Hello people who adjusted through marriage and had opt before!
In the first question on I 765 ( reason for applying )it says if you are asking for initial permission To accept employment , if I had OPT from my f1 before but then switched to a different visa afterwards (e2) should I check the first box or the third box? The first box is initial permission to accept employment and the third Box 1C is renewal of my permission to accept employment . Side note I have not had an EAD card for five years the last EAD card that was administered to me was when I was a student which was six years ago

For the I 485 and I 130 a form in the address history if I have a different address for physical address and mailing address where should I indicate the mailing address? And should the format be dates lived in that address and then listing the full address with the ZIP Code afterwards?

As for some reasons for the advice above...
- The I-693 issue was addressed via a quote from the instructions
- The reference to the 2D barcodes is via USCIS announcements, and subsequently looking at the PDF as you type it out (it's not a common barcode for most end users, but it is a standard one that you can scan yourself and verify it matches the typed contents of the paper). Logically, they don't hand-type the information when there's a barcode. Anecdotally, people have written in answers that were actually required fields (they mixed and matched electronic filing and handwritten answers) and got an RFE for something that was already answered in the hand written sections.
- The # photos is just counting from the instructions.

The I-864 is more complicated - it's a mix of the instructions and just experiences that many others have gone through. It's a tough subject as - other than required documents like the most recent year's tax return - everything else is a decision that the IO makes upon the totality of the circumstances. There are some general guidelines on what they normally like to see, but much of it varies from case to case too. No 2 I-864 cases are identical. USCIS has guidelines in the AFM and policy manual, and the FAM has similar (not identical!) guidelines for visa applicants.
- For somebody self-employed, current income is considered based on the most recent year's tax returns. Money earned within the year is revenue....until claimed on taxes, it's unknown what will be actual income.
- I have seen users post RFEs/RFIEs on the applicant's income not being considered on F-1 status. The notices state which statuses qualify and F-1 was not listed. At the same time, I have seen people with a valid OPT use that income successfully (despite technically still being F-1).
- Affidavits is just an experience thing + logic. USCIS does list them as one form of evidence, but the practicality of it is so minimal for the reasons stated previously.

So for people who just got married and are filing the AOS and I-130 forms , what photos should we send in and how should they be organized? We have photos of us dating from two years ago all the way up until our wedding photos taken from our iPhones so how should I organize this , how many should I put in and how should I write the date on each photo? Should I be gluing each printed out photo to a piece of paper and then writing a description on it?

I wanted to know how I can go about finding the right lawyer to help me check over my forms since I am adjusting from a work visa to a green card and I just got married . what questions should I ask them to make sure they know what they are doing? I feel like there are a lot of lawyers that do immigration out there but they each have their specialization.
Any tips in terms of how you were able to find your lawyer to help you with your case?

The envelope uscis in California sent me with the RFE request has a PO box address on it. I know fedex doesn't send to PO boxes so do you know which address we should send to for RFE work responses in Southern California? The uscis center is in Laguna Nigel. Thank you!

I read that people are needing to provide those now. Is that on the I130 or I485 form? I don't see that section if so or does this get asked at the AOS interview?

I had applied to extend my work status a few months ago, still hadn't heard back, now I'm filing for AOS bec of marriage. Is my AOS application going to be adjudicated by a different officer than my pending work application extension? Are they two different depts that work on green card applications vs work extension applications?

I 94 expired already but I filed for an extension on my existing status before the I94 expired. They still haven't make a decision on my nonimmigrant work status yet and I'll be filing my AOS before I get a decision so on the EAD application not sure what to write since my I94 already expired but my work status app is pending with USCIS.

What is the nonimmigrant status if we entered legally and waiting for the decision on our work extension status to come through? Decision on I129 still pending after getting married and preparing AOS papers.

Explain in the letter how you met, if online say when and then when in person.
Pictures together, travel together (itineraries, receipts) and the like. Chats (just samples over a period of time). Anything financial if you have it but not necessary for newlyweds.

Hi all,
We will file AOS, 130, 130A together shortly after we get married so we won't have too many finances as husband and wife comingled yet. However we ARE already living together. What are documents we can send in to show bonafide marriage other than all our dating and wedding photos ? We will have a big fat wedding bill to show too. Also we have dinner wiht his folks EVERY weekend, do we need to take photos at dinner? lol Or we spent all Saturday hanging out with his sister at a casino?

If you decide to send in ALL of your forms for AOS in together (I130, 130A, 485 and EAD/AP request form), will EAD only start processing after your 130/130A form has been approved and your biometrics come back with a go ahead? If not, what are all the things that need to happen/approved before the EAD will come back approved and you can receive it?

Ok so if the TN expires while your extension for the TN is pending does that mean you are out of status? If you file AOS at this time while the TN extension still pending does that mean you are back in status?
i know this sounds confusing but if worst case scenario an IMmigration officer stops you at a routine freeway check and asks for your status, what is the official thing to say? My TN is expired but an extension is pending AND I have an AOS pending too ?
