Thank you for your help! I thought that may be the case, please see the attached photos.

We got this exact message when we got DQ'd in April. Had no issues at the interview today, they didn't even ask about a joint sponsor or anything financially related other than what my wife does for work and if she still will be getting same income when moving back to the States.

You should be good 👍 Good luck to you and your spouse!

This has happened to many people. Basically, the officer at the interview will make the final decision. But if the petitioner does not make enough, you need to have a joint sponsor by the time you get to the interview. If the petitioner does make more than enough, then I guess you can just go and see what happens. I personally wouldn't risk it. I would secure a joint sponsor just in case.

    Thank you!

We don't have a joint sponsor, so hopefully they'll accept the income at the time of the interview.

Is your case within the normal processing times of Vermont? If yes, then you just gotta wait. If not, then put an outside normal processing request at USCIS. In our case that didn't work so we had to file WOM to get our case move forward. Best of luck to you. Hopefully things will pan out in your favor.

Thank you. Yes, it is within normal processing time. What is WOM?

she should return and set up a US address

does she have US bank account?

    state ID or DL?

What address does she use for her US tax returns?

that is what she should use

Yes, she has a US bank account,  DL, storage unit etc. She has a virtual mailbox that she uses for those things, I believe the taxes has our Norwegian address. We run a business together and her leaving right now to get a place in the states isn't very ideal for several reasons.

  5. We are still in the USCIS stage, but we know there's going to be a question in the next stage about where we're going to live.

My wife has been living with me and my child in my country since 2020, she came right before covid hit. We got married here and we couldn't afford to pay for 2 homes so we sold her home in the States since we would be living in my country till the visas are approved.

We will be going back to her old city to live, but we don't have anyone to ask to use their address. And signing a lease for a place we haven't seen, or even know when we can move into doesn't feel like an option. We don't know how long this visa process will take.

Our lawyer said we could use our friends in a different states' address for the I130 but for the next round we need a physical address of where we will stay. This might also be something they will ask about in the interview as well I assume.

Have anyone been in this situation, what did you do? Are there some solutions here?

  6. I went to the county governor in my country today to get an apostille stamp on my documents for name change. They stamped the original document, but said I had to take the translated version to the local court to get it notary stamped.
At the court they said they couldn't stamp it because I had used an American firm to translate it (Rush translate, which saved me over $100 for one document).
The guy asked if I really needed it to be notary stamped, or if Rush translate could get it notarized in the states before sending it to me again. Right now it just has a ATA stamp and signature on it.

Does anyone know what will be accepted by NVC/Embassy? I want to make sure we have the right documents and stamps so we don't waste any time.

Interesting. Please keep us posted. I keep reading about K3 being defunct, but every now and then somebody will have one approved. Best of luck to you and your family.

    Thank you!

What seems to be happening in some cases is that the K3/K4 will be denied, but they approve/start processing the I130 instead. So for us, we're using it as a nudge rather than an actual application. It's free when you already have a I130 in. We had some things come up with our current living situation and the visa process is taking longer than expected so hopefully this will help speed things up so we can get moving.

When was the last time you checked if you were in Vermont? Have you chatted with Ask Emma on the uscis site lately?

Our receipt said Nebraska, but when we sent a message back in August they replied with Vermont. We have tried to get a hold of them through Ask Emma, but when we did they said we had to call to get more information about our case. We have tried calling but it won't let us through even with 'live agent' 'info pass' 'technical issue/problem'. We have sent a new message through the inbox, but no reply yet.
