The NOA letter you received should say that your conditional residence has been extended for another 12 months. I think you can arrange an infopass appointment at your local USCIS office to have a stamp put in your passport which will allow you to travel on your extended green card. I'm sure som other will come along with more concrete info.

How long ago did you have your biometrics and where is your application being processed ?

I agree that the information you have found, as well as the other information provided by posters is correct.

My wife and I live in Illinois but got married at the Larimore House which is in Florissant, MO (North East of the city). We applied for our Marriage lisence in person at City Hall on Market St. downtown and I was only required to show my passport and birth certificate.

The area you're moving too is great, If my wife didn't have ties to Illinois we would love to live near Forest Park. It is great to have such a huge area where you can get out and be active for free. Being close to the metro is awesome too, especially if you can find a job near another metro station. I make a 84 mile round trip every day to work in Clayton and would probably save a fortune on gas if I could get to and from work without using a car.

From what I know, as a private plan does not cover for all pre-existing conditions like a company sponsored plan, there will probably be a period of time that you will need to hold the policy (with maternity coverage) before you'll be able to make ANY claims against it. We got my wife individual coverage through Blue Cross & Blue Shield and we had to wait 12 months before we could make any claims against the maternity coverage. Her policy was about $330 per month and din't cover any other pre-exisiting conditions.

Be VERY careful with individual plans as it is MUCH easier for the insurance companies to deny claims based on your prior medical history. They can take prior treatment as a diagnosis of a pre-exisiting condition, even if you've not been formally diagnosed, and can use this as grounds to either deny claims or revoke coverage completely.

Like others have said, if you can hold off on trying for a baby until one or both of you is covered under a "catch all" company plan, I believe that would the best way for you to insure that all claims are covered.

As a side note, although we are now covered under the Blue Cross plan if we wanted to try for a baby, they have just increased the premium to over $400 per month so my wife will be moving to a newly setup work policy when open enrollment begins in August.

I agree that the cost of medical care over here makes the NHS look like the best value for money ever. I also agree that when you add up what you pay to "have insurance" along with copays, prescription costs and the amounts we're left with when the insurance company has paid it's part, I often wonder what the point in insurance is at all !!

We have really been through the wringer with the insurance industry over here and it's left a pretty bad taste in both of our mouths. Add to that the contortions that some employers are doing nowadays to make it as hard as possible for workers to add family members to company policies, and I cuss under my breath whenever I have to pay a copay or some other charge in addition to my policy premiums.

The problem is that it's such a huge business now which employs so many people, that the companies have to keep driving up premiums to cover the administrative and employee costs associated with providing the insurance coverage in the first place. My wife currently (but not for much longer) opts out of her work policy and uses the $300 opt out stipend to pay for a private policy with Blue Cross and Blue Shield of Illinois. Her monthly premium went up over $100 in the last 12 months to the point where to keep the cost manageable we have had to change to policy that now has a higher deductible and no prescription coverage. Luckily she'll be enrolling in the school policy in August so we shouldn't have to pay too much in precsription charges between now and then.

Contact your member of congress and get them to look into it.

My EAD took almost 5 months by the time it was approved so I know how frustrating the waiting can be !!.

I contacted my congressman and was put in touch with his immigration liason. She was able to pull some strings (somehow) to get my file reviewed and within about 2 weeks my card was approved. Use this link to find out who your local member of congress is. Write them an email explaining excatly what you have done and when you did it. As long as you are outside the processing window by 30 days or more they should be able to at least get you a status update on your case or an explanation as to why things are taking so long.

If she holds a valid 2 year green card, until she has stayed out of the US for longer than 6 months she will have no problems re-entering the US. She may have some issues re-entering if she stays in India for longer than 6 months as I beleive she needs special permission to maintain her conditional residency when outside the country for longer than 6 months.

Until that 6 month point I don't beleive that there is anything that you or the USCIS can do to stop her from coming back and to be honest, if she left for India after 1 small argument, do you really want to throw away your marriage so quickly ?

I'd give it some time for her to calm down and then see if things are really as bad as you think.

If I read this right you are asking if you can go to Gambia to wait until your husband has his interview. If thats correct then I would assume that as long as you have the required visas and paperwork to visit the Gambia, you are free to visit there from the US for as long as you are permitted to stay as a tourist.

Great news Mark, congratulations! Are you going to go for citizenship this year?

