    Yes call USCIS right away and also send inquiries.

     

    They been making mistakes like that. USICS sent me the I-797 NOC for the I-130 application.  The NOA states that the "beneficiary is in the United States and wishes to adjust status" which in incorrect.  My husband lives in Mexico and the application (filled out by our attorney) was done correctly.  USCIS made that error in March 2020 and I'm still getting to get it fixed.  Since they said my husband is in the US they didn't transfer the file to NVC, so the file has been sitting somewhere for more than 6 months.  Im soo frustrated.

We filed in 8/16/2018 the file was received at the Potomac office then in February 2019 I was transferred to nbc.. then had a RFE in Nov 2019 and Finally approved March 10, 2020.  It going to be almost 2 years and USCIS have not transferred our case to nvc.  It’s very stressful that they don’t do anything even though I have been calling them to tell them abt their error and always telling me tht I have to wait 30, 60, 90 days to be able to follow up with them.

    I think what you gotta do is when you call give them dates of your inquires.  My understanding is that when you send 3 then you are allow to talked to a 2 tier person (which i think is a person that can get/has more information on your case; for me she was able to send a message to the officer that had our case asking for the status, I was told that the officer had the case since March 2018)  About 4 weeks later or so that when finally I received the interview letter.  Don't give up.  I know if gets annoying and frustrating but if you guys don't keep bugging USCIS no one else will.

    our case a a little similar.  We filed the I-130 on 08-16-18 went to the Potomac Office.. 6 months past by (Feb 2019) we got a letter saying our file is was being transferred to National Benefits Center, then in Oct 2019 I got a letter sating that I got an interview at my local office the following month (Nov 2019).  Keep in mind, during all this time i was sending inquries by emails at the USCIS, calling the USCIS (talked to a 1 tier and 2 tier person), emailed my state governor; they made phone calls on my behalf.  Which I think helped a little.  We have an attorney and said that we only needed to wait.  We felt hopeless.

     

    Well after I have the interview in Nov 2019 which was for an RFE, the officer sent a letter about 1 or 2 weeks later wanting additional information which some of the stuff that he requested was given to him at the time of the interview.  Our attorneys office submitted the additional information by mid Jan 2020; and finally in March 2020 we got a letter approving the I-130.  Now we are waiting for the instruction letter from NVC.

     

    I say keep bugging the USCIS, you have to send 3 inquiries (each one has to be 30 days apart from each other if you have gotten an answer to your application) to then be able to speak to a 2 tier person.  

     

    What I've heard is that USCIS are low staffed because of the virus BUT the staff that is working only dedicating their time in reviewing the files still moving them forward since they are not having any interviews.  The USCIS sounds like they arent gng to open until 06/04/2020 so maybe is not until then you might get a response.

  5. Can you give us more details.

     

    When we filed the I-130 application we got a notice that it was received.  6 months later it was transferred to a different office, then 8 months later we got a letter that it was under review and that I was going to have an interview at my local office.

     

    Our I-130 finally got approved on 03/2020.  Still waiting on the NVC letter with our case #.

     

    I hope this answers some of your concerns.

    It also seems they decided to do a petitioners interview which is odd. Typically they only do that in cases where there is a criminal history or some other serious issue. Perhaps it was because you sent a minimal packet? I really do not know. It also seems you had some relationship overlap so that could have been part of the reason they decided to interview you as well... Did you do biometrics? 

     

    At this point you need to respond to the RFE asap. The sooner they get it the sooner it will be resolved. You should also be aware that Mexico has a backlog for interviews as well so you can expect a long wait for your husband to be scheduled for one. Check out the regional forums to get an idea of how long people are waiting there- but it is a long wait. (sorry)

    It's appears it's because they just want to make sure that my marriage is "real".  I have not done biometrics.

     

    I'm scheduled to meet with my attorney next week to discuss further and if we need to gather the information that was said in the interview and not in the letter. 

     

    I was hoping my husband would be with me in the US by next year; but it appears I'm looking at 2021 =(..

