  1. Hello everyone.

    I had my AOS interview in Garden City, NY on July 10th. Fortunately everything went well and I was approved. It has been a week and I haven't seen any updates in my cases online (still shows 6/9/08 as LUD date). I haven't received anything in the mail either. The officer mentioned that I would receive a welcome letter within a week and my GC afterwards.

    My question is:

    Has anyone had a similar experience either in Garden City or any other office?

    Is this something I should worry about? I plan on traveling around the middle of August. I really don't want to have any trouble at the POE.

    By the way, forgot to mention that I got the I-551 stamp in my passport.

  2. My fiance is in Morocco at the moment. I have filed my I 129F form and it was approved. He had his interview on the 15th of July and they said the case needed to be processed administratively in Washington.

    Does anyone know what that means? Or how long (on average) it takes for them to process it?

    It could be that it was sent for the FBI background check.

    Was your K1 approved at the interview, and was just pending the results from Washington?

  3. Hi guys.

    So, ok. My wife and I married and sent in my Change of Status and Work Permit papers back in early May, unfortunately due to a mistake in a document we had to resend everything.

    Anyway, my K-1 and I-94 expired (I-94 in May and my K-1 Visa today). I was wondering, now that those two are expired, what kind of valid ID do I have here? I mean, I haven't gotten my driver's license for one reason or another, mainly because I could only get a doctors appointment until the 21st of July.

    I'm worried that 1. The DMV people wont accept my petition for a Driver's License because both my documents are expired, or 2. That just randomly a cop could stop my wife and I and ask me for an ID.

    I know my status is supposed to be protected while my status change is being processed but how to explain that to the people here? I'm living in a very rural where, unfortunately, some people might be a little prejudiced. Just the other day when I went to pick up the booklet to study for the driving test there were a couple of people there from the Middle East and, man, they were treated like #######.

    Anyway, any kind of help is appreciated.

    Your visa expiration is of no consequence. It was dead on arrival in the USA, regardless of expiration date because it's a single entry visa. You had 90 days of K1 status and now have pending adjustment of status.

    Now, I was wondering. My Mexican passport actually expires in August. Should I try and get a new one from a Mexican embassy here in the US?

  4. fwaguy, a really close friend of mine was an au pair and had her last month(grace period) just now starting in mid June and was traveling all over the US, in 2 different occasions, an immigration office(I'm not sure if this would be the right name, I apologize about that) requested to see her passport(and visa) and she was questioned about her visa being expired, she needed to explain about the grace period, d/s and all that, I don't mean to say you or anyone is wrong I'm just worried about traveling and getting in trouble when I can just stay home and avoid it, I'd really like to go, but I'm not if I'm not sure I'll be OK.That's the only reason I'm asking for official info.

    Exactly..your visa is meaningless. The K1 visa is a one time entry visa with the purpose to marry within 90 days which it seems you did. You then sent the proper documents in to adjust status and received the NOA 1 which is proof your paperwork is pending.

    Travel within the US is allowed, and you will not have any issues. The Airlines do not check your visa status if you are flying within the states and I never saw immigration officers in the airport checking passports. The only place that is done is immigration when you arrive from outside the USA.

    If you are concerned, carry a copy of your marriage certificate and NOA1, but I dont think thats needed.

  5. Well in my case I told my fiance to check this website but he prefered to hire an attorney because he didnt have time to do all the paperwork. Even though i told him he could search here, he decided to go for the attorney so i respected his decision. Now that we are waiting for the next step, I always tell my fiance about all the experiences I read here and he tells me i know more than the attorney he hired :yes::lol:

    We hired a lawyer to do our K1 petition and If I knew then what I know now I certainly would not have hired one. This site is excellent for information, and the people here are certainly happy to assist you with your concerns, for free !!!!

    Take the money you would spend on a lawyer, and take your soon to be new spouse on a great honeymoon...

    1. should I separate payment for biometrics and AOS processing fee? or just one check of $1,010?

