  1. Lona is absolutely right. I m not spam otherwise I wouldn't have posted here under my own ID. My only concern is what are the steps after if She gets denied while she is out of USA?Will they atleast let her enter USA and file for MTR or appeal before the Immigration Judge???or they have right to just not let her in and send her back??Is there any way we can find that out now???

    I have to cut this long story short. My girlfriend filed her I-751 to remove conditions based on divorce waiver (after divorce with her X)and subsequently she got interviewed. Immigration officer at the interview said that he will let her know later if the petition is approved or not. She has been waiting for last 3 months and nothing yet. Now we have our wedding coming up and for that she needs to travel to our home country..and it is very important and we cannot delay this. She has a stamp in her passport though. Can she travel safely for 2-3 weeks? or at POE officer will creat a problem to let her back in USA? I need a very sincere advice on this one. Thank you in advance.

    My sister has files for waiver on the basis of cruelty and we are waiting for the results. We mailed the application on 25th of June, 2009. She is very nervous about the outcome. Her husband turned out a jerk and kick her out of the house just 4 months before the 2 yr deadline for removing conditions. She also has to wait for an year before she can file for divorce. So it is going to be tricky if her case is denied and she is not divorced. Can you please share your attorney information?

    I-751 waiver approved on 15th of this month. Some of you already know me because I am a silent and active observer of this forum. To cut the long story short, I arrived here in 2006 after marying USC. Received 2 yr conditional GC ending in middle of 2008. After 6 months since I arrived in USA my marriage was about to collapse. Eventually we had to separate. Separated in the middle of 2007. In my state there is a 1 year separation requirement to file for the divorce and unfortunately my CGC expiration date was before even I complete 1 year separation. Hired an attorney. Filed for removal of conditions based on "removal of me from USA will result in extreme hardship to me". Got 1 year of extension and in the meantime Filed for the divorce and got divorced in the end of 2008. Withdrew previous petition and refiled based on good faith marriage with final divorce decree in the end of Jan,2009. (evidence- no joint tax returns, no joint bank accounts, no joint lease because the house was my x-wife's brothers name, I had-pictures, joint health insurance, copy of e-mails, MANY affidavits from her relatives,statement by one counselor). I have received interview invitation 2 weeks ago. Went with my attorney and a lady called me in. She asked my current address and biographic(basic) info about me and my x-wife. Briefly asked the reason for the divorce and approved my petition because of genuine nature of marriage.

    So please guys, don't be scarred too much if you divorce. If your marriage was real then you will get your GC for sure, sooneer or later. Remember, prayers always helps.

    to Khushi81-my significant timelines are there in my post(without actualy dates only). Also it depends how busy your local office is in terms of scheduling interviews.

    to Family Man- try to get divorced ASAP. Work hard on it because it is worth. I know your sister filed based on cruelty, but it is not that easy to get approval based on that unless you have extremely strong evidence. Since (I assume) you will buy some extra time by filing based on cruelty(I mean 1 yr extension), get divorced or atleast file for it and then withdraw your previous petition and file based on good-faith marriage with divorce decree or nowadays you can file it even without that and later on USCIS will send you an RFE and ask for divorce decree. So according to me, you have plenty of time getting divorced. My divorce was in NC state and attorney also lives there. Let me know if you are from NC then I can give you his contact info that might help your sister. wish you good luck.

  5. I have received my biometric appointment(actually my lawyer received it today) in FL.

    I had to move to PA after filing my I-751 due to temporary internship

    I did not change the address with USCIS because it is better for me and my lawyer to have my interview done in FL(I filed waiver so guaranteed interview)

    Questions:

    -can I go to have my biometrics done in PA local office?(because there is no way for me to travel this month.

    -Since I have only 1 day off from my internship this whole month(09/12/09,Sat) my attorney will not be able to mail me original notice for biometrics appointment. He e-mailed and attached my a scanned copy of it, can a copy work for biometrics?

    I have received a biometric notice 2 days ago(actually my attorney received it) in FL. All my family lives there and in the mean time I moved to PA for temporary internship and I did not change my address with USCIS because my attorney is in FL also. So it is better for me to have my interview done in FL.

    Now I have my biometric appointment in FL and my attorney e-mailed me a scanned copy.

    Right now I am not in condition to travel to FL to have my biometrics there. I am doing my internship in PA.

    Questions:

    -can I still go to Local(PA) office for my biometrics?

