  2. Voy a preguntar en ingles porque yo no confio en mi español.

Is anyone familiar with the FORMATO AUTORIZACIÓN PERMISO DE SALIDA DEL PAÍS PARA MENORES DE EDAD? My wife will need permission from her ex for the two children to leave the country. We are not sure how to answer questions 3 and 5. #3 asks for the "Propósito de viaje del menor", Do we say to live in the US? To study in the US? Or what? This leads to the concern with question 5: "Fecha de regreso o entrada al país del menor". We don't know when or even if the kids will return to Colombia, as the idea is to live in the United States. I certainly don't want to lie about anything on this form, but we also want it written so the father will sign it giving permission.

Any experience with this? Or ideas?

    Thanks,

    Charles

    Sent you a PM :)

  3. Im not sure if i have all info, i know, need the birth certificate, marriage license this two have to be inextense (longer form), copy of passport page, passport Pictures. I dont know nvc ask for the permision, i was thinking that this i can get when im There and give it at airport for exit

Well way Back in 2007/2008 we needed a letter from the Mom to be sent a( To NVC see my time lien ) for permission for me to bring the boys. Also in Colombia all kids under 18 need a Permiso every time they leave the country without both Parents. I would look into this as soon as possible to make sure there are no delays when all is approved and ready to go. As I am not familar with the DR I am at work and get a firewall when trying to look it up.

Start getting all documents now before time to make sure you are ready to go once it gets to the NVC.

Just a question does the other parent allow the children to immigrate to the US?

    How old are the children?

  4. Can't file K2. Her mother is already here. We had to go the I-130 route.

Ok So a few questions :)

How long have you been married to the Mom? If less that 2 years daughter will get a conditional card,or CR2. the time is basically the same as far as stats of the CR1/IR1 as they fall in the same category. Did you the US citizen file for the child?

Good Luck to you hope your daughter will be here soon :)

  5. Well, things are moving..albeit ever so slowly I'm sure. Got my NOA1 text and email today around 4:00PM.

    Couple of quick questions:

What type of visa is this going to be for my step daughter? IR2?

Does the visajourney robot give you an estimate for how long it's going to take? I created another profile to add a new timeline.

    Thanks in advance!!

What did you file for your step Daughter? Did you go the K-2 route as it shows you as K-1 filing? this will help with the estimates.

  6. HUH My Spanish writing not that good, What you need to be sure of is when it gets to the NVC to make sure they are linked together before you pay the first one. Since they are both for you. When it comes time do not pay anything to the NVC until you see where both cases are showing. Yes its been a while but our 2 I-130 stayed together the whole time. Just make sure when you pay you have both cases as then you know they are together.

One will be approved before the other but that does not matter as once it gets to NVC you can link them.

    Good Luck.

DO you have all the info on the exit requirments for the children from the DR? like other parents permission etc?

  7. Hello fellow Journey Member,

Step son is getting ready (About dang time lol ) to apply for his cistizenship, however he can not find his old passport with his exits and entries. I look up that we can do an FOIA request. Do i just make a letter or is there a sample one here that did nt come up when i searched. Thanks for the help as always....... we still have 3 more for citizenship but funds are low and all that jazz

  8. Does anyone know if the letter from the other biological parent must be submitted to NVC before they schedule the interview?

YES it does back in 2007 They ( NVC ) sent an RFE to us for not having this letter. Delayed us about 45 days. Also be sure to check the exit requirments from your country once the child/ren get the visa as this can hold up the exit from their country. We had to go the the Colombian emabassy in NY and have the Mom ( Yes she was here is US Long story ) send a paper to colombia saying the kids could leave the country with only one parent.

  9. Marriage has been exactly 2 years and 1 week as at the date the kids POEd.

    Marriage April 2012

    Green card September 2012

    Kids came May 2014

Can kids file ROC together with their father? Please say YES..

    Lol.. Thanks

There would be no way for them to file same time as their dad unless they recieved their GC along with him. Wait for the kids GC as they may come with the 10 year card based on your Marriage being over 2 years. If not schedule an info pass as I know some here have been through this and gotten the 10 year card once card arrives.

Good luck and hope they get the 10 year card. Do not make assumptions check the dates on the cards honey

  10. Good day y'all,

Please i need help with translating the attached document from spanish to english. Husband's kids came as unaccompanied minors and were given this piece of paper by CBP officers at airport, even though neither kids nor us understand spanish

Also, husband will file for ROC next month. His kids just came this month (May 2014) and we are expecting their green cards in the mail by next week. Should he file ROC for his kids too at the same time as his own. We think kids green card will be valid for a year, going by dates written on their passport.

    Thanks guys.

You have all been very helpful throughout our journey

    Thanks

Unless you have been married for 2 years when the kids arrived they will have to file their own ROC when they meet the requirements as stated. They will most likley get 2 year green cards and then you will need to file for each of them on a seperate petition. Yeah stinks fees fees and more fees. but the good part is when it comes time just send a few things in along with dad's ROC approval wham bam 10 years cards for them. Kids GC will be 2 year cards as you are not married yet for 2 years upon their arrival if hubby is just filing his ROC.

    Good luck hope it helps

See my time line for the ROC I did for dad and 2 boys. Dad GC 10/2007 kids came 3/08 and had to wait until the alloted time to file for kids, could not file with poppa :)

  11. Thank you both VICTORIOUS876 and NARocks - I think we are moving in the right direction then with our immigration journey. I really appreciate your time to help me on the path! I will keep updating once I get my NOA2 (in what... 6 more months? sad.png )

Well we were through the process pretty quickly in 2007 so it could be less than 6 months. Start getting all docs together and ready to go once you get to NVC as that speeds the process up alot. And now since so much in on line it helps even more. Hopefully she will get here around the end of the school year and the summer to get ready for her new school etc. I place the boys in school the last 2 months just to help them adjust and start picking up more English.