    2. and make it payable to U.S Department of Homeland Security right? is the U.S. should be shortened or it should be "United States", or does it matter? :unsure:

    3. Can I file for AP even if im not sure if I'll use it or not? Im planning to go to Phils. on Christmas or probably February, im not sure of the date yet, and there could be change of plans. And since we're paying a thousand dollars, might as well file.. Would if affect my pending AOS if there's an unused approved AP? Please let me know. My husband and I are filing soon, finally!

    1. The check should be written for 1010.00 dollars which includes the AP, and EAD also. These are now included in that price there is no fee for Biometrics, you will receive a letter aprox. 4 weeks after your application is received to appear for fingerprints, and picture.

    2. U.S Department of Homeland Security is acceptable

    3. Advanced Parole and EAD is included now in this 1010.00 dollar fee and AP allows you to leave the US and reenter while your process is pending. So apply for both along with your AOS

  7. Today I received 3 letters from the Dallas CIS, one for each of my green card applications. (Wife and 2 stepsons).

    Our GC interview was scheduled for the 24th of July.

    It states "Cancellation Notice"

    Due to unavoidable circumstances, your appointment scheduled for 07/24/2008 has been cancelled until further notice.

    Please do not appear for this interview as no action can be taken on your application at this time.

    Then it's signed by the field office director.

    I am speechless................

    Attached to each letter is a copy of our NOA to appear for the interview. And written in red ink in the top left corner is

    "Do Not Show for Appointment"

    This is quite common...We received the same notice for our interview which was scheduled for June. We had all prepared and were ready to go to the interview anyways, but recieved the new appointment letter the day before. The recheduled interview was a month later.

    I would prepare to go but also wait for the new letter

  8. TODAY I RECEIVED EMAIL UPDATE FROM USCIS, MY HUSBAND APPLIED FOR EMPLOYMENT AUTHORIZATION LAST MONTH, EMAIL SAYS HIS " PRODUCTION CARD" WILL ARIVE IN MAIL IN ABOUT 30 DAYS, IS THAT HIS EMPLOYMENT CARD OR ??? DOES THAT MEAN HE WILL BE ABLE TO WORK IN 30 DAYS ? PLEASE TELL ME IT IS :)

    That message means his EAD was approved and you should receive the card within 30 days. Usually it takes 10 days to receive it..

    After he receives the card, he can look for a job...

    We finally received notice that we were APPROVED. :dance:

    We had our interview yesterday afternoon and let me tell ya...it was a bit stressful for the both of us.

    Alot of questions about pre K1 stuff, and very little about Post Marriage. the officer did not make a decision at the time of the interview and told us to wait 10 days for the answer..

    Thank God we received the email this morning that it was approved.

    Current Status: Card production ordered.

    On July 8, 2008, we ordered production of your new card

    I will post a review in our timeline soon...

    the best of luck to those who are still waiting....you have no idea the feeling we share right now....we have tears of happiness in our eyes right now....

  10. Others have tried to re-schedule appointments without success -even when it is USCIS doing the re-scheduling! A number of couples have been denied because they failed to show up at the original interview date which they had been told was canceled except the cancellation and re-schedule information didn't seem to make it to where it needed to be. They spent a lot of time, worry and more paperwork trying to get their files re-opened. Another recent couple called for a re-schedule but were able to make their original date after all and when they went, the interviewer had no record of the re-schedule. They would have been marked as no shows if they had gone with the re-schedule rather than the original date. If you are at all able to make the interview date, be there, even though it means cutting your holiday short and paying to move the tickets. Good luck.

    It also states on the bottom of the Interview letter that in order to reschedule, you, or an immediate family member must be ill making it impossible for you to attend the interview.

    I do not think a vacation justifies reschedule in their eyes...

  11. The I-693 form changed on May 1, 2008. Before that date, there was a vaccination supplement page known as I-693A, which was the equivalent of the DS-3025. Some people used to send in the DS-3025, but others preferred to be safe and have the information transferred onto the I-693A. Since May 1, the I-693A doesn't exist any more and the vaccination supplement is now included as part of the new I-693.

    If you had the medical as part of the K1 process (ie less than a year ago) then you only need to send in the vaccination supplement with the AOS application. Officially you have to send the I-693, but some people do choose just to send the DS-3025 and not bother having the information transcribed onto the new form.

