I have a friend going through the same thing she filed her ROC 1 month after my husbands in June 2018. But she divorced about 1 year after Then last year she applied for citizenship. Had interview finally for I-751 in April 2023. Then N-400 interview in August 2023. Adjudicator said she will her something by end of August. Nothing. End of September nothing. Weird the adjudicator gave her her phone # and email (if they legit who the heck knows) but no movement on I-751 or update since 2019 and nothing on the N-400.
She is Nigerian also and so was her ex. But Ex did get messy in beginning cuz he was hurt and called immigration saying all kinds of wahala.
I do agree with @Rocio0010 previous marriages to your country people especially Nigeria is a BIG Read flag. So I am sure they are examining the divorce decrees and such. You know how documents go there it can be troublesome at best.

I will just keep waiting on them till end of Nov then see what happens

What about your spouses divorce decree?

My bet is that they think you’re not genuinely divorced from the first wife. They think your marriage is fake, and that you’ll apply for wife 1 once you’re a citizen

Ex wife that i dont even know her where about anymore. My spouse divorced here in the state and i sent both divorce decree to uscis.

Cannot approve citizenship until ROC is approved. You need to focus on why ROC is not approved.

Honestly I can’t tell this is the problem because my case is straight forward

    Have you been married before?

Has your spouse been married before?

    Yes both married before

  4. Hey guys, I applied for Roc August 2021 which is still pending till date. I applied for N400 September 2022 under 3years rules and had my interview April 2023 and i passed. Officer said am recommending you for approval. Since then nothing changes and i reached out to USCIS after 120 days and all they said was if i didn't hear anything after 90 days which is NOV 30th i should submit another request. My question is what do i do after NOV 30TH? Should i submit another request or what do i do next?

Ummm Did you and your spouse get a divorce or do you mean you had a divorce prior to all this immigration stuff? Because at first I read it as you and your current spouse got a divorce and not this I-751 is being applied for single and not with the Spouse that brought the immigrant over.

I would think if it was a previous marriage then the divorce decree stuff should have been handled from the very beginning?

As for the Taxes... Umm, for the sake of argument I probably would and the reason for that is because I like to play it safe lol. If in doubt, submit it anyways. As for Transcript vs Amended 1040, I read somewhere while researching that for this if you submit your 1040(x) info then you will need to submit everything with the 1040(x) so it is always better to submit just the Transcript. Unless you want to give them copies of the W2's, 1099's, any Schedule's, etc, etc, etc...

With all that said, I am not too sure but that is how I would handle it. I didn't even submit my 2019's was submitted during my wifes AOS and she had just arrived in 2019. Hmm, I wonder if they will ding me on that one now. roflmao.

Thanks Willie. Me and My present wife whom I want to file ROC with were divorced in the past and our divorced were final years back. I just want to know if I should submit our divorce decree document along with the ROC petition.
