    Aw :( that stinks! well, I'm sure it's on it's way. I just hope my case doesn't get a "special" treatment again like it did when I filed for I751. That took 8 months to process.

    Anyway, I hope someone can tell me whether the letter i received is some sort of RFE?

Just a little confused....i received the yellow letter that says "THIS IS NOT AN INTERVIEW LETTER" and just tells me that upon review, USCIS have identified additional documentation that may be needed and is asking me to bring 1) Driver's or state issued photo ID and 2) copy of IRS tax forms for the past 3 years.

    When I submitted my application, I sent a copy of all out tax forms from 2008-2010. Is this letter considered as "in place for scheduling" or is this an RFE?

  3. I had my biometrics on 11/18. No updates since then...

    Btw, I went to school in Providence, RI. Good to see October filers from RI. Good Luck to Zen Den for tomorrow!

  4. The officer was very serious, questioned the whole marriage. No small talk or smiles through the interview. A lot of yes and no questions. At the end, she stated she will review the case and the decision will be mailed. She took my greencard and my passport was stamped with a 90-day I-551. She gave no indication of approving the case.

    I have been checking the mail everyday since Tuesday and on the USCIS website but still shows initial review.

    Did they tell you they will mail you the decision?

    Yes, she said the same thing, "We will review the case, and will notify you of our decision". She made a photocopy of my greencard and my license but did not ask for my passport. Is it the usual to get a stamp? :(

    I have also been checking everyday....

    I just wanted to wish you luck and I also noticed our dates are so much similar, I too filed

    In July 2010, bio done 8/20/10 and interview 4/26/11. I also filed in vsc!

  6. This could predict the outcome, largely or in part. Most ROC cases are approved without interview, but 10% of applications must result in an interview (statutory requirement). If the questions were seemingly that perfunctory, was this interview part of the 10%?

    When we filed the RoC, there was no question in the form about the USC being incarcerated so we left that detail out. My husband wrote a cover letter also leaving out the fact that he is incarcerated. When I got the notice letting me know that I have a pending interview, that was when I looked for a lawyer and some lawyers thought I filed my RoC wrong, that I should have filed with a waiver, etc etc but this lawyer I hired said I did everything right and that they called me for an interview just to get the facts straightened out or it was something random.

    I really hope I hear from them soon. Also, when I check my online status, my file has not been "touched" since my biometrics which was 8/20/2010.

  7. Just wanted to share my ROC interview experience. It was very brief, in my opinion, since my situation is very unique. (USC spouse currently incarcerated and therefore cannot accompany me to the interview). The IO just asked straight forward facts like what's your husband's name, when is his bday, when did u get married, when did u first came to the US, when was he arrested, how long has he been incarcerated. Basically, she just asked for dates. And if we have children...we do not. She also asked where I worked and where he worked. Then after that, she said, "Is there anything else you would like me to add to your file?" At which point, I showed her pictures of the wedding, pictures of us together, letters from family/friends about our marriage, his letter of apology for not being able to appear in the interview, his lawyer's letter, bills, bank accounts, etc. Then she said "Ok, I will have to review your case and we will notify you of our decision".

    My lawyer thinks it went well. He thinks I will know within the month. But the IO was hard to read and I feel sick to my stomach because she didn't ask personal questions. No questions about how we maintain our relationship, etc etc.

    This site is very helpful to me, and I am writing my experience to help others who are in a similar situation. I hope I get my 10yr GC soon! :whistle:

  8. I will be meeting a lawyer this afternoon to discuss my case. I hope everything will be ok. I'm really nervous. I also hope someone in a similar situation or is knowledgeable about cases like this read my post and provide insight.

    According to OP it is the US Citizen spouse who is in the clink, his moral character should not factor into removal of conditions of spouse's green card. This is why the suggestion to have legal representation for the spouse who cannot go to interview.

  9. I traveled while my I-751 is pending and was out of the country for over a month. Since you are traveling in March and your GC does not expire til August, you should be fine :)

    Firstly not a problem for you, you will still have a valid card to reenter to the USA with.

    Anyway only problems I have ever seen is one report about an Exit control officer in China not accepting the letter and expired green-card, causing a US resident to miss a flight, and having to talk with a supervisor. From that experience others on another board simply go to field office and request an I-551 stamp in passport prior to travel while holding an expired green-card+I-751 letter.

  10. my husband is the USC and I am the immigrant. Does his moral character important for the ROC? I have called several lawyers and one said that the presence of a lawyer in the interview may sometimes be interpreted as being "defensive". So i am really scared. BTW, my husband has been found guilty by the jurors, but we are appealing the case.

  11. Hi! I have posted here before I filed my ROC. This post is an update and asking everyone's opinion in my extremely unique situation. My US spouse is currently incarcerated and received an email from USCIS requesting to appear in our local USCIS office for an interview. We never received an RFE when we filed and now they want us to go for an interview. My husband will not be able to join me, so I have asked around if I need a lawyer for this. I am scared because I did not expect my husband to be in jail, everything happened so fast, and now I am alone and trying to fend for myself while still supporting my husband. His case is on appeal but we do not even know when this ordeal will end. Is it usual to get called for an interview without even getting an RFE? One suggested I divorce my husband and re-file my ROC (will that not make it more suspicious for fraud?)...it is not easy being married to an inmate but we love each other and we believe we'll get through this together. I have proof that we are still in contact (phone bills, letters)...i also asked the prison facility, but they won't give me a copy of the visitation log unless it is subpoenaed.