    Got our RFE letter...  The leter doesnt mentioned anything about what the officer told me at the interview.  The letter is requesting information that I gave to the officer the day of my interview (SMH) minus the affidavits letter which family and friends are already working on.  Says that I have until 02/2020 to respond.  

     

    I'm here thinking.  Are they not going to look the evidence any faster if the 02/2020 has not expired?

     

  8. Sounds like we are getting an RFE letter soon requesting additional information.  Some of the documents they are wanting are:

     

    1. Proof that I was separated 05/2016

    2. Copies of our FB messages from 04/2018

    3. Certified letter indicating that my current husband was never married, or, if he was married that he is legally divorced

     

    I want to mention that the interview was not that bad and I hope that we get the RFE letter soon so that the files keep moving forward.

Still no NOA2 but.... I received a letter yesterday (dated 10/31/19) from USCIS (local office) letting me know that I (Petitioner) have an appointment at the Immigration Service Office in 2 weeks.  This interview may be video taped and to expect to being at the interview for approximately 2 HOURS which makes me very nervous.  I hope all goes well.  Does any of you have an idea what kind of questions I'll be asked? or even why I am being interviewed?

    @Ayako...Nothing... I called USCIS today... said there nothing else to do than to wait for an interview to get scheduled.  My file is no longer at the NBC it was transferred to the Denver Immigration office since 03/18/2019.  I asked if there was a deadline to when i might hear back from them, and she they said no.  I explained to her that the Denver Immigration office has had my file for over 6 months ago and said to try be "patient".

     

    What about you....anything new?

    Well for us we are still waiting.  Got a hold of the USCIS again said that the file has been in our local office since March 2019 and that we are in line for an interview.  You would think that 6 months is good enough time to get an appointment set but still nothing.  I've contacted my attorneys office and the congressman and both have said that they cannot do anything for us but just wait for hear back from our local office.

    Here there... Cases a year old now and still nothing.  Waiting for the 3rd inquiry to expire (08/30/19) so the following I can call USCIS and ask for my inquiries to be escalated for a response ASAP (at least thats what they told me).  I've also contacted the congress office for them to help me in getting a response.  Its been a week today since that and still nothing.  I just know what else to do.

  14. 3 days shy from being 12 months since we file our applications.  The Congress mention since the end May that our files are at a local office because it appears that I will have an interview.  Now almost 2.5 months since that and still nothing.  We are getting very inpatient.  Our attorney office told us that USCIS told them that they are a "little behind" but that I'm in line for an interview.

Have you considered filing an I129F for a K3 visa for your spouse? You may have a slight chance of getting that one faster or just getting your case looked at again.

    I've also tried calling but i never get thru a live person.

     

    I will discuss with him about filing an I-129F and see if he wants to go that route.

    In your case, I think it wouldn’t hurt to reach out to your congressperson and see if they can advocate for you. I’ve seen some folks go that route.

    I would keep calling and following up maybe once every week though because it sounds very strange from what I’ve seen most people’s experiences with the I130.

    Oh that link you gave me for the e-mail if where I send my inquiries to which they told me that I need to wait 30 days to get a response.  I have already contacted my congress and said to contact them if I dont have a response from them by the middle of August (SMH) and I have also created an account with USCIS.  Believe me.. I've done anything and everything that you can think of that is why now I want to see if I can send additional evidence to them so see if that will get the case moving forward.

    I filed my first inquiry at the end of may and said i would get a response in 30 days.  The 30 days came by and nothing.  So I filed another inquiry since I couldn't get thru a live person when i called. And again they told me the same thing, that I will get a response in 30 more days.  I then asked how many inquiries do I have to make to finally get a response from someone.  Was told that I would have to file 3 and wait their 30 days until they can finally get a hold of someone and get an answers for me.

     

    When you say an electronic follow up?  Where exactly can I do that?

    When I originally entered my CR-1 timeline (NOA1 22nd July), it showed me a November 2019 NOA2 estimate for Potomac. Now it's showing April-August 2020 which is a wide range and seems... very far off, especially for Potomac? Any idea what caused this sudden jump—did someone upload a weird timeline that skewed the data, or is new info suggesting it really jumped that far, that fast? How is everyone else's Potomac timeline looking?
