In #10 of the I-134 "I have submitted visa petition(s) to the Bureau of Citizenship and Immigration Services (CIS)" should my fiance list my name and my 2 children's name or just my name? If their names have to be listed, the space wont be enough since there are only 2 lines. How are we suppose to fill out this item, can we put their names together on the 2nd line?

Did you submitted a signed tax return for her interview? I am already a widow so considered as single. I think to be safe, i will get one with my maiden name and also one with my married name.

2. NBI clearance - for those who have previous marriage and filed for K-1 visa, did you get an NBI clearance with your maiden name or does it has to be with married name?

Regarding ITR....I don't know the definitive answer, but I would say it should be signed.
As to your question about NBI clearance, I asked my Fiance and she recalls that she used her unmarried (maiden) name for the NBI clearance because that marriage was already annulled. Assuming that you have had an annulment of your previous marriage, your status is restored to single. (If you haven't gotten an annullment, you can't get a K-1 issued.) My Fiance went back to using her maiden name after that. I asked her if she had to list any other names used besides her maiden name, but she did not recall. I think I remember that she just used her maiden name and left it at that. She had no problems with the Embassy regarding her NBI clearance.

I just want to ask what normally the employer should put in the Letter of employment as requirement in the Affidavit of support. Is it the annual gross (basic) salary or should the employer include the overtime pay?

Whether you the 2 are included or not, he is still meets the minimum income requirement ($37,750).
In my honest opionion, i think he only needs to include only those he claimed as dependents in his Income Tax Returns. If his wifes declares all of them as dependents, then do not include them in the form. The form is only to show the government that he can provide for you and your family without relying on government welfare when you become a permanent resident until you become a citizen. The form is his oath to the government that he will be financially responsible for you and your dependents until you become US citizens.

We want to make sure that we are counting the correct number of household for us to determine if my fiance's income is above the 125% guideline. He has 3 children (15, 18, 19 years old) who are living with her ex-wife. He is providing financial support to his youngest son only. His wife claims them in her IRS.
How should my fiance count the number of household, should he just add his youngest son, plus me and my 2 children (k-2)?

I would think the technical answer is no - if the son is not claimed on his IRS Tax Returns, he would not claim him as within his household. That said, it may be a result of the divorce (which I don't know the answer to) that the ex-wife is allowed to claim the son on her taxes.
Is his income that close that one person changes things?
now see, I had read something that made me think he would claim the child as part of his house hold, due to child support , and maybe it was the "partially dependent" place on the affidavit of support. You would think the rules would be more clear on the paper work.
I would think so too - I guess I didn't finish my previous post.. I meant to add:
If the ex-wife's IRS Dependant claim is a result of a divorce agreement - then he might need to claim the son as part of his household. (The sharing of Dependant's for tax purposes isn't uncommon in divorces.) But as I said, he would know the answer to that...

What if his wife is claiming them ever since they were married, should he still count them in the number of household? If includes the 3 of them, then i would think that we are in a big dilemna since his annual income is just few hundred dollars above the household of 7
. I think he had $39,800 last year and the 125% income for household of 7 (him, his 3 children, me and my 2 kids) is $38,812. He has 401k, IRA and savings which can add up to this. Should we still consider getting a co-sponsor?
If we indeed need to get a co-sponsor, should his co-sponsor also count me and my 2 children plus the co-sponsor's dependent in counting the number of household?

Does US Manila embassy accept co-sponsor? I read somewhere that US embassy in Manila is very strict on this and sometimes doesnt accept this. Anyone who can confirm......

Ok...
I called USCIS this morning. They informed me that as of this morning I am approved with NOA2. They said the website will be updated today to show "Approval Notice Sent." I asked the woman if she was 100% sure and she said yes!
NOA2 today!

When you say hundred above the 125%, do you mean 225%. If it is, then i would include everyone just to feel safe.
However, your fiance's 2 older sons are considered of legal age already and may not be claimed as dependents. As you have said before, he's only supporting the youngest, then just declare the youngest plus you and your kids.
Lastly, in order for you to feel more comfortable, just include those dependents which he claimed in his Income tax returns. Those are your supporting documents for the affidavit, right?
What i meant with hundred is that his annual salary is just over hundred of the 125% PG ($38,862) for a household of 7 because he had annual salary of about $39000 plus last year. His wife was the one who claimed his 3 sons in her IRS but he still provide financial support to his youngest son.
BUt if he will only list his youngest son in the I-134 as partially dependent on him, that counts 5 household only. therefore we should be fine , right ? since 125%PG for 5 people is only $30,162.
Is this right?

I am guessing that your fiance is sponsoring you. The purpose of I-134 is to make sure that you wont be a burden to the government and that your sponsor can financially support you. I think that he should include his youngest in the form since is still partially dependent.
Remember, you must show that your household income is equal to or higher than 125 percent of the U.S. poverty level for your household size.

But if you're saying that he should include his youngest son only, then I think we should not worry since this will count only 5 household instead of 7 (him, his youngest son, me and my 2 kids). But i just want to make sure that it will not cause any problem if he will not add his 2 sons (18and 19 years old) because he plans to get a co sponsor if we are counting 7 household. Need a bit more advice on this........ our interview will probably 2 months from now and he is starting to gather the documents needed for the interview.

the 125% poverty guideline for a household of 7 is $31,090 and my fiance last year's annual income is around $39,000. Do you think that's good enough since its over the 125% guideline?

Hi everyone,
we just got the approval on our K1 application last week and we are in the process of preparing the documents needed for the interview.
Do i need to bring the original or photocopy of NOA2 to the interview?
My fiance total number of household is 7 (including him, me and my 2 kids plus his 3 kids). His annual income last year is just over $5000 (in the poverty guideline)? He has IRA and 401 which he will add into the affidavit of support. Do you think that is siffucient?
Lastly, he is a Filipino and naturalized US citizen. He plans to come to the Philippines to be with us at the interview. Will he be allowed to come with us inside the embassy for the interview?
Any help or tip will be appreciated.

That is the latest I-134 form. If that is on the USCIS site now, that is the latest. To keep your mind at ease, the govt agencies are accepting even 3 older versions of the I-134.
"Versions 12/04/06, 7/14/06 and 6/17/06 are also acceptable"

Hi everyone,
Do you know where can i get the latest I-134 form? the one posted in this website has an expiration date of 04-30-07.
I have 2 children, and they are listed in the petition (which is already approved by the way). Do we need to submit 1 affidavit of support only for the 3 for us and include all our names in question # 10 of the I-134 form or is it 1 form for each of us?
How about on question #11, is the answer supposed to be N/A?

Finally got our NOA2. I was teary eyed when I saw the email from CRIS. I didnt expect to receive it this week as we thought it will be out by June. Indeed GOD IS GOOD. He finally answered our prayers.

I'm just curious, when i checked my timeline the expected adjudication on my I-129F is constantly changing. Last time, the date it says that my 1-129F may be adjudicated as early as May 23. After a week, the date indicated changed to Jun 11. I checked again today, it changed to Jun 6. This looks positive since it was a pull in from the previous date. Is the change on the adjudication date normal and who change the date in the timeline, is it automatic? Does this change happens in your timeline as well?

Congrats to all march filers at vsc who got NOA2 already. I'm depressed because until now we still not getting the approval. We received RFE and sent back our response on the 19th of April and had couple of touches after that. But no word from USCIS on our application. Hope to get ours soon.
