  1. The answer to your questions depends on several things, including whether or not you live in a community property state.

    I would first ask the bank, although I would not necessarily trust the information. More importantly, I would ask an attorney. I doubt that it would cost that much. In fact, there may be free legal aid in your state.

    I can tell you that I would not feel comfortable being someone's beneficiary as named in their will while the bank account had a different named beneficiary. I would be surprised if the account had anything other than a zero balance by the time you got around to producing an enforceable will.

    See an attorney.

  2. I filed my tax return (late-I filed extension) so I submitted my completed tax return as per IRS instructions to IRS and also included copy of that return with my AOS packet as specified. WELL, IRS writes me saying my return is incomplete, blah blah blah please send another, I called IRS they said they have no record of my tax return on file! ARGH! so i am worried if USCIS contacts IRS I think I am gonna have big problems. any input? Does USCIS really check with IRS? I saw there was a disclosure on the aff of support......

    Hi...Just a suggestion....verify that the IRS has not yet received your return....800-829-1040; if that is true, you may be able to efile your return, but I am not certain if it would be processed without an extension being filed. It won't hurt to try. It is possible to get confirmation of receipt of the electronically filed return, but I would suggest you use a reputable tax prep firm. I alway recommend cpa's.

    If you cannot efile, mail your return to your IRS service center, using an original signature and the supporting documents....Across the top of the return write "possible duplicate." I would not take it in to a local office nor would I send it certified as these methods are outside the normal procedures and may slow the processing of your return. I believe you will have plenty of time for it to be processed.

  3. My fiance is coming on Saturday. She wants to setup her phone for roaming, so she can text message her family. She will only bring the sim card.

    Does she need to maintain a load every month? Will her SIM card work in the US?

    I have cingular.

    i just hope somebody will post here that they're using Smart Roaming in US.

    anyway, as per my experience in Middle East, i have a smart roaming & i need to maintain a credit otherwise it will be disconnected. The P300 load last for like 3-4 months. I think it depends on the SMS messages that you receive.

    So, what we do before is that..my family just send an SMS message on that SMart number when its emergency & when im not online. because you can also use this CHIKKA when sending & receiving SMS messages from the philippines.

    When they reply on the chikka account, it will only cost them P2.00 per SMS messagel.

    I don't know much about all this but I believe that the 3 letters @ the start of your petition receipt number represent the Service Center where you filed it. Because we filed ours @ the Texas Service Center, our petition starts with WAC, for Waco, Texas.

    When I am monitoring my petition online, how do I know if we have been touched?

    Also, when you say you were touched by a phone call, did you call CSIS or did they call you?

    I appreciate your answers.

    Go to https://egov.uscis.gov/cris/jsps/index.jsp and create an account using your case number. The "Last Updated" information on your case will tell you when you get touched. SImply, a touch is when this last updated date changes. I called USCIS asking about my case and in my experience sometimes this will lead to an updated touch, sometimes not. USCIS never called me.

    Aloha All!

    After 10 months of HeL it all came down to a interview that lasted less than 5 minutes.

    Hello My dear Husband .

    WOW! the great day of our lives is today, 24 day of August 2006, 6:30 in the morning Appointment for Interview. . . I got a wake up call at Bayview Park Hotel Manila from you mahal ko and i am very happy and excited. . . When i heared your sweet and lovable voice saying I LOVE YOU and GOODLUCK and you will be at my side the entire time i have the strength and confidence within myself already. . .

    And so, after our more than 30 minutes conversation i gargled, then eat the "manok and little rice and drink water", took a bath, tooth brushed, wear my new violet blouse and black pants. . .

    Well, when we crossed the street, people who are taking Visa Photos is saying "in this side is the 7:30 AM schedule and on the other side is the 6:30 AM schedule. . .

    We fall in line around 5:00 in the morning. . . 5:15 AM, we are already seated infront of the US embassy waiting area. . . there are 4 rows of long bench and around 20 people in each row. . . i counted from the start, i am in number 30 and Anna May number 31. . .

    At around 5:55 AM, the guard let us stand and by five people are already allowed to come inside and have the baggages pass through an X-ray machine. . . i left my cellphone to our sister Evelyn who was not allowed to enter. . . and so that it will be easy for me to exit after the interview but in the X-ray machine they saw the digital camera, so i left it and they ask me for an ID for the claims. . .

    After the X-ray machine thing, we walk and look up the arrows saying Immigrant Visas (though we are Non-Immigrant, i remember you told me that Non-Immigrant Visa application is being processed at the Immigrant Visa Section.