My thoughts are with you on this Journey

My time line has a lot of info and also my story has many dates etc :) we were delayed due to holidays in December if not they would have been here in January of 08 instead of march.

  12. My Dear harmony - they Did not speak to either on of the Kids at the interview lol. Their dad was there and he was asked the questions. We were missing a copy of a tax return ( Do not know how I sent triplicate of them all lol ) and he had to go out and make copies.

We were able to go to the Colombian embassy and get the letter needed when the boys traveled back on their own. I am hoping the best for your journey and new Step Parent relationship . It is sometimes difficult when the child comes from a different background/culture than yours. This was the case for me, was not the best time the first few years. But I will never change the experience the immigration process and given to me.

    Much Luck

  13. Thank you!!

If I may also ask a few questions :)

    1. Who will go with the child to the interview at the Embassy?

    2. Does the mother of the child agree with the child coming to the US?

    3. How long have you been married to your Husband? I ask since if it is under 2 years you have to remove conditions on top of all this other stuff :P

also if the other parent does not agree then the child can not come.

For us once we got to the NVC stage we were asked for a notorized letter from the boys Mom ( Was an RFE ) stating the boys were allowed to immigrate to the US.

I know a lot has changed in recent years as I brought my Step Kids in 2008. But you will also need to look into the exit requirements of the country to make sure this is in order when it is time for her to come.

Get to know as stated via Skype, calls letters in anyway possible to make her transition here also better as she will already know you. I happened to take a trip to Colombia a few months before the boys interview and got to know them, not that it helped much in the end But hey I did my best.....

Also Colombia has requirements that until the child is 18 if they attempt to leave the country with one or no parent they need a special Form filled out.

I truly hope it works out for the best goofy.gif

  14. Hi guys I have a question. If our petition gets approved what would be the next step? Should we send the affidavit of support of my husband or wait for the instructions? How long it normally takes to get approved?

Hope to hear from you soon fellas.

Are you still waiting for the I-130 to be approved? Wait for the instructions, I know stinks to keep waiting but all will work out in the end hun smile.png

    ClockWatch2.gif

Hey Ladies smile.png hope everyone is well , Still pop in once and a awhile but MY things have changed need to read up to get back in the mix that's for sure.......

PS if you could maybe in you immigration info add the Info on this I-130? helps when people look to see where you are in the process. I still gt PM's and I did this 5 years ago for my Step kids and hubby. Plus an F2A for hubby other son...

FOund a lInk here on VJ , But looks a bit OLD LOL http://www.visajourney.com/examples/NVC_Process_Flowchart_v1-2.pdf

Off topic a tad I can remember when I did this we created manual Bar codes and all lol

Also here is a Helpful post that lists a lot of stuff my Dear First page has Lots of links http://www.visajourney.com/forums/topic/433472-nvc-filers-june-2013/

  15. goofy.gif Diana, Can you translate LOL jajajaj

If you bring the child and also want to adjust status be careful as you may need another letter stating that the other parent gives permission for this child to immigrate to the US.

  16. Thanks NA!! glad you guys have gotten past the immigration rollercoaster and are living life together.. how old were ur kids and how was the adjustment??

The kids were 11 and 16 when I applied. However in reading your stuff ( posts lol ) . There was no DNA asked for at all and I ( USC ) was the stepmother applying. Also once dad got his PR card he applied for his son born out of wedlock that is also in my timeline. No DNA for any of them. But the consulate where you are is a random one that is for sure. I hope this process goes by in flash for you dear. The adjustment was very difficult since the dad had been here for 8 years without them, it was harder on me that is for sure since they come from a country where they have a maid and thought I was one also. Needless to say the happy family is no more , based more on my part since i wanted to slap heck out of them thought better for me to leave. We lived together almost 3 years and also neded to come back to Miami from NJ to take care of my eldery Mom. If i had to do it over again thoguh I would ( which says alot ) . Lots of luck luv

  17. Been forever since I posted :) as life goes on. See my Time line I did 2 stand alone I-130 for both step kids WAY back in the dark ages. Just for you to see how it was then and how it is now. Our hiccup was a notorized letter from the Mom we had to send to the NVC stating the kids were allowed to come to the US :). Miss this place but since my journey is over since last year have not come on much. hope this helps you

  18. ty but i dont understand im talkin whit somebody who has the same case of me and he doesnt change of category while was out of age he its in usa right now he its colombian too he said that the important thing its have the approval before u are age out and thas my case are u sure about that the category willa change for my and how can i be sure of that ?

No as they are stating to you you have to look at the amount of time the Petition was with the USCIS. This is where you want to wait the longest. You did not you were only there for just about 14 months. Which means you have aged out. This is a very tricky situation as your I-130 was approved in 16 months. This is the time you can take off your age. Your priority date is not yet current so this means you will age out if you have not Already. My case is a little different as the son was 18 when we filed and it took them 26 months to approve our I-130 there fore he had 26 months taken off his age. I gained a lot of information from calling the NVC as they are the ones who will say yes you are eligible or NO you are not. There also used to be a link with a formula but it no longer works and I do not know how to post the file I have saved. He is a screen of the dates you gave cspa.jpg