    -I cannot get a day off from my internship this whole month unfortunately but I have only one day(Saturday,09/12/09)off so can I use a copy of the original notice for biometrics or I have to have the original?

    Yes, she asked me to tell her of how the marriage was going and why we divorced. She even asked me questions from when we were dating.

    You're rigt, God knows what's best for me. I'm asking for opinions only because I am not sure what to make of the interview. I realize that I was married for a very short time, so I understand if she has concerns and asked questions but then I am not sure what it means when they say that they have not made a decision yet. From what I've read, they make decision right after the interview.

    First of all I thank you so much for posting your interview experience here because VERY few people updated their waiver based interview experiences so far. And this is really helpful to many of waiver filers like us. What type of waiver did you file? good faith marriage? As long as you don't have crime records and provided sufficient evidence and that is well supported by your interview then I think you should be fine. Waiting for USCIS reply became like a part of our lives here. First you wait for interview and then for decision..but you are now only 1 step away.I wish you good luck.Keep us updated.

    I filed my I-751(based on extreme cruelty and hardship because I was not divorced at the time of filing in April 08...then I got divorced in December,08 and I withdrew the previous petition and then Filed for the new one with Divorce and good faith marriage in the last week of January,09 to VSC. We all have to wait which is not fair. Please include what type of waiver you filed.Thanks and God bless us all.

I had to refile my I-751 because initially I was not divorced and now I got a divorce decree while my previous petition was in process and then I withdrew previous petition and filed my new petition with the divorce decree 1 month ago. My question is- Should I expect to receive my another biometrics appointment letter(last bio was in the last week of May)?or they will now just adjudicate my case without having me done my 2nd bio???

  10. The petition you have that is pending is one that would be decided on the merits of whether removal from the USA would cause you extreme hardship. Remember, that this petition does not require a divorce decree, nor does it require that you demonstrate that your marriage was bonfide. If you feel you have a good case, then you wouldn't have to file another petition, but beware that if the Service does not believe that the evidence you provided to show tha you would be subject to extreme hardship if removed is sufficient, then that petition would be denied. I believe that iff your chances of approval are better by showing that the marriage was entered in good faith (bonafide) then I would replace the current petition with an I-751 waiver, indicating the bonafides of your marriage. If you cannot afford the filing fees, is there no one that you could borrow the money from? If not, have you looked into the fee waiver possibility with USCIS?

At that time my divorce was pending and I had no other grounds to choose from..(state required 1 year separation).I have filed my I-751 for removal of conditions with the help of my lawyer..I also got 1 year extension letter and done with my biometrics as well...but now my divorce is finalized and my I-751 case is still pending.My lawyer wants to charge me again for filing a supplemental petition (I-751 with the divorce and good faith marriage waiver) which I cannot afford right now.My questions is-are there any other ways to let USCIS know that I am divorced now and send them a copy of it if necessary or I have to file an I-751 again???can I contact the USCIS directly even if I have signed a contract with my lawyer??any help would be greatly appreciated...thank you all in advance and wish you all happy holidays!!

    now my next question is-If I file another petition based on Divorce and good faith marriage then..will my processing time change according to new petition or it will stay the same?And also once I have signed the contract with my atorney..can I file the supplemental petition by myself?will it break my contract?asking because he said he will accompany me on the interview day one time...thank you in advance...and you have a blessed day.

Thank you so much for your contributions.I have filed to remove the conditions 1.5 months ago and also got NOA1 for biometrics.My question is-will USCIS grant 1 year extension while my petition in process?I am asking that because I never received an extension letter as most of the people do. :unsure: .I will be divorced(most likely)in the October,08 or so.What are the chances of the interview before that(I filled with TSC)?(because if thats the case then I will be in the removal proceedings unfortunately),so confused.Anyway..I really appreciate all your help.May God bless you guys. :star:

  14. If you give details of what extreme hardship you claimed you will probably get comments on what others feel the success rate for that kind of petition is. Hardship waviers have a low rate of approval.

    There was one terrible case where the USC miscarried and that was not considered a hardship.

    In general they are not approved.

    now sorry about not giving the details.But what if state requires 1 year separation and meantime the 2yr GC expires..??? :unsure: you cannot file any type of waiver because you don't meet the criteria for anything :blush: .so I filed that with Extreme Hardship Waiver(had no choice,because cannot file good faith marriage due to state law is can't file for divorce until 1 year separation is over)...have you ever heard of this type of situation?if so please help me out with this.thanks in advance.