    At around 6:20 AM, we were instructed by an employee and the guard to have a sit. . . And at around 6:45 AM the employee is giving an instruction by rows to go to the ticket booth wherein we will be issued a four digit number and also they collected the DS-forms 156 & 157. . . Saying the we have to memorize as much as possible that 4 digits number. . . Because we are going to use that number until the interview and paying Delbros will be done. . .

    The employee told us that the four digit is our queue number and the other two additional digits is the WINDOW where we will go when we see our number at the queueing board... And we were also instructed that for those K1/K3 Visas only one among the member of the family is allowed to go to the ticket bo

    oth po. . .

    I got our queue number 7011-26 at around 7:05 AM. . . At around 7:25 AM our names was called for finger printing [our anak no need] then after that we were told to take a sit again. . .

    At around 8:05 AM i saw our number in the queue board flashing, this tells us that we must go to Window number 26 wherein the Filipina staff will get the documents they are requiring. . .

    I first greeted her GOOD MORNING Ma'am. . . and she replied Good Morning too... First she asked my name. . . to check if the documents infront of here in rubber band match my name.

    She asked questions in Tagalog and I answered in English!

    She arranged our papers, i saw the DS-forms 156 and DS-157, our passports, and the petition papers that you submitted.. .

    The nice lady said can you give me your Birth Certificate, our anak's Birth Certificate, our Marriage Certificate, your Divorce Decree and my NBI Clearance. . . She started asking me.

    How did we meet, i replied her "Ma'am we met through my cousin wherein she gave my telephone number to him last June 2005 and we started communicating by way of his calling me almost every day and sometimes 2 or 3 times a day and we chatted, and exchanging emails and sending letters. . .

    She just nodding her head,

    When is the first time you saw him? October 14 2006 Ma'am. . .

    And then you got married right away during first visit?

    Ma'am. prior to our meeting each other, we are open and honest with each other and we started as friends and then fell in love online but he said that the most important thing we meet each other in person and confirm our love for each other and so he came here last October 2005 and sparks flew when we first met then after few days when he proposed for marriage and then i said YES to him Ma'am. . .

    Ok, when did the last time you saw him last May 9, 2006 during his second visit ma'am. . .

    How many time you got married, twice Ma'am,

    i said Ma'am, Jack told me that there comes a time in their lives that they just exist and lives with a relationship of more like brothers and sisters rather than a wife. So they decided to have divorce.

    Show me your wedding pictures, i handed the throw away wedding and reception pictures plus the digital ones which you arranged that i put captions.

    i said some more pictures ma'am? she said no its enough.

    Next she asked for the Affidavit of Support, i handed to her the 2 I-134 of me and Anna May.

    Then she asked me what does he do for a living?

    i said ma'am he is a artist and here is copies of his website.,

    Then i handed to her the whole bunch, Our 2005 joint tax return, your financial letters, my ITIN, out joint ATM accoint, ATM receipts of my withdrawals, Bank letters, . . .

    I am about to give her the trust showing we own everthing together and the estate planning but she said its enough, just give it to the Consul if he asks for anything more. . .

    Then like you said to do i will offer my all the supporting evidence for my late BC to support my being late registered. . .

    But she said, what we require is a baptismal taken originally when baptized, this one you just got this year 2006.i gave it to her . .

    i know is finished because she already put rubber bank on the whole bunch of our papers. And she said take a sit and wait again. . .And i said Thank You Ma'am. OK, she said.

    So i sat down and waited for our number 7011 to flash at the queueing board. . . at around 9:00 AM, the number flashed 7011-28 . . . there are two chairs outside and i sit down with our anak while waiting for the Consul to finish the interview of another girl ahead of me. . . But from time to time, i glance and see the face of the Consul at Window 28, Wow, i never seen a smile and i heard him repeated as in 3 times the question, in a little while a lady came near the Consul (its an interpreter). . . Then a lady outside told me, you come in once the girl ahead of you is finished. . .

    So, i said anak come hear. . . I seated on the left side and Anna May on the right side. . . Before i sit down, i greeted the Consul GOOD MORNING SIR WITH A BIG SMILE.

    What is your name he said, maybe to check if the paper he is holding is ours. . I did not get nervous. . . he removed the rubber band on our documents, i know its the one you submitted plus the Pinay employee got f rom me at Window 26. . .

    . And then i saw the APPROVED April 13, 2006 stamped on top of the G325 that we both filled out that you submitted at NBC. .

    OK, while the Consul is scanning and reading the contents of each document, i am looking at his face and guapo eyes just getting the vibrations of his mood to maintain my confidence and in order not to get nevous. . .