    I hope someone will read this and give insight to my plight. Do I need a lawyer? What other proofs can I bring?

    USC spouse is incarcerated 1 year and a few months prior to filing i-751. reason for incarceration happened before marriage. Entered marriage in good faith and still very much in love with the USC and believe his innocence (but that is another story and don't want to get started on that). Ever since his incarceration, I have tried to make a life for myself and am now able to provide for myself and for him and pay our bills. We filed i-751 on July and had biometrics in August and ever since, I have not heard from USCIS. I have submitted evidence of us living together prior to his incarceration but there are hardly any evidence of it this past year. I have a lease under my own name and I couldn't put him on it, insurance is just for me since I don't see a point of paying insurance for him when he can not use it anyway. Also did not mention in our letter that he is incarcerated as I feel like there is no need to mention it. Is this a mistake? Does anyone know what I should do now? I tried calling to ask for an update but the person said i'm still within the timeframe and to call back after 6 months. But my case has not been touched since biometrics appointment. I am afraid that i will be called for an interview and my husband will not be there.

    Can anyone tell me what's the best course of action is?

  13. hELLO Everyone!

    sorry I wasn't able to post the interview experience right away....anyway, we made it to the Interview 10 minutes late cuz we couldnt find a parking spot and then we couldnt find the bulding. But when we got to the entrance, the security officer let us through. I think they know the building is hard to find cuz there weren't any signs outside pertaining to it. Our appointment letter was given to a lady and we were asked to wait in the waiting area together with people waiting for their naturalization interview. We waited for less than 5 minutes and we were called and sworn in. Then we were asked to present IDs ( i gave my EAD, passport and driver's permit, my husband gave his Driver's license), and the officer sifted through the thick file that was my immigration papers. He asked basic questions like when is ur husband'd bday, and he asked him when my birthday is, asked us when we got married and where. Then asked for proof that we are living together so we presented bank statements, lease, magazine subscriptions, pictures. We dont have properties yet cuz we're still in our 20's and he's in college and he checked our age when we said we didnt have properties. I think if you're in your 40s and u can't present a joint property or something then it might be an issue. After that, he said "I dont see any problems here, i'm approving your application. In fact I'm ordering card production right now" and said Congratulations. He took my I-94 but did not stamp my passport with anything nor did he take my EAD card. So it was relatively easy than we thought it would be :D

  14. hahaha...as rmncm believes that a woman who can cook is better than one who can not, I strongly believe that you can't force a woman to want to learn how to cook. I came here in the US just knowing how to boil egg and cook rice using a rice cooker. Everyone was telling me to learn how to cook while I was waiting for my visa but I thought I can always buy frozen food or dial delivery. When I got here, my husband never said a word about me learning how to cook..instead, he led by example. He would cook me food and so when he left for work, I started browsing the internet and looking up recipes and surprise him when he gets home. So far, I was able to make kare kare, pancit, adobo, sinigang, spinach and chicken farfalle, chicken parmigiana, steak, honey bbq ribs, and some other yummy dish.

    Regarding OP's Q, here's what I did while waiting for EAD:

    1. sight seeing on his free time

    2. learned how to drive

    3. cook

    4. chores

    5. sell stuff at ebay

    6. browsed possible jobs at different job sites so I know where I can apply (I also applied to my first company without an EAD but I was honest with them when they called me in for an interview and asked me how soon can I start and told them I dont have an EAD yet but will be willing to start 2-3 mos from now once i get my EAD. Right after I got my EAD, I called them and they hired me)

    7. arranged and rearranged furnitures =P

    I'm sure you will find a lot of things to do here.. May times talaga na you will feel bored but just remember, once u start working, u'll be working for the next 30 or so years. SO enjoy your time together and have fun! :)

  15. Steph, hang in there....I know it must be driving you nuts just waiting for the EAD. I don't think it's nice that it takes that long.....then once u get the EAD, u again have to wait til u actually get hired.....*sighs* I hope you'll get your surprise in the mail really soon :)

    Please everyone, include us in your prayers for our interview is tomorrow. I am excited to get this over and done with but at the same time anxious and nervous. Trying to organize everything we have gathered for the 6 months I've been here. Hopefully everything goes well. Will keep you posted as to how the interview goes.

    been purposely avoiding VJ these past few days because it was hard to keep on hoping to get a notice transfer but today I got my interview notice instead. *sighs* I guess we're going to have to face them.

    Steph and Chris, I know it must be frustrating to have to wait and have our "lives" in the hands of other people who may or may not be doing their jobs well. I thought when I get here things would be easier USCIS-wise, but it's more complex and unreasonable. AT least with the K1 or K3 process, there really is a timeframe of 6-10months or so. I guess we just have to be patient and believe that everything will fall into place in God's perfect time.

    Congratulations to everyone who received their AP, EAD and GCs :)

    I have to start preparing for our documents -_-

  17. they can take xrays even if the person is a newborn. They just make the babies lie down instead of standing up cuz obviously, they can't yet. The PPD test will not be a reliable indicator for TB infection in kids esp if they had been given the BCG vaccine.
