  1. Correct me I'm wrong but I thought there was no fee for AP if you submitted your application for AOS after a certain date. Thats what I understood from the fees explanation on the www.uscis.gov website...

    There is no fee for AP (or EAD!) if you filed AOS after fee increase. That goes for filing at the same time or filing for AP and/or EAD after you receive NOA 1 for AOS.

    From the signature, bradcanuck filed for AOS in July before fee change so I guess AP fee applies.

    Im so confused, can someone explain?

    I'm kind of confused. I got here on my K1 Visa. After my fiance and I are getting married we file for AOS. We live in Delaware, does that mean we have to send all papers to Chicago?? I hope I understood it right?

    Do we have to send in a new bankletter with the forms or can we just use the one from the K1 process?

    I hope someone can help me...

  3. I had to physically stop my employer applying for a H-1B visa on my behalf - which would have made a mess of my visa application... "Oh, yes, it's a genuine relationship, I'm just covering all my bases!".

    Their immigration attorneys had ZERO clue about the K-1 visa (understandable /to a degree/, but still). It was on their advice that I went about things a lot of the way I did, but having remembered how much I had to show them - links to USCIS.gov that directly contradicted what they said, etc, etc, I put very little stock in it.

  4. My husband is an engineer, and we wondered the same. We have been waiting for AOS for 2 years and the EAD has been enough for the employers so far. Sure there are some opportunties lost (mostly due to requiring citizenship on his level), but its not that bad. The biggest obstacle I would think is the competition. Others have reported employers consider education in other countries as less, however, we have not had that experience.

    Wow Thank you. I pray my fiance has that same experience. I dont want him to be stressed and worried about finding a good job...

    Does anyone else have any helpful info and insight on this subject? Will he be limited as to what kind of job he cant get when he comes?

  5. Very common question:

    K-1 should apply for EAD WITH AOS, not before.

    K-1 holder should not bother with getting (a )(6 ) EAD card, that card expires 90 days after entry on the K-1, and can take up to 90 days to get. A Useless card, and a waste of $340

    EAD filed for with or after filing AOS is FREE, and results in a 1 year EAD, renewable for FREE if needed.

    (A )(6 ) is for Fiancee before filing for AOS, this is the "TEMP" 90 day EAD that expires with the I-94.

    A. K-1 Non immigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6). File your EAD application if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under (c )(9).

    I have read of MANY filers that got the (a )(6 ) EAD only to discover it expires when the I-94 expires, and others that had the I-765 petition rejected because they has an AOS pending, or the approval of the I-765 happened AFTER the I-94 expired.

    2. Immediately, before filing for AOS. As a K-1 visa holder you are technically eligible to file for an EAD immediately when you arrive. However, this EAD will expire when you K-1 expires (90 days) and because of this and the wait time (>90 days) it is a waist of both time and money to bother applying. You will file as category ©(6), "Nonimmigrant Fiance(e) of U.S. Citizen".

  7. If you only have an EAD you do not have Permanent Residency. If a job requires Permanent Residency and you only have an EAD the requirement is not satisfied. You can always apply for the job, though. Maybe their rules are not as strict as them appear.

    Thank you. I know that the EAD and Permanant residency arent the same. Im just wondering if its still possible to get a decent paying job while waiting for the Green card and permanant residency. Hes worried that all employers will ask for permanent residency and that they wont really like the whole employment authorization thing. I need further clarification on this PLEASE! Thank you guys!

  8. If someone has an EAD can they apply for jobs that require permanent residency? My fiance is concerned because his field is in Computer Information Systems and he wants to be able to get a good job as soon as possible. Hes worried that the EAD will not allow him to get a job in his field. Does he have to wait until he gets the green card to do that?

    Please anyone with answers, I would appreciate it so much.

  9. I was wondering the same thing. I just faxed over a extension request because the police record too 2 months. My fiance had his interview in June. Just got the police certificate last week and he got a letter telling him to have me immediately ask for an extension via fax. His visa was pretty much approved all we were waiting for was that police record. So now we wait. Hope they send his visa this week.
