    My wife filed for divorce today, Oct 20th 2010, and she gave me the paper, we'll be divorced in 90 days. So will I be able to apply alone as divorced before my card expires within 3 months (which is next month.)? or do I have to wait until the 90 days is over and that the divorce is final? If I do wait 90 days, I'll have only about a month before my card expires.

    First you need to start your divorce process. You have 90 days to file for ROC before the 2 year expiry date and you MUST file by then. You will file as divorced although the divorce isn't final and you'll get the RFE for the divorce certificate. You will have a certain amount of time (don't know how long) to submit the divorce decree so it's something you REALLY need to get started.

    As for how to file for the waiver, I don't know. Try reading the guides and the forms, usually the answer is there.

  2. You are only allowed to file together if you are happily married, living together. Hence, you need to file with a waiver. You will have to show that you ENTERED the marriage in good faith and that you DID share house, bed, and finances together before you separated.

    You can send your I-751 not earlier than 90 days before your Green Card expires. Since you need to be DIVORCED before the I-751 can be adjudicated, you'll have to get that show on the road. USCIS does not recognize separated as a state of a relationship. Married and living together, or divorced and living apart.

    Thanks for your reply. Yes we got married in good faith, and we shared everything together, since I moved to US in June 11,2008 till Jan 2nd, 2010. And I have enough evidence to prove that. The only thing that I still need to know is how to apply. Would you please, explain more what you mean with "I need file with a waiver" How?

  3. My wife and I are separated for about 10 months now, and not divorced. I entered US with a K1 visa, then we got married. I got my green card in 02/23/2009. So in a about a month I will need to apply for removal and I have some questions that I need help with.

    1 - Do I have to apply separate or file together?

    2 - What's difference between them?

    3 - If we apply together, how can I mention that we are separated for 10 months?

    4 - If I apply separate, which option to select on the form I-751, since we are just separated, and not divorced. The only option that is close to my case is the second one. "I entered into the marriage in good faith, but the marriage was terminated through divorce or annulment."

  4. Well we finally got our RFE from CSC. They want a form I-693 filled out and signed by a Civil Surgeon. Anyone else have this?

    yep, same here... we were even asked for our marriage certificate, which of course is included in our documents submitted to their end... oh well... the soonest that we can submit the addt'l requirements so we can rest for a while...God bless us all!!!

    We didn't get asked for the marriage certificate and I know we sent the vaccine record. They seem to lose a lot there. We can't get in to see the Civil Surgeon until Feb. 6th now. Hopefully they won't ask for anything else. I'm ready to be done with them for a while too :wacko:

  5. Hello all, we just got another touch on the 22nd, one month and one day since the last one!

    No emails or updates yet though...

    Anyone think we should be excited about a possible approval soon?

    Honestly I don't know if you should be excited or not. Several of us had touches and then out of nowhere were issued RFE's. I'm still waiting for ours to see what they want. We were starting to get excited until that...lol. Good luck to you!!

    :( sigh I have no idea what for ... I thought we have everything right so now im wondering and worried :S I thought he was so close to being approved and now this, this sucks

    We seem to be on the same timeline. My husbands AOS was transferred about the same time and touched around the same days. On Jan. 17th they sent a "Request for Additional Evidence" to us as well. I can't wait to see what they want. Good luck!

  7. My husbands EAD production was ordered on Nov. 19, 2008. Can anyone give us an estimate timeline that they'll send the Approval notice? We know of a job opening up in his field and he'd really like to apply for it. We're thinking about taking the chance and sending his resume next week for it. Thanks in advance!

    My EAD card arrived 4 days after it was ordered. I'd apply for that job now. Some VJers have sent out resumes before their EAD was approved because it often takes a while to hear back about resumes. Even if you hear back right away, your husband can explain that he's work-authorized except that he just has to receive the EAD card that has been ordered. It'll probably have arrived by the time he gets to the interview stage. :)

    That is what I think too. I was just worried that he'd get to the interview stage and still not have the EAD. I don't want anything to look bad on his end due to the fact that their aren't a lot of jobs in his field where we live. I've looked at several timelines and they all seem to be fairly quick to receive the EAD card. Thanks for the reply :)

  8. Hi everyone! I have not posted on this topic yet, but I thought I'd reply today. My husband and I sent his AOS & EAD application in July. His NOA1 was issued July 23rd. We did have an RFE for the AOS and it was transferred to CSC on 10/14. We have not received a letter from them saying it was transferred or anything. We are also still waiting for the EAD. I did call last week for an inquiry and that was not helpful at all. I was just wondering how many of you are still waiting for your EAD cards?

  9. My fiance had his interview on May 7th and the interviewer told him that they'd call in 1-2 weeks. I know they say this a lot, but she assured him of this. I decided to call the DOS this morning to check the status of his visa. She told me that our case is at the Embassy and I can call them. Has anyone else had this experience or know what this means? I'm thinking that he is done with AP and we're just waiting on Casa, but I'm not sure. Thanks for your help and suggestions.

  10. Thank you everyone for the prayers and well wishes. My SO has called me and everything went very well. He saw the interviewer around 10:45 and he said that she was very nice and friendly. She felt more like a friend than an interviewer. He asked what he should tell me after and she told him to leave his passport there so he doesn't have to make 2 more trips to Casa. She said that they will call in 1-2 weeks. He said that he got the impression that she wanted to give him the visa today, but she said that they have a lot of work right now. If he doesn't hear from them in 1 week he should know it is from that. She did tell him that it will be 2 weeks if he doesn't hear anything in 1 week. We are very excited with this outcome. She didn't ask a lot of questions, but what she did ask was "What are my kids' names", "What are their ages", "Will he be a good father to them", and "If he really loves me". They also asked him why my 1st marriage didn't work out. Thank you again!!

  11. Hi everyone. I just wanted to thank everyone here. I am very thankful for Visa Journey. I haven't posted much, but I've read and searched for answers to our questions a lot. Without the guides and the topics that have been posted, I think we would have been completely lost. My fiance's interview is tomorrow in Casablanca. We are really hoping for a good outcome.   12. Hi everyone. I just received our letter from NVC saying that they have our petition and it will be sent to Casablanca. My question is, when I call the automated phone number it says that it has not been received. I have tried the case number from USCIS and the new number from NVC. Has anyone else had this happen? I'm not real concerned about it, but would like to fix it if there is something wrong. I'm calling 603-334-0700. Is this the correct phone number? Thanks in advance!!
