Hello,
I want to withdraw or close my case with NVC since I will be adjusting my status here in the US after getting (advance parole-parolee status)
One of the questions on the I-485 application says" Have you ever applied for an immigrant visa to obtain permanent residents statys at a US embassy or US consulate abroad? YES OR NO
I have gotten my I-130 approved already but got a NVC case number how would I go on to close that case . can I send my adjustment of status packet before closing it my NVC case ?

Interesting not sure I have seen any Canadians on DACA. Not that being Canadian prevents this.
There are DACA recipients from all over the world China, Africa etc.

Short answer is yes because once you leave the US for the visa interview in Mexico, you will be living abroad and not in the US. I advise getting a qualified co-sponsor in the US prior to leaving for your interview. DACA situations are often complicated, so I also suggest consulting with an experienced immigration attorney in the US who knows everything about DACA beneficiaries who are applying for green cards via marriage to a USC. Do this before you leave to avoid potential problems. You've already mentioned in previous posts a waiver application so based on that you more than likely are not eligible for adjustment of status in the US which is why you are doing consular processing. Did you enter the US illegally? Specifics matter for DACA situations which is why a good lawyer can help. Good luck!
This is incorrect I just talk to an immigration Lawyer about this he said this is not true. So I wont be needing a cosponsor even if Im doing consular process. Thank you anyways.

is this because I will be doing consular process what if I was doing the adjustment here in US?
"If you included the income of the intending immigrant who is your spouse (he or she would be counted in Part 5., Item Number 1.), you must provide evidence that his/her income will continue from the current source after obtaining lawful permanent resident status, and the intending immigrant must provide evidence that he or she is living in your residence. "
This is what the form says

I would expect you will not be able to include his income as he will not be work authorised.
I have employment authorization I've been working with a social since 2012 and report taxes, why wont it be included.

Do I still need a joint sponsor/co sponsor if the beneficiary me (has a work permit-DACA) combines income with the petitioner in form I-864 to meet income requirements doing consular visa process?

Yes, but I Have to do the i-601a waiver and they are taking up to a year to get approved, so I have to have the waiver approved before closing my case with NVC that’s why the question.

Hi,
I received my welcome letter on my email from NVC yesterday 5/17/2020 I know the nvc fees are good for a year , but is it from the day they gave me a case number or the date of the payment receipt ? If the payment for the fees expire in a year do I have to pay for them again ?

My marriage license does not show my middle initial in the cert. only first and last name, How can i Fix this? will it cause a problem when going to my visa appointment in Juarez? My Mexican passport has my middle initial , but I couldn't renew my Mexican passport at the Consulate with my married last name because they didn't want to accept my marriage license because it was missing my middle initial in it.
thanks

Hi,
i know the I-601a waiver fee is $715 my question is I have DACA do I still need to pay for fingerprints fee ($85) or do I just send money order for $630?
-
So my husband I just received the notice of action for the I-130 this month , but under the beneficiary name my name didn’t include the my middle name it was just the first and the last.
Should I contact the USCIS to see if they made a mistake or has anyone receive the noa1 without including the middle name under the beneficiary name?
Thanks

Hello
I will have to go to my interview to Ciudad Juárez does someone know at what step does the NVC starts scheduling your interview when does the time start is it after you submit the DS-260 or after you submit the financial, supporting docs?
Thanks

For the required documents in the NVC stage
like
The W2s
evidence of income
tax transcripts
Do they have to be about the petitioner or the beneficiary ?

Highlighting on supporting docs is fine, make sure you use light color shades. Dark colored highlights may appear as black on the scans they make.
2 hole punch is fine in all including the form.
Thankyou

Hello,
Im getting ready to send out my petition I know you can’t highlight the forms but can you highlight some parts of the supporting docs ? And I’m sending my I-130 packet with 2 whole punch at the top can I as well whole punch the I-130 petition forms?

No you don't have to as long as you didn't spend more than a year in another country after the age of 16. And you don't need US police report.
Ok thankyou

For the required documents at the NVC

-

Have you ever been charged or convicted of a crime? If so you need the court records showing the final disposition of that case.
No I haven’t so that means if I have no crimes etc I don’t need one ?