    I needed to have one more shot so my DS-3025 was incomplete. I found the nearest Civil Surgeon who gave me the shot AND transcribed my DS-3025 onto the new I-693 form. He sealed it in an envelope and I submitted that as part of the AOS application.

    I'd advise being cautious and getting the information transcribed onto the new form. If you haven't seen already on this forum, Dr Arnold in Austin TX allows you to do this by mail. You can find the details by going to the first sticky post in the AOS forum (FAQs: Forms I-693a and DS-3025).

    We submitted the DS-3025 with our AOS packet and did not receive an RFE.

    SInce we provided the medical packet at the POE in Houston, we will only bring the DS-3025 along with us to the interview.

  12. I have filed the K-1 and am waiting for an interview at the embassy in Rio. Does the sponsor need to live in the same house as us?

    I've read where some consulates ask if the sponsor lives in the same household. Is this relevant?

  13. It doesnt have to be the DS-3025 does it? Will it be ok for me just to bring the vaccination card to the local civil surgeon here? Will it suffice as a base for them to issue the I-693a?

    No it doesn't have to be the DS-3025. :no: Practically NONE of us have that! Yep just bring the vacinnation card to the local civil surgeon, that's all they need. That's what we did, and they issued the necessary vaccination supplement I-693A with no problem. :yes:

    What if we have the DS-3025? does this still need to be transferred to a I-693A?

  14. Can anyone tell me first hand how they obtained cort records for offenses over 20 years old. My local police chief says he can ONLY run local requests and only back 11 years. Then he says I go to court. They say I have to go to Court where offenses took place. This is in TWO different states and over 8 hours driving. I THINK I only have TWO offenses, but maybe three, as they were separate offenses, but maybe one was dropped. I wrote an explantion letter, but was told I need to provide docs with offences and final dispostion, to submit with I-129F

    What i don't understand is, no matter HOW I reply to this answer, they are still going to run the check regardless for records, can't they see this when doing that?

    I would call the court clerk of both courthouses, and see if they can help. You might need the exact dates, or docket number of the papers. You might be able to get them sent to you if they have these after providing some ID to them.

  15. Krikit is right. Freedom for both partners to marry/remarry is established for the K-1. You don't need it for the AOS which is to prove the validity of the current marriage. If you are adjusting status based upon marriage to a US citizen from another status other than K-1 and K-3, then yes, you would need to establish that you are legally free to be married and thus obtain that immigration benefit.

    We have our interview scheduled, and received the apt letter. It clearly states you must bring a certified copy of your divorce decree.

  16. hi im i have a question my best friend got married 2years ago but decided to not file right away because she was working on her marriage but as of a year ago her husband made himself scarce can she still get her green card if though he not there

    So the USC husband abandoned the marriage?

    The AOS process to receive a green card is based on a marriage. She would need to show proof of a marriage like bank records, insurance, and will need to file documents. etc...

    this will be hard to do and one requirement for the interview is that both husband and wife attend.

  17. I am confused from reading what needs to be done first or if order matters. We a planning on meeting in Las Vegas to get married. That will be her point of entry under a K1 approved visa. Planning on getting married 3 days later, but do we have to do the SS# first or can it wait till after the marriage, since there will be the name change and all anyway.

Today I got mail from USCIS that they cancelled my interview on June 02, 2008 but i haven't receive any mail from them stating that they already scheduled an interview and even my status online was not touch since after my biometrics, Im so confuse right now. Anyone experience the same thing? what do i need to do? Do i still need to show up on the day of the interview even if I dnt have the letter for the interview only the cancellation letter? Please i need ur advice... Thank you in advance

    Last week I took my wife and step daughter to our local Social Security office to apply for their SSN and card. They received thier EAD a few days earlier and we had that and both Brazilian passports and ID cards from Brazil as well as the orininal Brazilian birth certificates as well as a certified translation of both. We were told it would take 6 to 8 weeks to receive thier card and number as they needed to translate the birth certificated with thier own translators and verify information with the USCIS. Is this normal or we just getting jerked around. Any one been told the same?

    My Wife applied for her Social security card prior to our wedding, received the card a week later. After we got married she went back and applied for a name change, again the card came withn a week.

    All she needed was her passport, I-94 and marriage license and certificate...
