’t have to worry about accumulating unauthorized presence if you make mistakes in your I-485 package.
You can keep trying and thus keep doing the DIY thing by trial and error without pressure. The visa journey immigration guide for you makes the process straightforward.
Thank you for the help! Do you know if I can apply immediately upon arriving to the US or I have to wait a few months?

So I have to apply for I-130 and then apply for I-485 or I can apply for both at the same time?

How long does AOS typically take from h1b if already married to us citizen?

Thanks for your help! Is I-130 needed if I am already in the US via the h1b?
if I-130 is filed do I need to return home?
I-485 status: "Your case is taking longer than expected to process."
in Adjustment of Status Case Filing and Progress Reports
Posted
I have been checking the status of my case and previously it indicated an estimated time of 6 months. However, the current status changed to the following:
Your case is taking longer than expected to process. You do not need to take any action at this time.
Your next step: USCIS reviewing your case
Has anyone else encountered this situation? Any idea how long it will take? It has been 11 months since I submitted my application. Thanks.
