Ha luckily you didn’t get an RFE mine was sent February 22 and receive 26th but they considered it late which I find ridiculous but I just sent the courier receipt showing it was postmarked on the 22nd.

Did you send in the I-944 as well since it was received on February?

I don't know whether I-944's that have already been filed with applications are still being considered, or whether the injunction applies only to applications made on/after July 29th. In other words, if you already filed for AOS with I-944, is USCIS discarding your I-944 in adjudicating your case?

 

It would be weird to have to respond to an RFE for the I-944 if it's not being considered.

 

USCIS/USPS/the US government in general is moronic. We followed the rules and filed before I-944 was required, got an RFE anyway, and spent a month replying to that RFE only for the form requested to be tossed out by the courts. Could be worse, I guess.

 

Exactly I don’t know how they can come up with rules and don’t even follow them it’s so annoying and frustrating. We had file before the rule goes into effect just to get an RFE . My lawyer responded to the RFE last month by sending receipt showing it was postmarked on February 22nd and the updated I-485.

My AOS timeline:

 

Feb 22 applications sent

Feb 24 received

Mar 31 biometrics scheduled in Atlanta, GA, but by that time everything was long closed down due to COVID of course

July 13 ASC Atlanta reopened

Aug 11 new biometrics appointment

 

At this time my case status on the USCIS website still just says fingerprint fee received/ case received

 

I hope this gives some of you some hope to also get your new appointments soon. And fingers crossed they are not going to shut down again before every single one of us got their

It means that the I-944 and Public Charge Questions will not be considered in making a final decision.

Maybe others can give their opinion. So basically August filers will not be subject to the same scrutiny as prior filers. Also, this is only in effect as long as the SDNY decision is in effect so I would get your applications in quick as this can always change. 

 

So for anyone filing the I-1485 on or after July 29, 2020, you do not have to file the I-944 

What does it mean if I didn’t include the i944 back in February and got a rfe last month? 

Hard to say since everything is moving slow with USCIS at the moment.

I’m in the same boat as you my lawyer had just file the new i485 and put a letter attach with the receipts showing it was postmarked before February 24th.

To me that sounds like they are doing nothing on my case until biometrics is completed. Meaning, not only will they not give me an EAD, they will not see if they need to send out a RFE or make any other progress before it's completed...

How to encourage USCIS to make an exception??

I’m in the same boat with biometrics not completed before the USCIS closure . Now cases are most likely on hold until the offices are open creating even more backlog . Even then there’s no telling when we’ll be hearing anything. I just wish there was an exception where they could’ve just waive the Biometrics appoint or just even open but to only a limited amount of people.

I had sent mine in February 22nd and delivered February 26th. I didn’t get a receipt notice in Mail until March 19. I’m not sure why in your case it’s taking so long but with this whole crisis we have going on things are gonna probably take even more time. You sent it off way before the outbreak so hopefully you’ll get an update soon. 

Last month February  22 I had my lawyer sent out AOS application I haven’t heard anything from USCIS no receipt nothing was wondering if there’s anybody on here in the same boat

I only have a copy of the I-94 and a copy of the biography page of the passport I had lost 

Has anyone use a copy of their I-94 for proof of entry when AOS ? Did you guys need more evidence for proof of entry like a FOIA, air plane ticket or the copy of the I-94 alone was fine ? 

Yea I’ve tried that only options are I 102 or FOIA

Hello I recently file to get a FOIA with uscis and cbp to get a copy of my I-94 since I can’t find it online assuming it only goes back 5 years on the cbp I was wondering how long it takes ? And wonder if I should just file I-102 in case ?
