  1. I would follow those instructions and also get a co-sponsor. You have to fill out the I-864 no matter what because you are the petitioner, but if you can get a co-sponsor then it will help your case and also provide you with the peace of mind knowing that your situation will not be questioned if someone else is willing to take some of the responsibility to prevent your spouse from becoming a public charge. I hope this helps!

  2. Before I found this site I called the 800 asking my question, but now I want to see if maybe I got wrong info from the 800 number. Since a few of you have stated they are useless. lol

    I have not worked since March 2004. So I KNOW I don't meet the income requirements. I've been on disability since around November 2005. My question is, what do I need to send in with form I-864 since I have not filed a tax return for the past 3 years. I was told by the 800 rep that I would still need to file the I-864 since he's my husband. And that I should just show proof that I get disability and also send a statement as to why I have no filed tax returns for the past 3 years. Would that be correct? I've already filled out the form and written out a statement. Just waiting on the proof of income from SSI...We've already got my dad as a joint sponser so that's out of the way. I just want to make sure I'm doing the right thing so far.

  3. I'm a bit confused on where to mail the I-485. I-130, I-765, I-693. I know they all go in the same packet, but where to? I "think" it's supposed to go to the Chicago po box but I don't want to risk it and send it to the wrong place. My zip is 46902 if that helps any. Thanks to anyone who can help me out. :)

    Oh yeah before I forget...I've read conflicting advice on the I-693 medical form. Do I mail this with the other forms, or hold onto it until our interview? Thanks!!

  4. I think we may have found a bank that will let him be on a joint account without a ssn. We'll go in Monday to see how it goes. As far as being added to my lease, he can not be added at all without a ssn. They won't even add this baby until she gets a ssn herself. I don't know why they do that, but that's how it works where I live. We don't have health/life insurance together. The insurance I have right now because I'm pregnant is state funded and for pregnancy only. He is using his Scotland license to drive over here b/c the DMV will not let him get a DL without a ssn. I can def do mail addressed to use seperately. Not sure we've had anything send to both of us besides the title to our car. The utility companies here will not add anyone without a ssn. They wouldn't even change my last name on my accounts without the new ID. As far as pictures of the wedding...we only have a couple from outside the court room of us holding the license. It was a bit rushed and I wasn't feeling too good...would those be enough? I can get my family to do letters but what does it need to have in it? I looked through a link on here on ideas and it needs to be pretty detailed correct?

  5. I have a bit of a dilema as far as proof required to show my marriage is bonified for I-130. DH and I only own a car jointly. We do not own a home. We do rent but the lease is still in just my name for now. He can not be added until he has a SS# for them to run a background criminal check. We don't have a joint bank account because he doesn't have a SS#. We have no children together other then the child I'm carrying and she will not be born until after we send the forms off. I'm guessing the proof of owning the car together will not be enough, correct? If not, what else can I send to ensure my marriage is indeed bonfide? tia

  6. This is what I did when I file for I-485/I-130/I-765:

    - for AOS (I-485): 2 photos of me (I'm the non-USC spouse)

    - for Petition for alien relative (I-130): 1 photo each for me and husband

    - for EAD (I-765): 2 photos of me

    So in total: 5 photos of me (non USC) and 1 for my husband (USC)

    If the OP is filing for I-130, then the USC need to fill in the G325A form.

  7. So when he entered you had no intention to marry? You may need to prove that at some point in the process. If he quit a job at home, packed up all his stuff, and ended a lease or got rid of a house before coming on the visa wavier programme, that will look a bit fishy. It might not come up, but if it does come up and you're not prepared, it can be a very very big problem.

    No intentions to marry when he came over. His things (besides clothing and such he brought over for the visit) are still back home at his parents, where he was living. He did quit a job about a month before coming over and was looking for work with more hours as he was only getting 4 hours a week at work. Not that I need to air my bizz but to further explain why we married on his visit, is because I became pregnant. We thought it better for him to just stay here and not risk missing out on the birth of the baby and be here as a family. I already have a 2.5 year old son from a previous relationship and without my husbands help, I don't know how I would have managed this pregnancy. Believe me I would have loved to wait and save for a big wedding but things happened and we did what we thought was right.

  8. No he is not. He came over on the visa waiver program in December 06. We decided to get married on Feb 2nd 07, before his I-94 expired. I-94 expired end of Feb. I had called the 800 for USCIS *before* we got married. I explained the situation of how we had planned to marry even though he was only on a visitor visa (even though they said tech he wasn't on any visa b/c it was the waiver program). I was advised from the rep that as long as we were married before his I-94 expired AND had all the paperwork filed with them within the first year, he would be allowed to stay within the US awaiting his approval/denial. She told us to file said forms (EAD optional if he wanted to work or not while waiting). It was never mentioned if he had to be in current status but I assumed not since she knew he was going to be out of status before we even filed. So now I'm lost. I've since read on immigration boards that there may be a problem with him recieving a work permit since he's now out of status. I sure hope not but something tells me it's true. :(

  9. Hi - I have a question regarding getting a EAD even though out of status. My husband became out of status shortly after we got married Feb of this year. We are currently completeing I-485/I-130/I-765 and whatever other forms needed with those. We hope to have it all mailed before the end of this month. My husband came over as a visitor on the visa waiver program. No K-1 visa or anything like that. Does anyone know if the fact that he is out of status at time of filing, will that effect him recieving a work permit?? TIA!
