  1. Well, we received a letter from USCIS today requesting additional information to make a decision about my wife's AP expedite. My wife's mom had died and her house needs to be put in my wife's name now. There's a certain amount of time to do this determined by Ukraine law and the deadline is getting close (May 6th). My wife has to appear in person as it can't be done long distance over the phone.

    When we called USCIS we were told that 2 of the criteria would apply (only need 1).....so it looks like we have to have a copy of the death certificate and a letter from the Ukrainian attorney stating what the Ukrainian law is, oh, and full translations of both. What makes this frustrating is that May 6 is also the 90th day mark from the AOS filing date - so they wouldn't even be expediting that much!

  2. We called USCIS today and requested expedited processing on my wife's I-131. The person I talked to said the reasons for the request met 2 of the criteria required and didn't indicate there would be any problem. This evening I checked the case status and it hadn't changed, however under case history it now says:

      We're trying to decipher what this might mean - anybody know?

  3. For K1 visa it does not matter where she is. Even if they send the package to Moscow for instance, you can contact the embassy and ask them to transfer the case to any other embassy anywhere. You do not have to do the interview in the country that you have citizenship.

    You have to contact the embassy where you want to be interviewed and ask them to request the packet from the original embassy.....anyway that's what Moscow told us. It took about 2 weeks to transfer our case from Moscow to Kyiv, but fairly straightforward with no problems.

  4. We cleared the NOA2 stage in just over a month. I called NVC and was advised they sent the package to the Embassy (Moscow) on 11 July via DHL. We are approaching a month so now I am wondering how we will be notified. Will we both receive an e-mail? I gave NVC her e-mail address. Or, will only I get an e-mail? Or, will she get information sent to her via regular post? I searched this forum but don't see this specific question being answered.

    You, the petitioner, should be receiving an email from the Moscow consulate anytime now (ours took about a month after it left NVC) that has all the information (DS-160, medical, fees, etc.) you need about applying for the visa - they don't send anything in the regular mail - at least my fiancée never received anything. They will also mention that you should forward the email to your fiancée. Good luck!!!

  5. Well we are now at 64 days. Perhaps it will come in a few days. But what if the Russians are holding it up, and not sending papers to Ukraine because of the war? Is there any chance of getting a waiver?

    Somebody posted about getting a power of attorney in Moscow and having them get it the same day, is this realistic? Can it be done that way?

    I'd give it some more time if I were you. If you're getting close to the I-129F approval expiration date, you can just email the US consulate in Kyiv and ask them to extend it and tell them why and they'll keep it valid for an additional 4 months....we did that because of the delay in getting my fiancee's Russian certificate.

  6. She's not in the East, she's from west of Kiev. She went to the Russian Consulate in Kiev on April 9th and ordered the police certificate and was told it would be there withink 30 days. Is it possible to get a waiver under these circumstances? The uscis website says that "police certificates from some countries are not available." Well, that doesn't exactly apply, as they are available, but what can you do if they don't give you one?

    My fiancee is a Russian citizen also living in Ukraine and was told 30 days, but it took 60. She didn't go to the Russian consulate - she went to the Ukraine police in the Kievska Oblast and was able to order both Ukraine and Russian police certificates at the same location (this was back in January). She lives just a few miles south of Kiev and was born in that area.

  7. How long after the K1 and/or B2 visa is approved do you physically get the visa? Assuming you do whatever is in your power to expedite it (e.g. pick it up at the location?)

    I am most interested in the answer for the Kiev consulate.

    Our ceac status changed to ISSUED on 5/23, she got an email telling her it was ready for pickup on 5/27 and we picked it up at the Zhulaney airport TNT office on 5/28 - however we were in AP for 2 months after the interview and the status went from AP to ISSUED. If you're told it's approved at the interview, then you should be able to pick it up within about a week.

  8. again, very similar. i wrote to the embassy two days ago, out of helplessness and asked to shed some light on the status. they updated the status for us as well, but again, to AP. and they did reply to me, but in a very generic way, saying that the case is in AP (surprise!) and that they will contact my husband with further instructions once they make a decision. he also served in the military for a long time, so it makes sense, as you said, that certain cases automatically go into AP. i'm sure that's decided before an interview.

    Well, ceac status has been updated 3 times in the past couple weeks but still AP.....sigh.

    I've booked a flight for the last week in May after the election, visa or no visa - just because we want to see each other. So, I hope the Kyiv area stays relatively calm.

El Burro, any updates on your case? we have a similar situation: husband had an interview in Kiev on March 12 and was asked to fill out CV/detailed resume. the case has been in AP since then and this waiting thing has been frustrating beyond words. i am graduating next month and need to decide on a job and may be move to the east coast (in California currently), but i hate making a big decision like that only to find out later the visa is denied, in which case i'd go stay wtih him in Kiev.

    Does anyone have an idea how long AP an take at the Kiev embassy? i understand it's all individual, but may be there's been a trend...

    My fiancee's interview was March 6th and she was asked to submit the detailed CV/resume which she sent to them two days later and like you, our case has been in AP ever since. On this past Tuesday out of frustration I sent the Kiev consulate an email asking what the status of our case was and if there was a time frame available that she could expect to be issued the visa, and I also asked them to please cc me on any further information they needed from her. Well, I got back no response but the next day I checked ceac status again and saw that our case was updated, but still AP. Nothing for a month and then strangely updated right after my inquiry?

    Yesterday I woke up to an email from KyivIV requesting additional information in the same format we used for the CV (case was updated again on ceac, but still AP). When they say detailed CV, they mean DETAILED CV. They want to know exactly what she was doing EVERY year since 1984! My fiancee also served in the Russian military for a while when she was younger (this is what really triggered the request for a detailed CV), and they want every detail about the work she did in the military and even the name and rank of her commanding officer. She never worked on any top secret type stuff, so we're not overly concerned. It probably doesn't help that US/Russian relations are strained at the moment.

    I've done some research on these requests for CV/resumes, and it seems that the vast majority are eventually approved. I believe the CV requests are pretty much automatic if the applicant meets certain criteria, namely some types of educational backgrounds, past research or, as in our case, previous military experience.

    If I had to guess, I would say that in my fiancee's case, we have about 30 days more until the visa is issued.
