  1. Hi,

    I need advice regarding working and traveling prior getting the work permit. I got a temporary work permit stamp at JFK airport but unfortunately it will expire on December 16. My problem is, I am scheduled for two job interviews next week. The company that I am applying for is an international organization and I believe they need to fill in the vacancy as soon as possible. Looking at my timeline, I dont think that I will get the EAD or AP by this month. I was advised by a friend who worked in that organization that once I got hired, I can apply for G4 visa so that I can work. G4 visa is given to representatives of an international organization (can only be applied in Canada), which means I have to travel out of the country.

    Does anyone know if the following are possible?

    1. apply G4 visa even I have a K1 visa. Will it have any effect on my AOS application?

    2. If I need to go to Canada to apply for G4 visa, can I leave the country without AP (since its still being processed) and enter the country using G4 visa.

    3. If AP is needed for me to travel to Canada and to go back to US, can I request to have my Advance Parole expedited?

    I am also thinking of re-using the supporting documents we submitted in our I-134 before, but what I have are photocopies of letter of employment and letter from the bank. Are photocopies okay ?

    Yes you can, we did, just updated the pay stubs to ones closer to AOS filing.

    We used I-864EZ, and attached copies of IRS returns for past 3 years, IRS transcripts, letter from employer, and copies of recent pay-stubs.

    If you are still needing to use a joint sponsor, then use I-864, and joint sponsor also uses I-864.

    Keep in ming I-864 requires IRS returns.

  3. Hi,

    I am filling out the EAD, AP and AOS documents for my kids (K-2). There are portions in the form where it ask for their "A" or File number. I basically have an A number which is indicated in my I-129F NOA and also on my I-94. On their case, the immigration at the POE just put "P/A, and my name on it on their I-94, so i am wondering if I put that one or just put the word "NONE"?

    Lastly, how many passport size photos should be submitted? I saw in the step by step guide in filing AOS, that 2 photos are required so I plan to submit 2.

    Need your advice.

    I went to SS office to get them SSN but the officer told me that they should have EAD first before they can issue them SSN. So I am assuming that even they are minor, I still need to file EAD for them. Am I correct?

    The advance parole are included if you submit them together with the I-485 package.

    There is no fee for AP or EAD even if you submit them after the I-485 package.

    You don't have to have SSNs for your children. You can file W-7s to get them ITIN for taxes until they have SSNs. If you want to get them EADs, you will need to complete the applications. You will pay $600 each for them regardless of whether you include AP and EAD forms.

    I have an 11 and 10 year old daughters and we are getting ready to submit our documents for the AOS/EAD/AP. We entered US on a K-1 and K-2 visas. Before I file it, I just want to make sure that I file with the correct fee. Based from the USCIS new fee schedule, the fee for kids under 14 years old if filing with the I-485 application of at least one parent is $600. Is that the total fee I have to pay for each of my child or do I have to include fee for Advance Parole?

    Need your advice on this.

    I need help. The name I am using in my passport is my married name (from my previous marriage). I entered on a K-1 visa and got married last Sat (Oct 20). I already got the certified copy of my marriage certificate yesterday, the name on the certificate was my Maiden name, meaning the name when I was still single. Since my name in the passport and name on marriage certificate doesn't match, will it affect my AOS application? I plan to submit all paperworks for AOS sometime next week and I need advice on how to go about this.

    We had our K1/K2 visa approved and we will be leaving for US next week. My daugthers just had their 2nd dose of Polio vaccine today. They still need to have the 3rd dose but it can only be done 6-12 months after the 2nd dose. Does this mean that we have to wait for 6 months for them to have the polio vaccine and can only file AOS after that?

    Any help or input will be appreciated.

    A friend of mine tried to get a copy of her annulment paper from the court (because she never received the copy) but she was advised to pay P15,000.

    - Is it true that to get a copy of Certificate of Finality from the court, the requestor has to pay P15,000? Her fiance will be filing K-1 visa application soon and she needs this document.

    - to get an annotated copy of her Marriage certificate (from previous marriage), will NSO accept photocopy of the Annulment decree, photocopy of Finality and photocopy of Certificate of registration.

    - Where can she get the Certificate of registration?

    - How long does it take for NSO to release the annotated MC?

    What if the US citizen who is a Filipino has a previous marriage in the Philippines which was annuled but doesnt have a copy of the annulment paper. Reason is because the wife was the one who filed for annulment and he doesnt know where to contact the previous wife.

    Does anyone know where to get copy of the annulment paper and will US Embassy make an investigation if he has previous marriage considering that he is a Filipino but was naturalized US citizen since 1980s? What if the copy of annulment paper cannot be presented?

  12. Mae had her interview on the 18th but she didn't receive her CENOMAR in time, so we knew she most likely wouldn't get the visa immediately. However, she did pass the interview (!) and needs to return with the CENOMAR to continue processing the visa (technically, I assume this is AR? She said something about a blue flag?).

    JeffK: USEM CO are not consistent with what they asks from their applicants and it is always best to have all the possible documents at hand for the interview. CENOMAR is required (as listed in the appointment packet) for Immigrant Visa Applicants but even if the applicant have this for the interview, they still do their own NSO checks which takes about 10 working days to process with NSO (according to Lorraine). Don't worry too much, the good thing is that you paid for DELBROS (always a good sign). You just need to wait until they received a copy of the CENOMAR from NSO, then CO will review the case again, and then the visa will be delivered to you in due time. You just have to follow-up it with them, call once a week just to check the status.

    My wife just got back from her interview and was told by the consul if she had prior marriages and said she will check nso. She did not have a CENOMAR- is that required for a cr-1 visa?They gave her a paper saying, "if there are documents (affv of sup, passport, a long list, etc. ) if checked, they will send you a letter to come back & "wait till you hear from us" the problem is there was nothing checked. They also said notify her if there are needed documents if not the visa will be sent.So whats the deal? :huh:

    crambajoy: The appointment packet for Immigrant Visa (CR/IR) states there on number 6 is CENOMAR. That all documents listed (including the CENOMAR) have to be ready to submit at the time of the interview. Although they don't usually asks for CENOMAR during the interview, since they do their own NSO checks, it is always better to have all the necessary documents at hand to avoid these things-> going back there to submit more documents.

    For those who will still have their interview, this could help you in some ways:

    CENOMAR for single: NSO will give the CRS Form No. 4 - which will state that the applicant does not appear in their National Indices of Marriages based on the records of 1945-2007 marriages enrolled in their database as of ______.

    CENOMAR for married or previously married: NSO will give the CRS Form No. 5 (Advisory on Marriages) - which will state the date and place of marriage and the name of the bride and groom. All marriages whether annulled/spouse died will still appear on the records. For those with annulled cases, applicant should bring a copy of the MC with annotation of annulment and the court's order. For those who are widow/er, bring a copy (NSO) of the death certificate.

    Please enlighten me on this. For those who are widow/er, do they still need to get CENOMAR or just bring a copy of the death certificate?

    They may want to see it signed, 2006 is the critical one though.
