I need help for my sister. Any advice on what to do are very welcome.
I have sister who came this year fiancé visa. Sad to know that they after they got married she found out that her husband cheating on her. They always argue coz of the 3rd party. She has 1 kid with her two weeks ago she found out that she’s pregnant. She wanted to go home coz her husband also never treat her like she’s a wife. He barely buy her like personal items and when my sister bought lotion it’s a big deal to her husband coz it worth of $5. We all know everything is expensive. I feel sorry for her. I send her lots of personal items also my niece.
her husband telling her he will get the child after she delivered the child and he never file the 2 years green card coz according to him she’s staying at home only . she don’t need a green card. He tried to scared my sister for telling her also if she go home he will never support the child. I was pissed and finally reach out my sister husband telling him he cannot traitening my sister coz I know laws here in the U.S . He never filled income tax for 2024 . Coz he will owe lots of money to the IRS . He is self employed and from last yr income he will pay about $30k and he keep telling he will never file taxes anymore . Which the W2 is the most important to file green card. Since my sister arrived this year of January she still not a permanent resident and I have a friend who also advised me if he never filed the green card at all my sister can seek like Catholic charities organization.
is anybody experienced like my sister ?
I seek immigration lawyer they only told me she can go if she want to go home or stay married and divorced later. But the problem he will never process the paperwork. And I couldn’t do anything for her coz she came here as a fiance visa.
any advice on what to do for my sister?
I appreciate to those who willingly give me advice.

DS-160 application form, ID photos, payment, valid passport. That's it.
The applicant may bring supporting documents to the visa interview, but not required. It's very rare for the consul officer to even look at additional documents brought to the interview.
None of those are required. It would help if the applicant has a stable, high-paying job in the Philippines, and good travel history to other visa countries. Still, none of those guarantee approval for a tourist visa.
She never been to the other country this is her first incase she apply. She have enough money in her bank account also . But I wasn't sure if this enough so she can visit me here in the u.s

Your sister will need to apply for a B2 visa herself. No need for an invitation letter from you. Instructions here -- https://www.ustraveldocs.com/ph/ph-niv-typeb1b2.asp
Note that the US embassy in Manila is currently not processing non-emergency first-time B visa applications. Your sister may apply anyway, but the earliest she can get an interview appointment would probably be mid-2022.
Thank you! It help a lot , I thought im the one who will do it. Do you know what requirements for applying tourist visa? She have assets in the Philippines, land and house is that enough? Or do she need more like more money in the bank?

Hi all!
I am writing in reference to this piece of news: https://www.cnet.com/personal-finance/sorry-not-everyone-will-qualify-for-the-second-stimulus-payment-even-if-they-got-the-first-one/
I am a foreigner who is legally married to a US citizen. We submitted the Adjustment of Status application in Sep 2020 and we are currently waiting for the next steps of the process.
Based on my current status, I would like to check whether I am eligible for the 2nd round of the stimulus check.
If so, do I need to submit Form W-7 for a ITIN (Individual Taxpayer Identification Number)?
Appreciate any feedback and advice on this.
Thanks!
I'm U.S citizen and I haven't received my first stimulus check 😅 and for sure not second stimulus either and im a tax paper.

I mean your information reported to USEM and or CFO will have zero impact on him doing another K1's Visa.
Well... before we came to the u.s we have ceminar and that was the cfo. Cfo is all about abused ,verbal imotional and physical, the woman may passed the interview but definately denied in cfo. When we process our divorce he was telling me that he want's me to pay all his expenses when he went to the Phil. From the lauggage his plane ticket ,hotel and when he bought a flowers when i was in the philippines. long story short he was saying too the he just get me to the poorest country . but now he will get another pinay to fool and be his slave's . He can do another K1 in Philippines. US pretty much don't care about Philippines laws on marriage.
He can't get married in Philippines, until he get an annulment, but I doubt he would go this route anyways.
I did reported him tho after he file the k1 i wrote the embassy as well. Coz my x was verbal znd imotional abused plus his not looking gor wife he was just looking for his slave and very controlling you couldn't even buy foods that you like even its your own money . Do you think they let him get another woman after i email the cfo and embassy?

So for the, sake of "papers" you endured abuse and chose to be a,"slave"? The word slavery is a strong word that shouldnt belittled. Africans went through a lot during the slave era .so be careful how you loosely use that word
I pray things turn out good for you

So you are already divorced? Then in that case, just to be on safer side take all documents / pictures etc that supports that your marriage was entered in good faith. Just to be on safer side. I am assuming you have all that information? Is that right? Please gather before your went ahead with your divorce filing.. How long have you been married for? When did you get your GC? Was your GC based on Marriage?
Were already devorce its been 7 months now since it finalize. And we been married more than 7 yrs .

I believe USCIS will look into your 5 year history for anything before granting citizenship. So since you don't owe anything to IRA you can mention safely that you don't owe and paid your taxes on time. Whether 5 yrs or 3 yrs naturalization, they can look how you got your GC? on what basis. This cannot be ruled out. So be prepared to show case that your marriage was in good faith but things did not work out afterwards. You need to have all that supporting documents that gives bonafied marriage evidence just in case during your interview. Why to take chances. Take all that tells that your marriage was good until last 7 months or so? as I don't know when and how you got your GC?
In a nutshell, you cannot write wrong information on your application and be truthful if asked about your marriage. 2 cents.
I have my photo copy of my devorce ,tax return as well . Green card hopefully that tge only thing they gonna ask . But i did submit all the req. Before so hopefully my interview goes smothly .

Nailed it.
As far as the IRS, as long as you don't owe any money, you are good. They don't care if you were audited. A lot of people get audited for various different reasons. If they ask, say yes and tell them everything, but I don't think they will care.
Thank you . They been audit us 2014 but everything we paid and we dont owe any to the Government.

You don't have to be a citizen to report an abuse.
Do you have kids with him?

I know it takes a while and i dont know if it will honnored if i reported him since we been devorce for about 7 months . Im just waiting till im done my citizen then . I will report him. Marriage /divorce relationship is not a consideration when you
are applying for naturalisation under the 5 year rule. If asked just state facts .. you were married. You divorced .
Thank you !

Are filing based off 3 or 5 year rule?
If divorced then you will likely be denied or told to withdraw or a considerate officer will adjust you to 5 year based app and none of all that will matter
Did you report the situation ?
Im here in the U.S almost 9 years. I did not report him coz im not a citizen yet and were devorce now for more than 7 months. Should i mention that to the consul or just forget and just told them were not get along to each other.

Hello everyone ! I have some question here. Iv been Deviece now for 7 months . My x his been verbal and emotional abused since i came here but i was trying to keep with him. I tell my story to all my friends here and most of them they want me to report him so he'll be blocklisk and wont be able to get another filipina and be his slaves. I have long story but maybe someday i can share my story. My question is I have upcoming interview for my citizenship if ever they ask me why we getvdivorce do i tell them that his been verbal / emotional abused or just we dontt get along ? I read some article before that they will ask you why you get divorce.
I have another question way back 2014 and 2015 the IRS audit us and everything is paid so we dont owe any to the Government should i mention it or just forget ? Theres one question saying taht if we owe anything in IRS so I put there NO since we did not owe anything. When i file my citizenship i used the 2016,2017 and 2018 taxes . I hope someone can give me advices here thank you and have a blessed day.
