Update:
Good day everyone, my interview was scheduled for today, Sept 24th @ 11am. I had done my waiver letter as suggested and send along with a copy of my husband's death certificate. They did not change my appt.
I got to the Atlanta field office at 10am and waited until 10:30am to enter. It was noticeably empty, the waiting areas were not full. I checked in at the window with my interview notice and was sent upstairs to the 2nd floor with a number (S48). When I got to the 2nd floor again it was empty and I later realized that most of the persons waiting were actually waiting for the 12pm Oat Ceremony. I also noticed that numbers were skipped from time to time, again in my busy head I'm thinking IO must be prepping the files for interview,
I waited until 12:30pm before my number was called, (realizing later that they did send an update in my USCIS account that my 11am interview was cancelled then send a 2nd update shortly thereafter that my appt was scheduled for 12:35pm) While waiting I started to get emotional as the long wait caused me to start thinking about my husband that he would have been there with me. I went with the officer to her office, and I was sworn in before I sat. She immediately said, ‘we will be removing your conditions today’, I added that I had copies of the waiver letter but she said she had it pulled up on her computer and had read it already. I started to cry, her tough demeanor changed for a quick second and said, 'I understand, everything will be ok'. She asked for my ID and I gave her my expired GC and DL, while she clicked away on her keyboard, I used the time to gather my composure.
She explained to me that my I 751 condition was lifted and I would receive my GC within 3 weeks, also for my son, now 19yrs, who is attached to the K1 filing. (my son was waiting in the car) The Officer went on to say that due to the fact that I am no longer married I am not eligible for the N400 until 5 yrs (I am presently 4+ yrs since I received my conditional GC) she then asked if I still wanted to do the N400 interview even though I would be denied due to 3 vs 5 year filing. I thought about the 50min drive with traffic and said yes, I have nothing to lose. I really wanted to do the interview just to see the process and expectations. She began to ask me the questions, I only remember a few right now - The capital of my state and Who was the 1st President? I got the 1st 6 correct (real easy) she looked up at me, smiled and said you passed, I cringed within thinking to myself 'so what?' but I didn't show it on the exterior because she had been nice/tolerable so far. I did the English test and of course I passed. She began to ask me questions from the N400 application, like my full name, height, address, job etc. I made a change to the job section as I had just started a new job in August. She continued with the other questions then I signed to the changes, and she read the Oat of Allegiance, and I also signed to that.
She explained that I would receive a letter denying my N400 and the way forward. She gave me the standard Naturalization Interview results letter with the below boxes ticked:
· You passed the English test and the U.S. history and government test
· USCIS will send you a written decision about your application
· A decision cannot be made yet about your application
I knew the results of today based on all the literature I have read but I was really hoping for a miracle. I really believe that if your spouse dies after you have submitted your N400 (3yr rule) and is awaiting an appt date then the 3yr rule should be waiver as death is a natural occurrence, that’s my 2cents. That’s all I can remember for now. I wrote this so that my experience could help someone in the future as I realized from doing numerous search of my situation that it does not happen a lot (losing a spouse in the midst of the process) or person just don’t share their experience.
The bright side – I am expecting my 10 yr GC and I will apply again next year April 2026 with my son.
QQ – can I travel out of the country on my present extension while I wait for my new GC? She did give it back.
