    I have this notification as well (your case is taking longer). I think it is just a standardized status based on when you submitted your petition versus the official processing time that they publish. 

    Yes I might try again. Do you know where I can get the form or email address please?

    i made the request over the phone and told them I had a letter from my doc. They said they would review and come back in 7 days. I expected them to at least ask for the letter but they just came back and said no.

     

    I am an LPR filing for my husband in UK. In the new processing section I saw this notice below. A whole bunch of us on in Vermont who are LPR got this. I don't even understand! Just made me more depressed.

     

    Estimated time until case decision:

    Your case is taking longer than expected to process. You do not need to take any action at this time.

    I contacted a congresswoman in January and she called Potomac. All that resulted was an officer checked my file, told her that it was being processed normally and no further documentation was necessary from me. Soon after it went into AR but that was just because of the officer checking.

     

    Expedites... I'm not sure. I hear they rarely work and I don't know if physical, stress-related health issues is good enough of a reason to try. Does anyone else know? In that case, I feel like a lot of us are experiencing the same thing and they'd probably be inundated with requests. 😅

    You are right. I have tried expediting twice, latest was stress which i am now being medicated for and they didnt even request evidence, Just said no!

    I just want to say thank god because they had denied my first case(applied in 2019 denied 2021) for my husband and I fought back and made another case and in less than 6 months my case is sent to the NVC center. 

    I pray for everyone who files to have hope and never lose it.

    Couple of things to consider but check these with the immigration lawyer first.  My USC wife filed the I-130 for me as the beneficiary online in Apr 21 and it is stuck at the California Service Centre.  We are moving to the US for a number of reasons, one of which is that her US employer has asked her to move back from the UK to the US.  We tried to expedite through USCIS last summer but our request to expedite was rejected without any formal response from USCIS.  We subsequently contacted her local (just outside Atlanta, GA) Representative and my wife completed a standard form (they get a lot of these) that was pushed through the Congressional USCIS Liaison Officer.  All we got back was a readout of why USCIS rejected the request to expedite.  The Congressional - Senator or Representative - route is worth trying, particularly if your lawyer suggests it.  However, to get something through USCIS quickly you will, as others have said, have to have a valid reason (in accordance with the USCIS manual) and evidence of it.

     

    It may be worth looking at whether you have grounds to file direct with the London Consulate and submit a parallel I-130 through them. However, we took some advice from a senior Atlanta-based immigration attorney this week who basically told us to sit on our hands for a bit - the system is jammed up and will take time to un-jam. Her advice (contrary to some of what I have read on VJ) is that K3s are a non-starter.  Frustrating, but there it is!

    I know the process to expedite. I haven’t requested it yet as my lawyer said to present the case to local rep or senator and see if they will support it to give more weight to the request as it is an elective health issue. 
     

    I was trying to find out whether anyone had been successful in going down this route that is all. 
     

    Will wait and see happens. It’s worth a shot. Best case they say yes, worst case they say no and we look at our options. Only way you find out is to try!

  7. The process is elective but it is not by choice that I need a C-section, it is due to health factors. Neither is it elective to do ivf, again for health reasons. If I fell pregnant now naturally without ivf the baby will still need to be delivered and the only method is C-section. Elective is just the term they use and it really causes problems. I’d rather not need ivf and I’d rather deliver naturally. 
     

    I have made contact with my senators office and they have been very responsive, immediately and said they will get back to me soon. I can’t ask for more than that. 
     

    Miracles do happen, I am ‘cautiously optimistic’ 🙏

    Oh sorry I didn't know that is what you meant. To uproot our two year old (who is also an LPR) back to UK after settling her into school here and after 6 months only is not something I can consider. With no job for me also in the UK. 

    That thought hadn't crossed my mind but it might cross the mind of USCIS.

    I'm not sure how helpful this will be, but when we were waiting for approval after getting married, it took longer than the processing time so I contacted both of my state's senators and received canned responses from their offices.  I walked into my congress-woman's local office and spoke to her staff, and they were on the case within hours - we were approved 2 days later.

    No I am an LPR. We were given wrong advise by a lawyer who told us we could adjust status on an ESTA so I moved as I have a job here. Several lawyers then told us that we could only adjust my husbands status on VWP if I was a USC. LPR cannot do so for their spouse!

    It is free to try, though.

    Thanks for the response. It is the Petitioner (me) that requires the elective IVF.

    I do not know your history but it seems like you have recently applied, may need to address why that was the case.

    We applied in September 2021. We were living in the UK where we met and I moved back to the US in July 2021, think we could do an adjustment of status for my husband on his ESTA but we were notified by a lawyer that that would only be possible if I were a citizen. We were very naïve!

    Thanks for your response. I am not sure if there are any hard and fast rules for the basis. We are at Vermont Service Centre which has a current processing time of 24-31 months. It is such a long time and will be too late for us to try for a baby. It is causing me so much anxiety, I am willing to try everything possible 🙏

    Pick an office you'd like to request assistance from, go to their website, and there usually will be a separate section for assistance with a federal office -> USCIS, and you'll find the way to reach out there. Sometimes you just fill out the form online, sometimes you have to mail it in with your signature. Depends on the office.

    Thank you. I am in the Atlanta area. Can I approach all 3 reps or it is only the one that covers my exact address.

    I found an e-mail address online for my senator, e-mailed the situation, the sent me a release form and they got to work.

     

    However, if the surgery is elective then does that qualify for an expedite?

    have history of medical issues, surgeries and procedures which has meant that my husband and I require IVF to conceive. We were fortunate enough to have had a daughter who is now 2 years old, after 2 years and 3 rounds of IVF. We would like to grow our family and we were advised due to difficulties I have during pregnancy and with giving birth, to wait 18-24 months before we conceive again (our daughter is now 2years 5 months).

     

    We are both in our mid 40s, given our age and the fact that we do not know how long the IVF process would take, we recognize that time isn’t on our side and would like to start the process ASAP. Even if we could do the IVF process remotely, it is not a possibility to go through the pregnancy and birth on my own given my health – I had a difficult pregnancy with our daughter and I had to have a classical c-section to deliver, which takes weeks of recovery.

     

    This would be deemed as elective, hence why my lawyer suggested getting congress or senate assistance. I am really hoping someone can help!
