  1. Thanks Melc! I actually went through my DS-260 to double check and there's no reference to the UK anywhere there (other than countries visited).

We re-submitted the Gibraltar certs yesterday with two pieces of additional information: 1. Email correspondence with Gibraltar Police explaining that they no longer issue "Certificate of Good Conduct", instead they call it now Subject Access Request Certificate; 2. A letter explaining we never resided in the UK (pointing them to that documents website).

Hopefully this will clarify it 🤞

Usually this website is a good go-to to see what documents are accepted by geography:

    https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/Gibraltar.html

    It mentions the following:

Though some of the data on Gibraltar is out of date; it hasn't been updated to reflect same-sex marriages being available.

Thanks for your response Melc - this is exactly what we submitted and it has been rejected with a request to provide a UK police cert 🤔  Hopefully just a missunderstanding.

  3. Hi guys,

Just got a message from NVC (CR-1 process) that they've rejected my police certificate from Gibraltar (Subject Access Request Certificate) and asked for a certificate from the UK instead (even though I've never lived there). We called them and kind of clarified this - they said we should submit an explanation letter, but wanted to check if anyone here had to provide a police cert from Gibraltar and if so, how did they go about it.

    Thank you :)

  4. Re. Travelling while i130 pending

My understanding is that you can travel to the US while pending i130 (actually, I did back in November '19) - I was flying from Dublin so precleared there - no questions asked. But now they might be more strict. Have a look at this article: https://www.boundless.com/immigration-resources/when-can-i-visit-my-spouse-in-the-united-states/.

Any documents proving your ties to the UK like a letter from employer, proof you study there (or about to start), etc - something to show you are planning to come back. I was never asked about it but had it ready.

Re. Travelling to the US during Covid-19.

Can't answer on this one but again, I think you should be fine. My wife just travelled from the US to Poland - she had to show our marriage cert, my ID (passport) and proof of address in Poland (to the airline staff, not at the border). Somewhere on this forum I read that you might also need a pre-approval from the US embassy, but this could've been only for banned countries.

Hope this gives you some point of reference. Best of luck!
