    I have been checking the status of my case and previously it indicated an estimated time of 6 months. However, the current status changed to the following:

    Your case is taking longer than expected to process. You do not need to take any action at this time.

    Your next step: USCIS reviewing your case

    Has anyone else encountered this situation? Any idea how long it will take? It has been 11 months since I submitted my application. Thanks. 

  2. Hi, just wondering what everyone else's progress is. I am currently on my H1B but married to USC. AOS was filed in Sept 2022. I received my EAD in Jan 2023. 

     

    Is the next step the interview then GC? if so, how long is the typical wait time. 

    if my H1B expires, can I technically still work in the US since I have my EAD? for traveling purposes I would just need to apply for advanced parole? 

  3. Hi  I have received a rejection notice and my whole package was sent back. 

    The AOS package included: 

    1. I-485 (outdated version was sent)
    2. I-864
    3. I-131
    4. I-765

    I see that each form have been stapled and some printed text at the bottom also initialed by a person. 

     

    is a new cover letter needed?

     

    My question is do I send back all the forms as is (stapled by USCIS with the rejection notice on each form) with the updated I-485?

     

     

     

    I also realized that there are newer editions that came out for some or the other forms. do i need to send newest edition even if the expire date is next year? the package that was sent back also included the envelope postal date that I send it on. 

  4. I am currently on h1B work visa and have filed i-130 online in Aug 2022. 
     

    I am planning to submit i-485 soon. when mailing the i-485 do I need to include the original i-130 receipt. What other documents do I need to include so that it’s considered filed concurrently? 
     

    Are there any other documents needed other than I-130 and I-485? 
     

    What is the approximate timeline? Thanks

    • Since I filed i-130 online do I only need to include the i-130 receipt with i-485? Is there a place to fill out receipt number inside of form i-485

     

    Are there any other forms I need since I am currently on H1b?

    • do I need to wait to file these other forms?
    • such as i-131 and i-765

    I will add that the one advantage holding a long term non immigrant visa gives you over other married couples (where the alien beneficiary is in the USA on a visitor status) is that you don’t have to worry about accumulating unauthorized presence if you make mistakes in your I-485 package.
     

    You can keep trying and thus keep doing  the DIY thing by trial and error without pressure. The visa journey immigration guide for you makes the process straightforward.
