Thanks, all is well no fraud here... I was very cautious about all the steps because I was afraid of being denied.
Thanks for letting me know I really appreciate it… I’ve gotten so much support from this forum.
No problem. I know a few people that apply for I-129F and got marry while waiting for visa. They surely got deny when CO find out about the marriage at the interview.

Hi,
My application was at the Nebraska Center, and it is one of the centers that takes the longest to progress I-130. So I thought/told it would help speed up the process with the I-129F. Our I-130 was approved about a month after I filed the I-129F.
Well! knowingly applying for I-129F after married is a immigration fraud. So be prepare to answer question. A lot of people got deny because they got marry while waiting for I-129F visa.

Just curious - why do you apply for I-130 and I-129?

Hi guys,
I support my wife financially but I sent money through remitly with my brother account and name. Do you think it is a good idea to submit money transmit receipt for I-130 application? I can get letter from my brother saying I reimburse him every time he send money to my wife. I don't know will this look fishy for USCIS. Thanks for your assistance in advance.

Thanks guy for a quick response. I will be filing I-130 next week. Any advice would be appreciated.

Hi - I am applying for I-130 for my spouse. the instruction said
You must submit two identical color passport-style photographs of yourself and your spouse (if he or she is
in the United States) so my wife is in oversea and I think I don't have to submit passport photo I guess. Please advice. Thanks

Yes we did have medical documents. They still didnt. I don't blame them.. If they issue it for us..I guess in future, people may use the same reason as an excuse. It was our fault. We learned a good lesson in a hard way for not seeking guidance on immigration. What's funny is that I am someone who usually look up and read a lot before actually doing something and I always try my best to do everything according to the law. In this case, I didn't because I was so upset and depressed about my dad's condition and I assumed we were doing the right thing since it was just a religious ceremony.
Thanks everyone for the comments and guidance!
Good luck to everyone!
So you show the medical document and they still would not give you a waiver. Just do it right this time for CR1. As long as you guy are for real, I don't see why not, you just have to keep on trying. I will do the same here. Just a little bit of time and money. It will prevail. I am still curious how they can find out your wedding. It is a mystery.

Make sure you are legally married.
Meaning we have to do at the court right! Is religious wedding acceptable?

Yes I filed I-130 petition last month.
During the second interview, My husband asked the officer what should we do now.. officer said we can apply for spouse visa.
Hopefully the previous k1 visa issue won't affect this one
The previous K1 visa shouldn't be issue I guess. But they are going to be more scrutinize because they think it is fraud not telling them wedding while processing k1 visa. Just make sure that everything is in place.

I still don't know how they found out. They didn't ask during interview and we didn't tell since it wasn't a legal marriage . It was at church only. It was 2 days after the visa was issued on passport.. they called my husband and told him he can't travel to US with that visa. they scheduled a second interview and when he went, they stamped 'cancelled' on his issued visa. 😢 We cried for weeks after that happened. It took us a while to come out of it..
We got married at church because my dad was very ill and he wanted to see our marriage. We only did the ceremony at church. We didn't register legally. So we thought it would still be okay to move forward with k1 visa process. We didn't know that it would affect our fiance visa process.
I am sorry to learn that you already got visa issue and cancelled after they found out the wedding. I am wondering what will happen if your husband didn't answer his phone or if he already gone to US with fiance visa. Same here we marry in church and the question never come up during interview. I still don't think they know about our wedding.

Did you misrepresent any facts during your interview? IE Did they ask if you got married/had any ceremony? If so how did you answer
No. The question never come up. They only ask a few question. How do you meet? Do you speak same language? What do your fiance do for living? what is your fiance name, age, religous? etc..

Same issue here. Got married in Feb. Went for K1 visa interview in April and got approved. But we got a call from embassy two days later and was told that they have to cancel the visa. They called us back and said they got proof that we had a religious wedding.
We were told by the embassy officer to do spouse visa
How do they find out you had a religious wedding. Did you tell them? Did you apply for spousal visa? I was thinking since they hasn't find out we had a religious wedding just go to the court and get marry and apply with that marriage certificate.

Should not be a total block, just adds the potential of a waiver which means time and money.
Just hoping that it will be OK.

What is 221g??
We had the same issue. But I don't know about 221g.. what is it?
221(g) is administrative hold letter that they give you after interview basically Refusal or need more information. Either the essential information is missing from an application (or additional information is required), or that an application has been placed on administrative hold.

In other words the CO was right about you two not getting married in the US.
Anyway, unless they scrutinize about you two so deeply that they find that the beneficiary lied during the K1 interview (already married but trying for K1 visa), I don’t see an issue pursuing spousal visa.
I honestly don't think the CO still don't know we did religious wedding. We were still plan to marry in US for friends and family in US.
Not even come up married question during interview. That was church ceremony and I don't think they can find out about the wedding.
-
No. the reason for refusal is interviewer didn't believe that we are genuine couple and didn't think we are going to get marry in US.
We didn't tell them we had a religious wedding.

Hi Guy,
We applied for K-1 visa but had religious wedding on March , 2019 during K-1 visa process. We had K-1 visa interview in July, 2019 and case send back to USCIS with 221g. So we decide to apply spousal visa. Will there be any problem for being marry in March and not told the counselor in the k1 interview if we apply for spouse visa now? Our marriage certificate date was March. 2019. Thanks

I know K3 is dead. I am talking about fiance visa I-129F. What I am saying is - it is fraud if you use fiance visa instead of spouse visa just because the process is faster.
