  1. Hey guys, I know this has been discussed bunch of times, I know we should be able to send to I 130 petitions (for my mother and father) in the same envelope using let;s say FEDEX.  However the question is that how do I put the form Number on the envelope on the side which is recommended on the filing instructions page at the USCIS's website.

I was thinking can I use to regular yellow office envelopes and put the petition and supporting docs for each petition in one of those envelopes, that way I can write the form number along with the beneficiary's name right outside of those envelopes (one each for Mother nad father) and then I will have the FEDEx folks put both those envelopes into one of their card board style envelopes with only the USCIS lockbox address in Phoenix (I live in Texas). I'm sure there's a way to put additoinal info right on the FEDEX envelope on the outside but I thought this might be cleaner and it will also keep the two petitions and their supporting documents separated. I will appreciate your responses on this please as I'm sending it out later this afternoon.

    Thanks

  2. Hello VJ Community - I was getting ready to file the paperwork for my parent (two separate I 130 petitions) and wanted to see if I need to send two of their passport size photographs with the petition. I was looking at this link on USCIS's website and got a little confused and thought I'd double check:

    https://www.uscis.gov/i-130

Also, I'm submitting the following documents as far as evidence is concerned:

Copy of my original birth certificate and translation in English

     US Passport & Naturalization certificate

Copy of Parent's Original Marriage certificate and English translation

Of course two sets of these documents for each petition along with two separate checks. Is there anything else that I need to include?

Thanks so much for your time!

  3. Hello Everyone - I was wondering if you guys have an opinion on this subject.

As I'm filing the I 130 petition for my parents (two separate forms for each), I realized that for my father's petition, I need to submit their marriage certificate as well. I also realized that both their names are spelled slightly differently on their marriage certificate as both those names as pretty common and of course just like any other proper name, can be spelled in different ways.  In my dad's name, it's just a matter of one letter "a" vs "e"

for example Amal vs Amel.  In my mother's name, it's two letter "ee" vs "i" for instance "Saleena" vs "Salina".  The names are spelled correctly on my birth certificate just not on their marriage certificate.  So here's my question - obviously there's not much I can do about how the certificate was written in the 70s and why they didn't notice their names weren't spelled right (can't blame them for that, I'm sure they had other stuff and a wedding to plan :)) but what I was thinking is this a scenario where I would put down OTHER NAMES USED (IN BENEFICIARY INFO SECTION). Typically you use that if a different name is actually used such as nickname or maidan name etc but not just the variation in the spelling of the name. I could be wrong, but I figured it's better to ask because if they (USCIS) notices two slightly different spelling of the names in their marriage certificate, they will at least see that I've already identified them under Other names used in Beneficiary info.

Please advice If I should use other names or not? Appreciate your help in advance!

  4. Hello guys - while I'm pretty sure that I don't need to file I 864 along with I 130 because my parents live outside of the US, as I was getting ready to print and send my I 130 forms for my parents, I read it somewhere that it needs to be completed. Is it a good idea to send it along with the I 130 form now?  I read that there are some changes made to the form which takes effect on Oct 15th, so I'm trying to figure out what is the best option here? Any feedback would be really appreciated.  Thanks!

Notarization isn't required. It's your choice to use a company or not. If you are able to translate it, then you can do it: https://www.uscis.gov/ilink/docView/AFM/HTML/AFM/0-0-0-1/0-0-0-2061/0-0-0-2253.html

"I certify that I am competent to translate from [Foreign language] to English and that the above Birth Certificate of [Person's name] is a complete and accurate translation to the best of my knowledge and belief."

Sign and date below the statement. Also put name and address.

Thanks @HRQX once again!  I agree, the only issue is I'm not 100% competent in my ability to read my native language because I didn't grow up there!  I did however find a company online called rush translate.  They seem to have pretty good reviews and reasonable cost ($24.99) for translation and certification in the format you mentioned, they will email me the translated document and certification - do you think that should be good?  I was planning on printing it myself or do you think the certifcation needs to have actual signatures in ink?  They do offer an option to mail but it cost extra and of course it'll take some time for it to arrive.  I'd love to hear your opinion on this? Thanks again in advance for all your help so far!

  6. In Part 4 ( ) question number 21 (provide info about beneficiary's current wife, if currently married)  - I went ahead and filled out spouse 1 with my mother's info in my father's petition and my father's name in my mother's I 130 petition - spouse 2 is not applicable, so I left that blank in both, however the very next set of questions (Information About beneficiary's Family, spouse and children) starting from 25 through 28 for person 1 - I'm not sure if I should put the Spouse here again in person 1 (dad's name in mom's petition and vice versa) or should I just start out with children in Person 1? I ask this because they had just asked about the spouse in question 21 and 22.  I know I'm probably overthinking it, either way should be fine but I just wanted to find out how you guys would do this? As of right now, I have myself in person one as the son and my sister in person 2 as their daughter? I can easily make myself person 2 and my sister person 3 and add the spouse in the person 1?

I'd appreciate your feedback  on this!

I agree with the link. Thus, it's optional. The old A number became the USCIS Registration Number on the naturalization certificate.

Awesome! Thanks for looking at the link.  I'll leave the A number field blank.

Also, @HRQX I posted another question, I was wondering if you know anything about that subject.  I need to get a document (birth certificate) translated into English for USCIS (i can't find the one I had)...do you know a USCIS approved service for this? It appears there are quite a few online and they will even email you the document. Any thoughts would be appreciated!  Thanks again!