    Then, the Consul asked me to raise my right hand and said "Do you swear that all of the information written here pointing to the documents (our documents), are true and correct?" i replied with enthusiam, "YES SIR". . .

    After that, the Consul said, OK tell me about where Jack's family came from? my answer was,

    Sir, Jack's clan was from Scotland in the 1600s but they moved to Oklahoma and then to California in a covered wagon due to hard times .Jack was born at Los Angeles, California then moved to Hawaii. . . Sir. . .

    Ok,OK.OK he said while nodding his head. . .

    Does he have siblings?

    Yes sir, i said, he has sister who died long time ago sir and he has one brother who lives in Hawaii also sir. .. Jack also has 3 nieces daughter of his sister and one nephew son of his brother sir. . .

    Does he have children? None sir, he has no child that is why when he found me and i have a daughter, he loves my daughter like his own very much sir, I love him very much and he loves us very much too. . .

    Why he has no child? because he was vasectomized sir. . . and i repeat my answer that is why he love my child very much sir and considered as his own child sir. . .

    Ok he said and while i am answering he is nodding his head. . .

    How long he was married before he was divorced, i pause a little and said sir around 12 years. . .

    he did not got married after that?

    No sir, he just had girlfriends but did not married until he found me, we got married sir. . . I love him very much sir. . . He is nodding his head again. . .

    i thought its pau but he asked one more question. . .

    Does he own a house?

    Yes Sir!!! the one we will live in and as a matter of fact sir, he just built a new house, the house is finished but no appliances yet we will arrange that together when we get there. . . And it is intended also for Rental so that we have additional incocme . . .

    OK, OK he said. . . Well, Goodluck to both of you. . .

    Thank you sir. .and i did like you said to do and ask . Sir, . . . ARE WE APPROVED SIR? . . . and while nodding again his head he said YES. . .

    WOW! i almost jumped up high but i cried, Anna May saw him smiled when i cried saying Thank you sir, thank you sir. . . Then he told us to wait outside for another thing to do. . . So we went back to the waiting area where we can see th

    e queueing board with numbers flashing. . .

    At around 9:35 AM the number 7011-37 flashed, we went to Window number 37 and guy gave me pink slip and said we will collect delivery fee of P165 pesos each and the guy said "after paying the DELBROS you can go home". . . upon getting the pink slip, i went to DELBROS booth, we were given 2 forms to be filled out. . . then after filling out, i fall in line and paid P330 pesos for me and Anna May. We paid Visa delivery and went to the exit door and we went back to the room where we left the camera. then went back to the hotel room very happy announcing it to our sister . . .

    That's the ending of the new beginning of our lives soon to be reunited as ONE WHOLE HAPPY FAMILY and move on with our lives.

    We arrived home safely and hope to see you very very soon mahal ko. I LOVE YOU and muah and tsups . . . GOOD MORNING RIGHT NOW. I will sleep after sending this one po.

    My wife got 5 stars for neatness and arrangement naman!

    If we had the whole trip to do over again i would have hired both Diwata and Ray and just played!

    Yeah ! We didn't sink with the Titanic and a year later things couldn't be any better.

    Oops! May have been better if we had stuck with the CR visas.

    Sure may have saved a LOT of stress with having to deal with AOS.

    Oh well that's history! Next up is the I-751.

    Anak will have her USC in October as I adopted her.

    If I brought £15,000 with me to the states, would I be liable for taxation on it?

    I do not know what the limits are before you are required to declare (to U.S. Customs) the cash you are bringing in, but the Internal Revenue Service does not tax you on money you bring in to the country, no matter how much or little it is. The federal government (and some state and local governments) is interested, however, in the earnings on what you bring, and taxes you on those earnings.

  8. Oh Thank God!! They deposited my check exactly 1 month after filing! Now i am waiting for the scan on the back to get my receipt number! I was starting to think it never made it there! :dance:

    niceguy26: that awesome news, i didn't want to tell you my check was cashed on 7/17 coz i didn't mail it until 7/06. and i was feeling really bad for you.

    yeah i would have even lost it even more :D lol... im so happy now. i checked it at work and threw my fist in the air haha. now for the long part. im just so glad its started

  9. Hi all,

    I think I messed up my last post (it was my first).

    We mailed our petition on 6/7. It was received @ Texas where check was cashed on 6/18, then sent to Calif. To date we have no hard copy of NOA1 but we have receipt # dated 6/18.

    We hope to be home together in Florida @ Christmas, but recognize that January is more likely. Optimism is a good thing.
