  1. Hi everyone! 

    I'm filling the form i-944 and I have some doubts concerning part 3, item 15, question D: "have you enrolled or will soon enroll in health insurance but your health wlth coverage has not started yet?" 

     

    The problem is that the very first question in that item is "do you have health insurance?" 

    I have health insurance since June 2020, so I have active health insurance and I answered yes.

    And I don't understand weather I should answer yes or no to this question (D), as if I answer yes, it feels like redundant information, if I answer no, I'm afraid that I'm saying that I don't have health insurance! 

    This is confusing because of the part "your health coverage hasn't started yet". 

     

    What should I answer? Thank you 

  2. I filed the AOS without the i944 and mailed it on Wednesday, it was delivered this morning. On he USCIS website there are no updates regarding the i944 form, so I hope I did well as this is the second time that I mail the application as the first time it was rejected because of the i944 (I didn't file it the first time because I didn't know about it).

    My concern now is that I thiked "Yes" where it asks weather I am exempt from filing it and in the notes I mentionned the injunction of inadmissibility... But reading previous posts on this thread, that was probably a mistake and I shoud have thiked "No". I hope that that won't be a reason for rejection!!

  3. Hi guys,

    I red many posts on this topic, but I ran into contrasting information and I as I just got my AOS application rejected (because I didn't file the i-944 form that is not even required anymore!!), I want to avoid further delays before resubmitting it.

     

    I got married in California this May and I changed my last name to my husband's last name.

    So, now I wonder, should I file the AOS application using my "old" last name or the new one? Would the marriage certificate be enough as a proof of that?

    The confusion comes from the fact that I know that the GC is a sticker applied on the passport (am I correct?).. And on my passport I have my maiden name, so I wonder wheather the "mismatch" could cause any problem.

  4. Hi guys,

    I recently posted on this forum saying that my husband and I filled for AOS but after two months we didn't have any NOA from USCIS.

    well, this morning we got our whole envelope back.

    On top of the i485 form there is a rejection letter, stating that:

     

    1. We need to add the i944 form (which we didn't send with our application as we didn't know of its existence)

    2. We need to fill the form I864 (which we did file and mailed, they even put a staple to it! Why would they say that we didn't?)

     

    And on top of form i130, there is another letter saying that we need to fill form i485 (which I guess they ask for as they reject the one we sent).

     

    Ma question is: what to do next?

    File a whole new application or "fix" the errors and submit a new application, but mentioning the first one?

    The doubt arises from form i944: apperently there is an injunction or a lawsuit of some kind and I red that USCIS can't ask for it to all of the applicants who file from July 30th.

     

    Any advice?

    For those who applied for a marriage based AOS, how long did it take to receive a NOA/case number or any kind of receipt?

     

    My husband and I sent the envelope on June the 9th, but after two months we haven't received any notification from USCIS.

    (we haven't been charged for the fees either. And we did send the I-1145 form)

     

    Any idea of how to get in touch with them?

    I see you're in California (I live in LA). Luckily Senator Kamala Harris's office is very responsive about helping immigrants. Google her website and file a report under "Help with a Federal Agency." Provide as much info about yourself and your case as possible (birth date, passport number, date you mailed the papers etc). Her office does take a little time to get back you but they do always send letters updating you about your case. 

     

    I know USCIS is even more backlogged due to COVID but I feel like 2 months is way too long. You should have received the receipt notices and a case number by now.

    we are both quite worried, this is a very concerning situation considering that we have no way to get information from anybody and all we can do is basically wait.

    I'm a little nervous and wondering weather anybody else is in a position similar to mine.

     

    My husband and I filled for AOS two months ago (June the 9th), but we haven't hear back from USCIS yet... Which means two months of wait. Is this normal?

    I red on the forum that people get responses (case numbers I mean, or some kind of reception notification) as quick as 2 weeks after sending the paperwork, max 7.

     

    A bit of background story (shoud it be useful):

    I came to the US on ESTA on March this year and my 90 days as a tourist ended on June the 9th (day that we filled an mailed AOS), so now it's two months that I've been here not lawfully I guess? This makes me extremely nervous as should anything happen, I don't have any notice from USCIS to prove that I at least started a process to stay here legally.

     

    My husband and I got married in May and we sent the forms i130, i130a, i485, i864 and g1145 (along with copy of all of the personal documents requested and so on).