I won't be eligible for citizenship until January of next year (LPR status granted Jan 2006) but to be honest my aim is to have that all completed by the next election. It's so bloody expensive that I'll have to get saving to afford the filing fee anyway !!

I received the email overnight that my I-751 was approved and my unconditional 10yr green card is being produced !!... YAY !! :dance:

Unless things have changed since I filed for my K-1, your Fiance will still fill out the I-134, not the I-864. In addition, his parents will also need to complete an I-134 and provide all supporting documents as per the instructions.

The I-864 is filed when adjusting status from that of a K-1 holder to a permanent resident. This stage doesn't happen until the K-1 has been issued and you are married.

As I understand it, if you are married to a US citizen and have been granted permanent resident staus, you should be eligible for citizenship 3 years after being granted PR status.

This is confirmed on page 18 of the document posted by YuAndDan which states that you are eligible for citzenship after 3 years as a premanent resident...

If you are at least 18 years old and are currently married to and living with a U.S. citizen; and have been married to and living with that same U.S. citizen for the past 3 years; and Your spouse has been a U.S. citizen for the past 3 years.

Obviously, if you don't meet one or more of the above requirements then you'd have to wait longer.

First off - how did they even discover that the cornflake looked like - Vermont was it? I mean - do people routinely go through boxes of cornflakes looking for ones shaped like cities and states?

The cornflake was shaped like Illinois and it wasn't found while deliberately searching through boxes and boxes. If you'd seen the size of it (it was about 2" from top to bottom) then you'd probably have pulled it out the bowl too, even if it didn't end up being shaped like a US state.

Secondly - how are they going to pack it for shipping...?

I believe that they mounted it in a display frame of some kind.

My wife is a member of a teachers forum and it was the daughter of one of the other members who found the frosted flake. It was the idea of their father to put it on eBay for a laugh. They had no idea that it would create the stir that it has. It wasn't sold for charity. It was sold to a TriviaMania.com who have a traveling museum of items representing pop culture. It was sold by 3 sisters from Vermont and they will be using the money for a family vacation.

In answer to the OP's question, No... I don't believe that a frosted flake is worth $1350.00 but I guess someone did !!

I just found something he posted today in the K-3 / CR-1 forum so I'm guessing he had to file the I-130...

Actually this is only partly accurate. You see my wife was approved for a K-1 in Jan. 2007, got married. But, then she had to return home because of an emergency and we could not wait for AP. So, we had to start over again with the I-130. The received date for VSC is 09-21-2007, NOA1 is 01-04-2008, Online with USCIS 02-24-2008. No touches....nada since that time. So, we are in the same situation as every one else. The entire system is flawed on every level. I mean we get married here, but she has to leave for a bona-fide emergency and she cant come back without filing I-130?!!!

I guess he hadn't heard of or didn't have time for an infopass for Emergemcy AP ??

I was going to to say exactly what Rebecca just said (and she should know !!)...

If everything goes smoothly then yes, your EAD might arrive only a short time before you are approved for a 2 year green card. However, if you are one of the unlucky ones who gets sent for an FBI name check or some other kind of delay crops up, you could be in for a MUCH longer wait for the green card to be approved. Also bear in mind that many EAD's don't get processed within the predicted 90 days either. If you get lumbered with a name check AND a slow EAD processing timeline you could be unemployed for longer than you'd care to imagine.

If you're in no hurry to get working then wait it out til the green card arrives. If however you need to start bringing in some $$ then I'd get the EAD application filed as soon as you're allowed.

Look at it this way... Yes, having a K-1 in the system shows increased immigrant intent. However, it also shows knowledge of the right way to do things and an understanding of the US immigration system. Make sure he travels with plenty of proof that he will be returning to the UK and he should be fine. Answer all questions 100% honestly and be prepared to show extra evidence of ties and plans to return to the UK at the end of the stay.

I made 2 trips to the US while my K-1 was processing and even though I had an envelope full of evidence I was never asked to show any of it. On both of those occasions I stated that I was visiting my Fiancee. In terms of evidence I had a copy of my K-1 NOA1, A letter from my employer stating they were expecting me back to work on such and such a date, bank statements showing I still had a decent sized balance in there etc..

There is nothing in any of the USCIS information which states that having a Fiancee visa in the system is grounds for denial of entry. As long as he is eligible to travel under the VWP and has no plans to stay in the US permanently this time around, he should be good to go.

Don't sweat it too much. You'll be fine !!
