Exploring some options here but my sister in law recently found love.  The topic came up which is what happens if they decide to take the next step.  My wife filed for a family based citizenship for her sister 5 years ago with the understanding that it would be granted sometime in the next decade or so.

     

    If she were to file for the K1, will that have any negative effect?  Does she need to withraw her application?\

  2. My wife who is a citizen now is telling me that it is near impossible for anyone from South Korea to get a B2 visa and that it will take months to process.  Is that true?  Is there a strict filter on B2 applications from Korea?  

     

     

    we are just exploring options for her sister who was recently refused entry because 2 yrs ago she miscalculated her 90 day stay and had the plane ticket for the 91st day.  

     

    My wife is saying that she (wife) was refused a B2 back in 98-99 because her background wasn't strong enough...ie education, finances, reason for visiting, etc.  At that time she has no ties to the US.  All her family was in Korea.

My sister in law came to the states under the VWP.  Has done so many times.  She left for a day trip into Canada and upon her attempt to return, she was denied entry.  Reason?  Back in 2015 my sister in law goofed on her plane ticket and made reservations for the 91st day of her VW stay. In other words, 90 days ended on Jan 11, and her plane was on the 12th.  2 years ago.

     

    My question is how long is the ban for?

     

    Right now she can't even come back to the US to gather her stuff nor fly back on her original ticket. 

  4. sorry in advance if this topic has been discussed but I could not find it.

    I am wondering how the processing times are deciphered. For example, I am looking an I-130 and the current "processing time" states July XX 2011. Well what does that mean? they are working on apps from July 2011? My application date is March 2013. So does that mean it will be another year and a half before it gets looked at? Or completed?

  5. I spoke to a tier 2 "officer"

    she was very adamant that it would be rejected because I did not file it "at the same time as the i130."

    I did not include the NOA letter, but I did include the number on the i485 form. I wasn't aware that it had to be included in the packet. *sigh* so maybe it will be denied.

    I was hoping that my applicant would not have to return back to their country while the i130 is being processed.

    My wife who is a US Citizen (thanks to me) wants to get a permanent residence for her mother. I admit I was a tad busy and I filed the i-130 without the i485. I filed the i485 a week later when it turned out that the immigration process would go beyond her visa period. I was told that this would allow her to remain and continue her i130 process.

    I called the USCIS today and asked what the status was and some officer got on and told me that although they see the i130 pending....they will reject the i485 because I did not file it at the same time as the i130. Is that correct? On the i485 it allows for process AFTER the i130 was filed and even is directed to a lockbox versus the standard processing centers. Or am I mistaken?

    they said I would have to resubmit the I-485 AFTER the the Green Card is approved

    help!

  7. I filed for my sister in August 2010. Last year, right about 2-yr mark I received approval notice - hard copy - never really bothered with online tracking given how long it will take. What I did is when we moved, I sent I-865 for a change of address and a copy of NOA1 to CSC (this even though they don't have a I-864 on file from me yet but the case is still processing through the system).

  8. So I spent an hour on the phone yesterday with a rep from USCIS who really didn't help much except to put in a research request. I also scheduled an infopass appt online.

    All of a sudden this morning I get an email.....

    "The last processing action taken on your case

    Receipt Number: XXXXXXXXXXXXXXXXXXXXXXXXXXXXX

    Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Card production ordered.

    On December 16, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register"

  9. Its been 51 days since I submitted the information requested on an RFE (missing g-325 was requested after initial interview) Was told that everything was pretty much approved during the interview. Only hold up was that the 325 form. Sent that in on Oct 25. Haven't heard anything since then.

    I seriously don't think it should take this long. When I ask the idiots at USCIS they keep telling me that according to my case status, as of Jan 24, 2008 it is still being normally processed. ITS ALMOST A YEAR NOW.

    I got lucky on my call with USCIS who took a service request even though it "technically" is still within normal processing times. (I said initial filing date was Dec 2007...she heard Jan 2007) So don't know what that will do for me but I am starting to lose patience.
