  1. So we submitted our AOS application in Jan 2021. Our interview is in 3 weeks and I’m wondering how to handle the financial stuff. 
    when we sent our application, my husband was employed. I submitted his last 3 years of taxes, pay stubs, letter of employment. Everything got accepted.

     

    now my husband just quit his job so he can stay with me and our newborn baby at home. (Paternity leave wasn’t an option since he works in oilfield and they don’t really give days off like that). So he decided to just quit and now he is in the recruiting process for a new job. So basically we don’t have “current income” but his tax return for 2021 shows that he made above the poverty guideline, it was around 70k. Really don’t know if we should get a joint sponsor or his tax return from 2021 would be enough to show that we are good. How does it work? 

  2. So I was supposed to have my AOS interview the 25th of Feb but instead I gave birth to my son that day literally 4 hours before my interview 😂 my interview got rescheduled and I’ll have it on March 31st.

    So the question is, do I need to do a new medical exam since the previous one I did was while I was pregnant and I couldn’t take 2 or three vaccines that they require?Civil surgeon signed the medical 23rd of Feb. Idk how to handle that honestly

    so I was supposed to have my green card interview last Friday (Feb 25th) but I delivered my baby at 8am that morning LOL what a funny kid right? 
     

    my husband went to the field office an hour before the interview and they told him to sent a certified letter to them and include copy of my interview notice and a letter why we couldn’t come and the proof from the hospital. I also called them before the interview to reschedule it. 
     

    Yesterday my status on the app changed from interview scheduled to “case is ready to be scheduled for an interview” and I was wondering if anyone else had ever any emergency situation and how long it took to get the new interview date.

    Yes, your AOS application will be denied if you do not attend the interview.  To avoid a denial, contact USCIS and request for a re-schedule.  Make sure to ask for an email with details of the request ticket you filed.  In case USCIS denies your case by mistake, at least you will have an email trail that you followed proper procedure for re-scheduling.  A similar thing happened to another VJ member who recently had his AOS denied despite having a prior request for re-schedule --

     

     

    What’s if it’s an emergency? What if I literally go into a labor the day before or the day of my interview? Would be a proof of being in a hospital enough? How does rescheduling work? 
    gotta start praying that baby boy will stay in there till March 7th 

  5. Ok so I didn’t except that. Houston office is pretty busy and people really are waiting long for their interviews. I just woke up to an email that our interview is scheduled, as of Jan 27th. So basically I’ll have an interview in a month. I’m due March 7th and I’m so scared I will into labor earlier and I’ll be in the hospital and they’ll deny my case if I don’t make it to the interview. I’m so worried right now. Any advices? Someone had situation like that?

    Well actually yes, due to my I-94 expiration I wanna send it out ASAP, I don’t know how long we’d need to wait, my husband still didn’t get his w2s 

  7. Im sending my aos paperwork soon and I was wondering, in the forms where they ask about my husbands taxes, should I leave the last tax year of 2019 he paid or 2020? My husband won’t do his taxes until February/ March cause he still needs to get his W2s. I wonder if I’m the form i864 I can leave 2019 as a last tax or I need to put 2020 and wrote a statement my husband didn’t do his 2020 yet? 

  8. So I’m ready to sent my aos but the only one thing lacking is insurance. My husband’s job is very specific and it might take a time for me to be added to his plan. I really need to send my AoS asap due to I-94 expiring. Do you think it’s ok to buy an insurance at Visitors Coverage or 7corners for a few months? Meanwhile my husband and I will figure something out to add me to his plan. Please help, I’m literally freaking out

We got married two weeks ago, the next day after we got married we returned our marriage license to the county clerk and today we got our marriage license back, well, not sure how that works, we got marriage license with the clerk stamp on it. It doesn’t say it’s “marriage certificate” it’s still marriage license and also on the very top it says “Texas state doesn’t issue marriage certificates”. in the letter we also got congratulation on our marriage letter from the county clerk. So I guess that’s what me and my husband need for the AOS forms? Is this like a Texas thing lol?   


    also, I don’t need to include the original one right? I can just do a copy?

    Current Annual income is an estimate of what he would make in a period of 1 year based on his current payment (either salary or hourly). This period of 1 year is not Jan 2020 to December 2020, it's a generic period of 365 days.

    Thank you so much for your help! Now it’s clear. I guess I’m already exhausted after filling all the forms and my brain is not working right so all these things seemed unapproachable 😄

    You said he has short term contracts. Is he salary or hourly? W2 or 1099?

    He gets paid hourly and it’s w2

    Current Annual Income = His Current Salary. Get an employment verification letter stating his position and annual salary. Add recent paystubs. They will use this number to compare to the poverty line.

     

    Don't worry about unemployment. He has a job now. That's what matters. Even if he starts the job today and sign the affidavit tomorrow, his current Annual Income is what his new contract says, not what he has made throughout the year.

     

    Example: He had a Job from Jan to July, making 10k/month. (Total: 70k). He became unemployed, and stayed like that until end of October. New job in November with a salary of 30k. His Current Annual Income is 30k. 

    Well, not sure if I understand it right, 

    my husband works as a constructor at rafineries, he doesn’t have one regular stable job. He always gets a contract for a few months, get the work done and he goes to another place to work. Sometimes his contracts lasts a few weeks only and he hops to another job. That’s his profession. Due to covid and him getting sick he was on unemployment for 3 months. He got his new contract at the beginning of November so I don’t think he made more than 21,125 since November 3rd

    So basically what do We need to get? It says that they will compare in to the poverty guidelines and this unemployment really worries me

    Until they fix the return, the total income on it is 44k. The 864 doesn't ask how much money he made last year, it asks what the Total Income line on the return shows.

     

    USCIS is not going to ask IRS if the number is correct (which would be correct, since it was his mistake). They are only going to compare what you wrote on the form and what's on the transcript you gave them.

    i-864 asks about annual income, so We need to put the number from the tax return? Or his current income from 2020? How does that work?
