    In my opinion that sounds like a lot going on to not be working with an attorney. A lot of the hardship clause has to do with where you are from and if your spouse could easily move to that country and work or if they would struggle.

    I’m sorry that is so frustrating. It sounds to me like they maybe they are waiting on a supervisor to approve? 

     

    I had a senator reach out in June and the answer she got was that his case had been sent for additional review and there was no timeframe on how long that would take. They can’t follow up again for 90 days. 

     

    This has been the most difficult part being so far out of normal processing time and nothing happening. 

     

    I really hope you hear something soon!

    I'm assuming you already knew this, but I was just recapping for the thread (and correct me if any of the above is wrong...I am making assumptions based on the limited info).

     

    The new medical being requested was likely a procedural update due to the medical ban, not related to the 10 year ban ban due to unlawful presence. Now he is just waiting for the I-601 to be approved to waive that. Assuming no other issues, he should be on his way to getting the visa and being reunited.

    Yes, you are correct. The lawyer was not concerned about the letter. Initially we were hoping that the request for the medical exam was coming from USCIS but it appears the Consulate was acting on their own. Thank you for the kind words.

    They approved the expedite and the I-601 at the same time but I didn't know they approved the I-601- they just requested his passport sent to their Juarez location via DHL. My lawyer was also confused. We weren't sure what else we were supposed to plan for. It turned out they sent his visa/passport and packet back almost a month later. Then we were able to cross.

    My husband was found inadmissible based off the findings of his medical exam in Jan 2018. He was told to come back for a new medical exam (Juarez) in one year. We filed the I 601 (march 2018) and were told by our lawyer to not return to Juarez until waiver is approved. 

     

    We got a letter from the Consulate last month telling my husband to go back for medical exam. He goes and then a week later gets a letter to send passport to Consulate.

     

    A few days later, the Consulate sends a letter saying his visa was denied b/c he was here illegally in the US for more than 365 days....etc. I call USCIS and his waiver is still pending. Meanwhile, the Consulate still has his passport. We are beyond confused and the lawyer is too. We are beyond tired of getting our hopes up with something happening on his case only to be let down.

    Hi Ruthie, Any word yet on your waiver? We also applied in March 2018 and haven't heard anything

(Not violent either, but they sent back the RFE as a "violent and dangerous crime". Obviously they didn't look at the first packet our lawyer sent) Then April 1st, FAM at the US London Embassy tacked on an additional inadmissibility of misrepresentation. Playing dirty pool with our lives. Our lawyer submitted a rebuttal and additional evidence. Now we wait. It's bad all the way around.

    I’m sorry to hear that. Wishing you the best outcome. We last heard a couple weeks ago that my husband waiver was sent for additional review, no idea what this means and we haven’t received anything in the mail since they first got his waiver in March 2018. Trying to stay positive with the mindset we will be together in the end no matter what happens. Stay strong 🙏🏼

    I wonder why his *online* case status has not been updated at all throughout this whole process. It literally has said your case has been received for the past 15 months. If i switched employers, could that cause a hang up as I am his financial sponsor? I was under the impression that the consulate would be the ones to request new proof of income at his interview. Thanks.

    It simply means that an officer has been assigned to adjudicate your case (give a finale decision approval or rejection) but for the time being there's an additional review ongoing so the decision on your case has been suspended pending the outcome of the additional review. No timeframe can be provided as to when you may get an answer, so all I can say is hang in there and stay positive.

    Thank you for the kind words. Yes, i was able to understand that much as well. I guess in my original post I should have asked if any one else has gotten this response? I wish I could know how long the case has been under additional review.. Is this the same as Administrative Processing? 

  9. I had my Senator reach out to USCIS to get an update on my husband's I601. Here is part of the response that we received:  "was assigned to an adjudications officer at the Nebraska Service Center (NSC) and is currently in an additional review process. Adjudication of the application will be suspended until after the additional review is completed. While your office’s interest regarding this case has been conveyed to the Form I-601 Unit at the NSC, we are unable to provide details or predict a completion date for the additional review."

     

    Waiver received by USCIS on 3/16/18. 

     

    Lawyer isn't sure if this is good or bad. Any insight?

    How inspiring to hear that people are getting approved, but definitely discouraged to hear how long the consulates are taking to set up an interview.

    The NVC (Nebraska service center) received my husband's I601--waiver of inadmissibility on 3/16/18. I have literally checked the USCIS website everyday to check the processing times and we finally surpassed the normal processing time and we have heard nothing. Case inquiry came back on 5/14/19 to say it had still not been processed and to contact back in 60 days.

    My husband's medical exam and interview were in Jan of 2018 in CDJ, Mexico. He was referred for a pysch exam in his medical exam, even after passing the drug test. He was diagnosed as an alcoholic by the "psychologist" even though he has NO record in the US and I know everyone says this, is NOT an alcoholic. He was denied his greencard and was told to go back for another medical exam in a year and to apply for the i601.

    Lawyer filed the i601 and said to not even bother going for the medical exam until its approved. Meanwhile, husband has been going to AA every week and following the doctors recommendations to seek counseling.

    That is my story and and I truly hope this nightmare is over soon.

    Embassy send email to attorney stating that interview is scheduled for 14 may 2019 now i have only oneday. I  have not done medical,no fingerprint nothing.all of sudden consulate asign me a date for interview i am nervous now what to do

    How did everything go for you?? 🙏🏼
