    If the petitioner/primary sponsor does not have the required income or assets, then they need a Joint Sponsor.

    I came to know from someone (with some immigration law background, but not in practice) THAT if someone owns a self employment business such an LLC with no or limited income but has all IRS fillings in good standing (i.e filing annual income tax and other Forms with zero income etc. ) can get an income qualification waiver from the USCIS?

    I'm skeptical because it makes no good sense of applying for financial supporting ANYONE without income? Doesn't filing for I-864 require someone to have a CURRENT income and proof such as pay-stubs?

    Perhaps a joint-sponsor could be the solution?

    I asked this on a different thread, but wasn't sure that was the right one. Later I found this thread and posting here too for your help. My situation is as following:

    My petition (I-130) fir my wife and children has been approved.  Now I am required to file paperwork and pay fees etc. 

    I've a few questions here. Hope someone would read and help me. 

    1. How much time do I have to complete all of the paperwork and pay fees from the approval? I received the approval letter from the NVC on September 4th, 2020.

     

    2. Among other documents such as financial, I read the instructions to submit 'civic documents'. Does that mean that I would need to submit our marriage certificate, passport copies, birth certificate etc like what I submitted to the USCIS when filing I-130?

  4. Hi Everybody, 

    So, my petition (I-130) for my wife and children have been approved on September 4th, 2020.

    I've given case and invoice numbers to pay the required fees. And also have been instructed to file i-864 and the immigration form (forgot the Form # right at this time) along with other documents. 

     

    My question to all of the good, knowledgeable and helping people here is this: how much time do I have to complete these things?

    I'm filing I-864 by March 2021 (sorry for the typo).

    Yes, I will not have any current income by then, but for the 2020 tax year, I should have over 50K income for myself from my job that I quit this month.

    I'm aware of joint sponsorship for filing IF I don't have enough income, but I will have that, AND, as I mentioned, I might NOT have any current income/pay stubs until then at that time

    Your opinion?

    I recently quit my job to start a tech start-up (sole proprietorship) business.

     

    By July of 2020, my 2020 annual income for 1 person income should be around 4 times more than the income threshold required to submit an I-864 for my wife and 2 kids, which I intend to submit in/around March of 2020. 

     

    I've registered my (sole proprietorship) business with my state and got an FEIN # from the IRS. I do not anticipate any income from the tech start-up business by the time I submit I-864.

     

    My question is like this: Do I have to have a current employment/income/pay stubs to file I-864? If you need more clarification of my situation, pls let me know

    But the instruction also says 'this:

    DS-260 Costs

    "Once your visa is approved, you will receive an immigrant visa stamp in your passport. At this point, the USCIS Immigrant Fee ($220) can be paid online here. This fee is required for USCIS to produce and mail the physical green card"

    This to me sounds she files DS-260 AFTER she receives the visa. Any words?

    The DS-260 Petition and filling fee:

    1: Do I, the petitioner send it to the NVC and pay the fee from here to the them or,

    2: Does my takes with her and pay this fee when goes to the local US Embassy for visa interview? I could not found this language in the guideline,,, or I perhaps missed..

    I know information is available on the USCIS, but it's so vast that its really hard to pinpoint what I'm looking for. So, I decided to ask the experts here who are selflessly helping folks like me! :) 

    My question is: I already submitted and paid the fees for I130. What else Do I need to submit? I know I would have to file Form I-864 Affidavit of Support. What else? Do I need to file DS-260 visa application  and $325 fee?

    Thanks for your kind attention to this matter. Can I pay the filling fee to a local embassy where my wife resides? All I'm trying to figure out if I could travel to her residing country and come back with her and the children to the States after she receives her visa. If so, I'll travel and file from abroad, using my US home address.. :)

  11. Hi Folks,

    I've submitted I-130 for my wife and 2 children. I need your kind help for the following issues:

    1: I gather the filling fee for I-864 is $120.00. But the Form itself says the following:

    "There is no fee if the sponsored immigrant files this form with USCIS or abroad with the Department of State (DOS); however DOS does charge a fee if they file in the U.S. For more information". Pls see the attached. Is this for 1 immigrants or 1 filling fee for all 3? Also, is there another fee of $325 to it?

    2: Do I need to reside/live in the US when I submit this Form? I've a permanent address in the US, and 

    3: Do I need to submit any proof of residence while submitting this Form?

    I'm submitting Form I-130 for her in 2 weeks. From reading others' various posts, I understand that the embassy will be asking for documents and no one knows what they would be. I'm trying to be proactive here, so that she could have the necessary paperwork. Her ex lives in Europe.

    I'm new in this forum. 

    I'm a US citizen and in the Form I-130 applying process for my wife from Bangladesh. She has a child from her ex husband. Does she need to obtain any written permission from her ex to bring her child to the US with her? What if her ex does not consent?  What's her option(s)? The child has been with her since birth.

    I don't know Bagledesh's local laws - I advise checking in the regional forums for some input. That said, you may want to have her start the process of getting consent as I would work under the assumption that it will be necessary (barring a court order).
