We would like my fiance extend his stay by one week but do you think it's a problem because CBP asked to read his ticket return and put the day of return on his computer? My fiance came on esta and has normally 90 of authorized days on the territory.

    Thank you

I have done this multiple time over the last years. Supposed to stay for an amount of time, but then something happened and I had the chance to push my return - and I did. Never had an issue with it, not even once. However it hasn’t been more than 3 weeks extra at tops and always within the authorized 90 days on my ESTA 😊

I am getting confused with items 38a-38 h in the form. Item 37 says "Has your beneficiary ever been to the United States?" I answered "yes", next there is the statement - If your beneficiary, is currently in the United States, complete Item numbers 38a-38h

I am not currently in the United States but I previously travelled to the United States as a tourist, so should I leave 38a-38h blank, or should I include my I-94 form and passport number? Should I provide the scan of my previous visa to the United States as evidence?

You are not currently in the US, therefore you leave them blank

Hello! My husband is French and I am American. He wants to visit our new nephew who will be born in a couple weeks for about a month. He doesn't really have strong proof of ties to his country and we filed the I-130 a couple months ago. He doesn't have a lease or anything because he takes care of his mom at her house. She is old and needs the help especially since she recently recovered from cancer. His brother will help her during his travels. But he also only uses the train so he doesn't have a car. Trains in France are way more convenient where he lives and much more economical. He has is his bank account, a frail mother to get too, and the money he gives his family to help support them. He has friends he visits very regularly. But these aren't really strong ties? He will have a return ticket to, but it is required anyways. He would leave through Paris and arrive in Atlanta.

Is there any chance he would be accepted to visit to meet his newborn nephew? If he is denied will our I-130 get canceled? Someone told me there is a 0% chance he will be accepted and they could cancel our I-130, he get deported and banned from entry for three years and it has me so scared to even try. What are the odds he could get in?

    Hi there,

I have visited 4 times while we’ve been in the process, and never been denied entry. Today I got really basic questions, like how long we’ve been married, how far along in the process we are, how good I am at skiing (I am from Norway, and apparently the CBP officer knows that we ski a lot haha) and if I’m returning because of work. It is always a little scary and I feel interrogated, but I think that’s just how it is. It usually works out fine 😊

I have never shown any evidence of ties, just confirmed when I am returning to Norway!

    Good luck 🍀

Thank you for your reply! I’m so sorry. That’s so unfortunate…I’m starting to think that the delay is gong to be significant in my case too. Did you submit the document originally? We sent everything in the first place, but apparently they didn’t notice them or they got confused because my husband changed workplace.

No, we didn't submit it the first time around! Hopefully your case is different timewise!

Hello everyone! I’m waiting for CR1 visa. I’m at the NVC phase. Yesterday I received an email from NVC stating that our case was updated. Everything is accepted, but there is a FE note “  Please submit every 2021 W-2/1099 form for ( petitioner’s name )”. Months ago my husband submitted everything included this document, and the section about the financial documents say accepted.  Did somebody have this problem? In your opinion how long it’s going to take for reviewing this document ?

We got that in March (asking for 2020 W2), submitted April 5th and are still waiting 🥲

Reading the instructions for the I864EZ, I don't see anywhere that says you need to provide additional proof your, the petitioner's, citizenship.  Since you should have answered "Yes" to 1a, and you already provided proof of citizenship on the I130, you should be fine.

    Good Luck!

Thank you! Fingers crossed for approval then 😊

  7. Hi guys, we’re approaching review day (hopefully next week, since we resubmitted April 5th), but question! I people on Facebook that have submitted proof of petitioners citizenship. I haven’t seen that being required anywhere. We haven’t done that, we got a RFE in March requesting only the W2 for 2020.

like these are the only documents submitted by petitioner. Do you think we are going to get a second RFE for that?

    Hello,

we have submitted the CR1 to the USCIS this Sunday on May 29th 2022. We only now noticed that we did not photograph the back of my birth certificate. Because of that I wanted to ask  if this could be a reason for the CR1 to be denied for us or to be sent back? Is there any way to submit it now so we don't have to wait 2 months to be potentially denied? Thank you!

Did you send in another kind of proof for citizenship? Like picture of passport page?

Yes I'm incredibly fortunate but I'm wondering did the USCIS officer feel bad and approve me quick knowing Bombay has such a long wait?  My brother got married and petitioned his wife around the same time as us but his wife is in the UK.  There they have barely any wait for interview and my bro hasn't been approved by USCIS yet.  Also, I had applied for a K-1 but withdrew so maybe some of our background checks had already been done.  Tbh, who knows why some get lucky and others don't.  I think interview before the end of the year would be fantastic but it's really hard to tell.  I think it could easily be next year as well but let's hope.

That is a really quick timeline indeed!! How long of a wait is it in Bombay?

... 27 May was Friday... this was posted 19 hours ago.

ETA: I am the worst with dates, too! My before post involved me thinking the 27th was Saturday and for some reason I think it is Sunday already!

Oh, the timezones and dates are hard. Thursday was a holiday in my country and everything was closed as it is on every Sunday too, so this week has thrown me completely off! 😂

Thank you. This is what I've done. Do you know if this will put me at the back of the queue?

Adding documents to the "additional document" tab seems like it doesn't reset the clock if you do it before they get a chance to look at your file - so short answer: no 😊 (for the cases I've seen at least, just saw someone on Facebook who added a document there on may 24th and just got DQ'ed)
