    Since your wife is in removal proceedings . Her green card has to be granted by an immigration judge. After the I-130 is approved , you should be called in to uscis for an interview . This interview will be a stokes interview ( since she is in proceedings). Once you guys are successful with the interview , you appear before the immigration judge with the approval notice from USCIS. Everything is now in the hands of the immigration judge and the government attorney. You need a knowledgeable Immigration lawyer to assist with your case . As far as I know you wife do not have to leave the country to be interviewed. As far as your waivers I’m not certain since from the cases I have seen the alien did not disobey the notices . They appeared to the immigration judge once the notice for removal proceedings was received. You wife can be successful, she needs to appear in court when she receives notices and hire a good attorney. Best of luck .

    I attached a portion of the RFE and the evidence they requested. Our response is completed and I'm about to mail it, but I'm worried if what this letter means is they absolutely need pictures. We're sending additional evidence, but we feel blindsided being asked for these photos because we had always thought pictures with dates written on them are garbage and non-verifiable, so we don't have any from specifically the time period they requested, nor did we send any with the original I-129F packet.     I received this RFE for my I129 application I filed for my fiancé. USCIS requested additional evidence to prove we met within the 2 years before the application was filed even though I submitted passport stamps and flight itineraries. To prove we met I sent photos , hotel receipts , and written affidavits from people in his country stating they have seen us together during said periods . I also included a letter explaining my trips and everything we did during the trips . The case was approved. Send them all the evidence you have and write a written explanation. Good Luck .

    That’s strange. All the cases of DS 5535 I’ve heard the embassy contacted the beneficiary before or upon mailing back the passport. From which country is your fiancé coming?  What did the CO say at the interview? 

    Very weird because at the interview the CO said congratulations, you qualify for the visa . Took the passport and gave a slip of paper to collect in a week .

    Did the consulate return your fiancée’s passport at the interview or after the interview?

My fiancé was told by the CO that his K visa was approved and will receive his passport in a week . 2 weeks later the embassy asked him to come in to collect his passport and original birth certificate. He was not given any documents or explanation. Case status in ceac says “ready”. And has been updated 3 times . We have sent emails but still no answer . Anyone had this experience? We are totally confused .