  8. Hello Everyone - As I'm working on filling out the I 130 form for my parents, I discovered that the  translated certified copy that I had is missing. I can't seem to find it. I do have the original birth certificate, so I think it's just a matter of finding an approved translation company that would translate and notarize (not sure if that's needed?) the original?

Has anyone used any such services? A simple google search revealed quite a few of these so I thought I'd check to see if anyone has any experience?

    I'd appreciate your feedback! Thanks!

Leaving "Item Number" blank is fine. Or an alternative to using Part 9 is something like the following: https://t6d5m2p2.stackpathcdn.com/cpwp/wp-content/uploads/2015/11/I-130-Attachment-Sample.pdf

Thank you for the idea.  I do like it however I feel it's probably best to just fill out part 9 since they asked to attach additional pages only if you run out of space in part 9. But I think your point is, either way should be good or else you would have told me to stick with one over the other.

One more thing, while I was looking at your example, I noticed that the person had their A# filled out as well.  Throughout the form including in the beginning in part 2 (question 1 & 2 about A num and the USCIS acct num) - I've left those blanks because I read that if you're a US Citizen you don't need to provide A number even if you once had it prior to becoming citizen? Here's the link to the article! Do you agree with that?

Part 2 #11 you already answered "Yes."

Part 2 #12-13 put the address you were last year; they'll figure out from this section's "Date To" field how long you've been at your current address.

Part 2 #14-15 put the address prior to June 2018.

If there is an additional address in the last 5 years use Part 9.

You can send them all together. Each petition should be accompanied with its own set of photocopies of documents: https://www.visajourney.com/content/immigration-parents/

https://www.uscis.gov/forms-filing-tips "If you are sending more than one case in an envelope, clearly separate the cases by rubber band or fasteners."

Thank you so much once again! I thought I was staying up to get it done this evening :) I really appreciate your responses and the useful links you've provided. I think it's great that someone such as yourself with extensive knowledge on this subject is helping out folks who are new. Gotta give you props for that. Thank you!

I do have one more address so it'd probably go on that Part 9 like you eluded to, so I guess I'm putting down the page num (2), part num (2) but I'm uncertain about the item number because I can't put 16 (that's a separate item). What do you propose or should I leave that blank?

Also, attaching a screenshot for your reference in case I need to format the text, I guess just looking for your feedback on how it looks?

    Thanks

Select option A. The reason they is ask is for people who select C for fathers: https://www.visajourney.com/content/immigration-parents/ "My father. I was born out of wedlock and legitimated" and "My father. I was born out of wedlock and was not legitimated"

    Just a reminder that it's 2 I-130 petitions; 1 for each parent.

And yes, I did realize there were separate forms for each, thanks for the reminder though. I'm sending them at the same time in the same package I'm assuming?  Correct?

Hello guys - so as I'm filling out form I 130 to apply for my parents green card - I noticed in PART 2 (Address History section) - they have physical address 1 and Physical address 2, I left Physical address 1 blank as my mailing address is the same as the current physical address, and filled out the Physical address 2 (# 14 - 15) with the address we were in last year before the new house, however we were only at address two for 1 year, so I'm trying to figure out if I need to provide address 3 (prior to June 2018 ) because I read it somewhere that they ask for 5 years of previous address history.  I'm confused because if that was truly the case, they would have provided more options for address 3 and possibly 4.  Anyway, I guess my question is do I fill out part 9 for the third address?

    Thanks in advance!

  13. Thanks so much for the speedy response HRQX. That's what I thought (by process of elimination) but was really curious if the question would only be applicable if I was doing it for my child. Anyway, thanks and I will select A.

I do have one more quick question for you -  in PART 2 (Address History section) - they have physical address 1 and Physical address 2, I left Physical address 1 blank as my mailing address is the same as the current physical address, and filled out the Physical address 2 (# 14 - 15) with the address we were in last year before the new house, however we were only at address two for 1 year, so I'm trying to figure out if I need to provide address 3 (prior to June 2018 ) because I read it somewhere that they ask for 5 years of previous address history.  I'm confused because if that was truly the case, they would have provided more options for address 3 and possibly 4.  Anyway, I guess my question is do I fill out part 9 for the third address? Thanks again in advance!

  14. Hello guys - I'm a newbie to the forum.  I'm hoping you guys will be able to help me out with a few questions as I fill out the I 130 for my parents.

In Part 1. Relationship - of course I've checked the box in question number 1 to indicate it's for a parent.  However question # 2 is confusing me. Following is what's being asked in question  # 2:

If you are filing this petition for your child or parent, select the box that describes your relationship (Select only one box):

a)Child was born to parents who were married to each other at the time of the child's birth
      b) Stepchild/Stepparent
c)Child was born to parents who were not married to
each other at the time of the child's birth Child was adopted (not an Orphan or Hague
      d)Convention adoptee)

So I'll tell you they are my biological parents, so b is not applicable.  They were married when I was born, so C is also not applicable.  I wasn't adopted either, which left me with only a. Now I would gladly check option (a) except that it makes me think if this is only applicable to a US citizen filling out for their child (not parent).

So my question is can this be left blank in this situation?

What have you guys done? I'd really appreciate your feedback as I'm filling this out myself without an attorney's help.

    Regards,

    Samuel
