Yes, I got it. Don't overthink it, just send them the marriage certificate again. I also added the passport information pages for both of us, the entry document and a cover letter stating the entry and marriage dates, signed by both of us. Probably way more than was needed, but I got approved after this.

Thanks... you got approved ? you are april 2022 filer ?

As far as denying a visa is concerned, if you have presented everything truthfully and correctly then that's the max you can do. They have to make a decision based on their own parameters. I am positive if the case was dismissed and all then you should be OK 👍

I am not in the same boat but recently had a discussion with a petitioner who was actually incarcerated for over 3 years in a federal prison on a federal charge (conspiracy) and he was able to get his beneficiary here without any issue. They grilled the daylights out of her asking her/telling her about the minute details of his criminal history but in the end the visa was issued based on their relationship being considered bona-fide.

Yes! Im staying positive because i was innocent in that case and im still innocent.

The petitioner having a criminal record is less of an issue (unless it's Adam Walsh related): they will grill as.a means of ensuring the beneficiary knows who they are marrying.

A beneficiary having a criminal record is different.  The information is less about the relationship being bonafide and more - in my opinion - about trying to figure out if the beneficiary would be a criminal risk once in  the US.

I mean people get arrested all the time and anyone can get arrested even if innocent and people also get falsely charge for something they didnt do. I dont think a charge would cause such issue if case was dismissed as it was mentioned to the judge showing the person is innocent.. Isnt it suppose to be more difficult if was convicted, fined or sentenced ?

I know no one can tell the outcome, only the officer, but i

Really trying to find out if anyone here been through this and got visa and how did the consular reacted to the dismissed case.

You have provided all the documents pertaining to it? With maybe an explanation letter?

I am also assuming that they asked you about it because it was disclosed during the actual i129F filing and all?

It was not a surprise to you or them to be brought up during the interview itself?

Yes the right and correct record was submitted along with the other doc and my passport as they requested. Yes on ds 160 i told the truth and at the interview as well. All they wanted is 2 missing doc 1 is which court record and passport back. Someone said they would have denied at interview but they didnt and asking for missing documents and my passport back thats a good sign so idk..

Were you charged ? In the same boat ?

They will look at it NO question about it,

Just be honest and disclose everything in the application

As far as denial is concerned Noone can tell you with certainty that it will be a cause for denial or not.

But yes it will definitely make them scrutinize your application a bit more for sure.

    Ok thanks.. God is good.

If anyone on here been through this process with a charged and dismissed case, please share your experience.

  6. Anyone did their us medical and was told to get a medical report from doctor to show that you were treated and good? How long did it take to get the reports and if you're in jamaica and was treated at a public hospital like Kph or chest etc, how long did it take ?

3 weeks oh boy! If he had his interview date set and show the police at the door the proof, they would have let him do it urgently before interview and get it in 5 days if was express thats what we did.

Good luck with everything as well.

My husband has to get his court documents as well. He said it doesn’t take very long. He was able to get a court doc clearing his passport in 1 day, so I am hopeful the process to get all the records needed for immigration will be just as fast. This is unlike the police records which are taking 6 weeks just to get an appointment to submit the request.

Got it done and court said 1-2 weeks so idk if going be same for you.

Ok thanks and Yes police records are taking forever now. Hopefully it don't take long to get court documents. Did he get his court doc at the court he was dismissed from or do courts send all dismissed documents to supreme court?
