I am a business owner; however, I received a RFE for (I-864) stating that I did not earn enough money. My mother has agreed to co-sponsor my husband; however, she has completed a joint tax return with my step-father. Her income is enough to meet the income guidelines. Do I need to include the adjusted gross income from the tax return or just my mother's income for the past three years? I didn't want to ask my step-father to sign anything. Please advise.

My friend was recently married,and is applying for AOS from a B-2 visa. She has been issued work permits in the past (past employers). When completing the I-765 should she mark x next to permission to accept employment or renewal of my permission to accept employment? Please advise.

Mother overstayed her B2 visa. While in the United States (over 20 years), she married a U.S. citizen. Her husband turned out to be a loser. Can my U.S. born sister do adjustment of status for our Mom?

Thanks Mike-eeh and Odie. My salary exceeds the income limit. I submitted a joint tax return. I will send in an employment letter and pay stubs for the last 6 months. Is that sufficient, or must I resend the most recent tax return?

I am the co-sponsor for a family. The beneficiary received a RFE. It reads the joint sponsor does not meet or exceed the poverty level. I included my joint tax return. My income exceeds the poverty level. With the yellow RFE notice, I plan to send an employment letter from my job (on company letter head) as well as pay stubs for the last six months. It also says to submit supporting tax documentation for the most recent tax year. I already submitted the most recent tax return and all tax schedules with the initial package. Must I send another copy with the pay stubs and employment letter? Please advise.

My friend suffered abuse from her husband. She recently filed the I-360 and I-485. However, she forgot to include the I-864 Waiver. According to the USCIS website, the I-360 takes 5 months. Should she wait for the RFE for the I-864 waiver, or should she mail it in now? Her package just arrived yesterday (Vermont Service Center).

Hubby had a citizenship interview on 9/15. He passed the civics test; however, he was given a N-652 letter. Today a letter comes in the mail. It reads: Please come to the office shown below at the time and place indicated in connection with an official matter. Reason for appointment: Signatures needed on two documents. Bring with you 1. Photo ID such as driver's license and 2. Your legal permanent resident card
What does this mean? I'm sure that everything was signed in the initial packet. Please advise.

If a U.S. citizen is applying for AOS for wife and two step-children in the U.S.? What is the filing fee? I know that the wife has to pay $1490. The children are 4 & 12 years old. Please advise.

An I-912 cannot be submitted by itself but must instead be included with the applications for which a fee waiver is being sought; this is clearly stated in the I-912 instructions.

I need your help. My friend has been married to an abusive husband. She entered the marriage in good faith. However, she never filed for the adjustment of status. He refused to "allow" her to file for legal permanent resident status. She can't work because she has no work permit. She is going to file the I-360 (free). Must she have an approved I-912 before she can file the I-485 and I-765? Can she send I-360, I-485 & I-912 in one package? Please advise.

This new I-864 is driving me nuts! My friend filed for his wife and step-daughter. Here is what the checklist states:
In Part 1. Basis for Filing Affidavit of Support, please correct the following...
He has a co-sponsor. Since he is filing for his wife he marked 1a. I am the petitioner. I filed for the immigration of my relative. Was that wrong?
In Part 2. Information on the Principal Immigrant, please correct the following...
He typed his wife's first, middle & last name along with her mailing address, country of citizenship & date of birth. He left the Alien Registration # blank. She used to work on a cruise ship in the United States, but he is not aware of an Alien #.
In Part 3. Information on the Immigrant(s) You are sponsoring, please correct the following...
He marked YES I am sponsoring the principal immigrant named in Part 2.
Since his wife and step-daughter's file is at the NVC, he left #2 blank. I am sponsoring the following members immigrating at the same time or within 6 months of the principal immigrant named in Part 2. Do not include any relative listed on a separate visa petition. The wife and daughter have different case numbers. He left Family Member 1 blank.

I figured he could send a pay stub. He did not have a copy of the 2012 return; however, he now has a tax transcript. Am I missing something? Does this mean that only Part 8 is missing? Is this a false check list? HELP!!!!!!

A friend is adjusting status from B-2; however, she lost her I-94. She arrived to United States in 2010; therefore, her I-94 is not available online. She completed the I-102. Part 3: Are you filing with any other petition or application? Name of the application or petition you are filing concurrently. Technically, she will file the I-102 with the I-485. Since the I-94 must be enclosed in AOS packet, should she mark No? Has anyone had a similiar experience.

I am trying to help my friend pay for his wife's $88 AOS fee. He has already completed the DS-261 Choice of Agent form. When he tries to pay the $88, here is the error message-
This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please contact the NVC immediately.His stepdaughter's payment went through fine. He has e-mailed the NVC twice; however, they have not responded. Should he mail in a money order with the case & invoice ID #? He received the initial notification on February 6, 2014. Please advise. -
I think it figured it out. Even if there are no other sponsors, you have to put 0.00 in Part 6 (Questions 6c, 7c, 8c & 9c). Then transfer the figure (Question 5 individual income) to 9c (current income & 10 annual income). Don't let the mistake happen to others.

My friend (CR-1) received a RFE. It says:

x Item 10. The current annual household income must equal the sum of items 5, 6c, 7c, 8c and 9c

My friend's stepdaughter arrived to the United States in March. During this time, the new $165 visa processing fee had just been implemented. He paid the fee a month later. To date,she has not received her green card. I made the Info Pass appointment under the minor's name. I have a few questions-
1. Should I have made the Info Pass appointment under the petitioner or beneficiary's name?
2. Does the beneficiary have to go to the appointment? She is 16 years old, and does not want to miss school.
Has anyone had a similiar experience (Atlanta) office?

Send the proof that the State Deparment requested.
Proof that US citizen father has custody - child's school record with address and father's driver license with same address.
Don't make this complicated. This is a simple request to deal with.
There is no need to go to court. That's unnecessary and an overkill.
There's no need for letters from the mother - a 17 years ol does not need both parents to get a passpot.
You don't need doctor's records either.

Thanks for responding. His daughter's visa arrived yesterday. He was told that she has to pay an additional $160 visa fee (recently implemented on February 1, 2013). She will be in the U.S. next week.

My friend's husband was a student at the time of marriage. He did not make enough for the I-864. He has a co-sponsor. The co-sponsors are joint business owners (husband and wife). The I-864 is confusing. Since the income is the same- should the co-sponsor mark one or two joint sponsors? Is it necessary for the co-sponsor to include their business and individual tax return? The co-sponsor's individual tax return is significantly less than the business tax return. Please advise.
