    Make sure what you write in “my current income” doesn’t exceed what you proved with your payroll document. 


    Check your Part 5

    #1. It auto fills 1 for the immigrant, your spouse. 
    #2. Yourself. 1

    #3. Blank because your spouse is counted in #1.

    #4 or #5 is 1 for the other person you support and claim on your tax return.

     

    So with having to file our tax return paper this year, I don't think I'm going to have my tax return back in time to be able to send it on the RFE

     

    So now at this point, do you think they will accept just my W-2, letter of employment, bank statements and pay stubs as proof of current income? Keeping in mind 2020 was a little under. Should I not send any tax returns at all this go around since I'm sending the one W-2? 

     

    For my total income, do I go based on what is on my W-2 for last year, or what it will be this year based on the letter from my employer? I made a little over 38,000 for a family of three last year but will make 42,000 this year. I'm praying that's enough for them. 

     

    It's so frustrating because I sent everything that showed my current income and I filled out everything correctly on the form, I claimed 3 for my household size which is my spouse, myself and my son.  Maybe I sent too many documents? I sent three years of tax returns plus the W-2's. Maybe if I make it more simple they will approve it? The ONLY thing I can think of that might not have been wrong is I put 42,000 as my current income, instead of what I had made to date when we sent in the form that would have caused them to kick it back. 

     

    They didn't state that we had done anything wrong, just that my income wasn't sufficient and for 2020 it wasn't, so I get that part, but current is well over the threshold.

    That's weird. Tell your HR that you need it for immigration, and they don't take fax. They should be able to draft a letter stating: how much you make a year, and prospects for advancement at the least.

     

    That can be confusing. Print a form and fill it out by hand or use the typewriter mode on Foxit Reader.

     

    Did you download the transcripts from the IRS? That's way less paper and really simple to do.

    It's just a printout from KRONOS showing my salary. 

    I downloaded the transcripts from IRS- but printed them out to send them. 

    I'm trying to contact my employer again to ask them for the letter. 

    I'm going to wait until I file the tax return for this year to resubmit the RFE, that's the only thing I know to do.. 

  3. Okay, so we got an RFE for the I-864. My income last year was slightly under the threshold, but this year will be well over. I submitted paystubs for the entire year, I submitted a document that shows I get 42,000 salary. What else do I need to do to get them to realize I make enough? 

     

    The only thing I couldn't submit was a letter from my employer because they only verify things via Fax. The only other thing i can think of is I had to cross out things on the household number because it auto fills, but I wrote in 3 for our household size. What am I doing wrong?

    What else are they wanting? I literally have no one to be a sponsor, I make more money than everyone else. The only other thing I know to do is add my mom as a household member and put her income on it, which is only about 14,000 but I don't know if that's going to make things worse. 

     

    Please help... pretty scared right now. 

     

  4. Hi Friends, okay so as I am brand new to being married, how does it work when you're filing your taxes the first year? We've been married since October so will we file Married filing Jointly or will I file as head of household ? Do we include his income that he made in the UK before coming here ? A little lost and afraid a tax preparer might not know. 

  5. 2020 was a difficult year (for all of us.) I was just very slightly under the income limit. My current salary is well over the threshold by about 15,000. My previous to 2020 tax returns are over the income. Should we be okay ? I'd have to search for a joint sponsor... And I don't know if I could find one tbh. 

     

    Also, do you include the biometrics fee with the adjustment of status fee ?

  7. Good morning family, we're starting to prepare for AOS. I'm the petitioner, my fiance will be on my insurance at work. My son is currently on Soonercare (similar to Medicaid) that I pay a share of cost for, I make well over the financial requirements for Affidavit of Support, but he still qualifies for the SOC program, will this reflect poorly on us with the AOS if I keep him on this? (Please don't be mean to me, I pay my taxes and this is the only thing I get help with from the government)  Thank you.

    It's just hard to get a letter from them, but I went back and found my original offer letter, and just wrote on there that I make two dollars more than when I started out in November and I'll have my paystubs to add to this. Sorry for all the confusion, we're just trying to make sure all our I's are dotted and T's are crossed so there are no more delays and disappointment. Thank you so much again.

    Under Part 3 Question 8b, it asks "I have mortgages or other debts amounting to"... Is this looking for things like student loans and credit card debt? Is it monthly bills? I'm not sure what it's really looking for. Please help. (I don't have any mortgage debt, but I have a small student loan and some medical bills I'm paying off.) Thank you.

    Can’t you provide year to date pay stubs? 

    I'm sorry for being confusing. I absolutely have pay stubs, just not the letter of employment that I can present.   I made over the 100% last year, just not the 125% due to a change in jobs (due to covid) so my salary for 2020 was a little less.

    Yeah, he's aware. We'll be okay, we live in a low cost of living state and I try to keep our expenses low, I just had a rough year last year.

  13. Hi everyone, is the I-134 requirements still 100% or has it gone up to 125%? I know I-864 is 125%. My income was a little lower last year, it's back up this year with all the overtime I work, but I don't have a way to prove it besides paystubs..my employer only verifies employment through fax and my salary goes into a prepaid account.  I was slightly under the 125% last year (Covid related) If I add my entire household income (my mom lives with me) then we are fine, but I can't add her income to the I-134, I can only add it to the I-864...just trying to get some clarification, thank you.

    You make some very valid points. With the UK, once the K1s, tourist, work visas open with a year backlog, it’s likely to take a long time. Then with the K1, the additional already long wait for adjusting status or even getting work and travel authorization. A marriage visa recipient hits the ground running as soon as they enter the US...get a greencard, can work, get a driver license. I think some K1s may not realize the extra three applications and wait time before they can get to that point. Not sure what it is now, but approaching another year??

    I think it's because it used to be advertised that the K-1 was faster to get them home.

I was hoping the K1 would be allowed after the travel ban was lifted, but this makes it seem as though the K1 is included in the list of visas not being issued until Dec 31 due to the Presidential Proclamation ... 

     

    Not sure what to do next. My interview was scheduled March 18, wedding set for September 26th. Sadly it isn't looking good from this response. We can only hope that they amend the EO, that I believe they review every 2 weeks (I think I saw this somewhere, may be wrong), to allow the K1 visa to become exempt from the EO.

He tried to reschedule but gets a message stating that there are not appointments available at the London embassy. Any advice you might have would be greatly appreciated!

    He was able to book it a couple of weeks ago and so far it hasn't been canceled, he just kept checking the website.

I spoke to my brother yesterday on his birthday. Today mum called and told me he woke with a high fever and is very ill. Overnight! BUT his son went off to work at Tesco. The spread scares me a lot.