    I was waiting to receive a case number to add the i944 form (we didn't know about it when we filled the application), plus the medical one and the two additional ones to request permit to work and travel.

     

    They might reject the application as the i944 was not included, but still no news of any kind from them!

    I don't know what to do, but I'm really nervous and worried.

     

    Please note that we filed a paper application and we haven't been charged for the fees.

     

    Do you guys have any suggestion?

    I also tried to call them, but they don't give any information without a case or receipt number.

    Maybe somebody has a contact number for the Chicago office? (that's where we sent my application, we are based in California)

Our first attempt was rejected because we didn't file the i944, same as you will be. We received it back after about 2 weeks and resent and it arrived on 6/2. Still waiting to hear. I would wait for them to send it back to you and just get everything they want for the i944 while you wait. You won't be charged. 

     

    On another note, visa overstay is forgiven when married to a USC right?? I'm fairly certain it is im just anxious especially because I live in a border town so border patrol is everywhere.

    As for the overstay, we talked to a couple of lawyers (weeks ago) and all of them said not to worry about the overstay as we are married.

    But like you, I find it very hard to manage the anxiety when it comes to this matter

  9. Hi guys!

    A little bit of a drama here as my husband and I filled the application for AOS and sent it yesterday to USCIS in Chicago and we are a little worried because we didn't attach the new i944 form.

     

    A bit of context:

    He is an American citizen, I am Italian (he actually has Italian citizenship too) and we have been in a long distance relationship for about a year.

     

    I came to USA in March this year under the visa waiver program and we were planning to move together to Denmark in May.

    But that was not possible anymore because of the pandemic (canceled flights, no entry to the country, no job market and so on)

    Other than that, we were planning on getting married this summer, in Italy

    But given the situation we decided to do it in May in California and file for the AOS.

     

    So the marriage was celebrated about 75 days after I entered the country. We sent the envelope to USCIS yesterday, June the 9th, which was the last of my 90 day stay here.

     

    I have a couple of doubts and I hope that you guys can help me with that!

    First, we found out about the i944 form yesterday and as we didn't have time to file it during the day (as it calls for documents that we didn't have ready) we decided to send the application without it, planning to send the form during the next week or soon. Would that be OK? Or that might cause the rejection of the application?

    I red that USCIS would simply ask for it, along with the medical one (693 something), but there is no certainty.

     

    Also, we red that as we got married before the end of the 90 days, there might be the presumption that we were already planning on staying. Is that true?? We could have waited a couple weeks more for the wedding, but I would have overstayed without a "valid reason" and isn't that against the law?

    We have our flight ticket cancelation and my application to an university in Denmark as a proof that this was not planned, would that be sufficient proof?

     

    So I guess, my real question is: what to do now? Send another envelope with the additional forms? Or block the checks and resend the whole application including the new forms? Or Just wait for USCIS to ask for them?

     

    I am so anxious!!! We were trying to do everything following the rules, but it feels like a maze.

  10. Thank you all guys!!

    My doubts arise from the fact that this all AOS thing is a last minute thing and I need to translate all of my documents into English (birth certificate, vaccinations, etc.).

    I already sent them for translation, but it's gonna take a couple of days before receiving them. Then I need to send the forms and the documents to USCIS and I red that they consider the date they receive the envelope and not the one when I actually mailed it.

    And at this point I'm pretty much sure that that is gonna be at least a couple of days after the deadline of my 90 days lawful stay in the country.

    I'm so worried!!! I want to do everything according to law and it makes me feel really anxious that I might be breaking one.

  11. Hi guys!

    I came to the US almost 3 months ago with ESTA and a week ago my husband and I got married. We decided to stay in the country and file for the AOS

    (please note that none of this was planned ahead; we were planning of moving to EU together, but things changed because of the pandemic)

    We are filing the forms now and apperently we need to file the i130 (and 130a for me) and the i485. We found out that the first one can be filled out online, but the second one has to be mailed.

    Our doubt is weather it is OK to do so... Maybe it's better to print both the forms and mail them? Our preference was to split the procedure as I have only a week left of the 90 days that I can spend here with ESTA and the online procedure makes it faster to start the AOS process, as I can submit my personal documents digitally and we don't need to wait some extra days for the post office to deliver the envelope.

    what do you think guys? Any advice? Thank you
