Sarge, I don’t if it was my fiancé that posted this originally or not but the circumstances fit our situation perfectly. I was medically retired from active duty U.S. ARMY in 2013. My retired pay is considered military disability pay and is not taxable in either end but it is offset by my VA Pension, which is also considered military disability pay and is non taxable on both ends. I also receive Combat Related Special Compensation, which is also considered a disability income and is therefore tax free on both ends. I have not had to file federal or state income taxes since I retired (except for the year I retired because I had earned income for most of that year) other than that, not only do I not “have” to file taxes but if I even tried it would be an empty form. My fiancé and I have known each other for years and we live together and have lived together for years. We have joint bank accounts, own property together. You guys are spitting out a lot of very ill informed information on here, especially the whole “have you even met” stuff or the retired Air Force guy talking about taxes everyone knows that they’re only two branches of the military, the Army and the Navy because the Air Force is a corporation and the Marine Corp is a cult. But like I said, I don’t know if this was my fiancé’s post or not, I will ask, but these circumstances fit me exactly so I thought I would help inform you well meaning citizens where you are mistaken. We are on top of it, we have an immigration attorney and an account giving us advice.

Im not your fiance :) Thank you for clarifying this and we are not alone in this situation. It seems we are in the same boat we are still in our process of our K1 petition and waiting for our NOA2 and up until now we still havent get any answer what to present in case they will ask for tax papers and affidavit of support. Still trying to get answers.

I, the petioner, submitted w2 forms, 1099, & documents that show the amounts being deposited in my account each month.  Those of us who are on disability get the w2's & 1099's from IRS each January.  I also sent in a verification letter of my income from social security website.  So far nothing has been rejected & no RFE.  I hope this helps you a little bit.

    Best wishes.

    Thanks for the reply 😊

For the  form I 129F employment part did u leave it empty?

Hi.  It doesn't matter if he is getting Social Security Disability benefit.  As long as he can show that his income is sufficient.  He can show that by using his SSA-1099 tax document.  I am in the same situation.  I don't know if the the joint sponsor has to live in the same state, but the joinet sponsor is kind of financially responsible for 90 days, once he enters the US.

I got a question regarding this what supporting documents did u provide when u applied for k1?my fiance is 6 yrs medically retired (dissability).

What do put on the job part of thr application?

    We need help pls..

No, it started 6 years ago but it is still the same status. So you will still put it down.

however I don’t know if disability, is same as retirement?

What should we put in there?

    US ARMY (RETIRED)

    OR

    US ARMY (MEDICALLY RETIRED)

how about the address? And start date ?

You would list employment history, but there is nothing asked regarding income for the I-129F.    Income information is not until AFTER the I-129F petition is approved, the embassy will want Financial Support evidence.

I understand however on the form its says job for the last 5 yrs.

He has been retired for 6yrs.

    Should we leave it empty?

Are you just starting and filing the I-129F?  If yes, no financial information is needed for the petition process.

For the visa application process at the embassy -   He will need to print out a Benefits statement, plus include a letter stating why he is not paying taxes (... disability is not taxable )

Yes we are just starting and planning to submit next month until we complete our paper.

we are worries that the employment part will be empty..thats why he wanted to include that on the kit that we will submit.

Does this mean that income thing we need to provide when i have my case number? Or when they have accepted our application?

I hope that is not what he told you about paying taxes, because that would be a red flag for you from jump street. I'm retired Army too, although it would be nice not to have to pay taxes cause I was retired,  but that's hardly the case and TOTALLY false.

If he’s not being honest with you about his finances, one wonders what else he is not being honest about.

    Got it clarified with him

His not paying taxes bec his pay is disability pay not retirement.

We are still wondering what papers to provide on our application.

I hope someone can clarify with our confusion

Your recent posts suggest that you haven’t even met yet. He cannot file the I-129F until you have met.

Also, he is the one to complete and file the I-129F, not you. If he is retired and not working then he writes “retired” for current employment.

Unless his only income is SSI or he is below the federal filing threshold (which I doubt) then he is still required to file a tax return. However, the I-134 and tax returns are not needed until the I-129F has been approved and the case has been passed to the embassy. You are a long way from that if you still haven’t met yet.

Slow down. Meet first. Get to know him. Then he can think about filing.

We have met his here now 😊

    1. File the visa after you have met (if it is the first time you are going to meet.) as it is a requirement to have met at least once within two years of filing. And also be sure with each other that you would want to file for a K1

    2. Your Fiance cannot file the K1 in the Philippines unless he is there on a permanent residency through direct consular filing, it makes the most legal sense for him to file it from the United States. If not done through direct consular filing (which cannot be done if he doesn't 'reside' in the PH), you need to mail the packet to an american address which would obviously cost more in mailing fees from the PH compared to mailing it domestically in the US

    3. Once filing the packet and if you have stated that your current residence is in Singapore, the case will be routed to the USEM in Singapore for you to continue the rest of your case

    Good luck!

    Thank you very much 😊

  10. Hello,

What are the things we shoulf take note off.

    sorry all new to this
