Did any of your partner’s answers to the ESTA questions change since their last application? Has he/she visited any country on the travel restriction list? These would be Iran, Iraq, North Korea, Syria, Libya, Somalia, Sudan, Yemen, and Cuba if I’m not mistaken.

No the answers didn’t change and she hasn’t been to any of those countries.

  2. My partner’s ESTA has been denied and we aren’t given a reason why. We have flights booked to the US (I’m American) and we had no trouble getting her ESTA approved before. Does anyone have any advice on what to do? We have delayed our flights by one week but now I think I might be travelling back on my own..

Oops, now I see that you wrote 2021, not 2022!   In that case, yes, you may well be much further along in the process by then.  It’s possible she may even have her visa by April.

I would suggest you look at recent London timelines to get a more accurate view of how long the NVC to consulate/interview part of the process is taking, as it could be tricky to plan for a long trip over.

Okay! Any chance you can help direct me to the recent London timelines please? I have trouble navigating this website :)

Yes, that is the length of time it takes to adjudicate/approve your petition.

Once approved, it will be sent from the California Service Center (CSC) to the NVC (National Visa Center), where it will wait until requested by the London consulate.  That part of the process generally takes another couple of months, depending on how backed up London is.  They will notify you (or the beneficiary) of next steps in terms of scheduling medical, obtaining police reports and scheduling interview.  That part is consulate-specific and subject to change, but in general that is the course of events.

There is not a lot you can be doing at this point, besides getting your available IRS transcripts (i.e for 2020, 2021, and eventually for 2022).

As you can see, there is a lot of waiting during the immigration process.  Best luck.

So once it’s requested by the London consulate, that’s when it generally takes a couple months for the interview to be scheduled?

I’m trying to get an idea of timing…simply because my fiancée is coming with me to the US for 3 months in April and we’re supposed to hear about the petition approval around Feb/March… so if she gets a notice for the interview whilst she’s in the US…you see my concern?

  5. Hi all. My fiancée is from the UK. We filed the 129 and it was received on 4th November 2021, got the notice 6th November 2021.

I’m confused on the timelines, as when I checked a few months ago, timeframe said 13 months but it’s not jumper to 15.5 months.

    1. What exactly am I waiting for in this time period - Is it the interview?
    2. How soon does the interview get scheduled after this wait period?
    3. What can I be doing during this time to get ready for what comes next?

As of early 2021, the filing fees for the K-1 process were $535 for Form I-129F (filed with USCIS), $265 to apply for the K visa (paid to the consulate), and $1,225 for Form I-485 and the adjustment of status packet (filed with USCIS), including the biometrics fee. That brings the total government U.S. fee to $2,025.

And as far as timing goes, approx when does the K Visa (to consulate) get filed? And adjustment of status packet is AFTER visa gets approved right?

You asked if sending extra things(your photos) needed. I'm telling you that the only time sending anything extra with the petition is beneficial is when dealing with high fraud countries.

If you want to send the pictures go ahead. As long as you have the evidence that you truly need to show - Meeting within two years of filling.

Ohh okay. As far as evidence of meeting goes, I have both itineraries for my flight there and back - as well as one boarding pass from my flight there and one boarding pass from my flight back. I have screenshots of our many, many FaceTime calls since I’ve been back (evidence of ongoing relationship). Does that seem sufficient?

Members that have added everything under the bus are usually form high fraud countries. This is called preloading. They do this as many high fraud countries tend to be much harder and they do not always get to hand over more evidence at the interview.

    I’m sorry? I don’t understand what you’re talking about…

  9. So, I have had conflicting answers on this. I have heard that some people include their photos with the fiancé during the interview, but I read that you should include 2-5 pictures (names and dates on them) in the envelope when you send the K1 application…is this true? Should I include some photos as well? I have included flight itineraries and screenshots of our FaceTime calls etc already.

On January 25, 2021 President Biden signed P.P. 10143 continuing the suspension of entry of certain travelers physically present in the Schengen Area, the United Kingdom, the Republic of Ireland, and Brazil, and expanding restrictions to include travelers present in South Africa.”

    and

K visa applicants who are physically present in a country covered by any of the COVID related geographic proclamations, who are not plaintiffs in Milligan v. Pompeo, and who are not eligible for a National Interest Exception cannot be issued a K visa and thus will not be scheduled for a K visa interview while the geographic proclamations remain in effect.  K fiancé visa applicants are not spouses of U.S. citizens and therefore are subject to the geographic proclamations.”

  11. Hey all. With the letter of intent to marry - do both signatures and dates need to be literal “pen to paper” signatures - or if the document is signed by my partner - she scans and sends it to me - then I print the document and sign it as well - will that work? Or can the document not be “scanned” by one party?
