We both got residency in Spain, and waited there during our years-long spousal visa application. (My spouse cannot enter the US without a visa, and so we could not do AOS as suggested by some of our confused European friends.) Spain has great IVF clinics.

It's possible that your husband will be charged for his time in prison. If he has assets, the state may try to collect from him. I have no personal experience, just read this NPR article.
