  1. I am looking at all the paperwork and was wondering if its better if I try and do it all or better to hire a service to do the complete k1 visa? I would hate to mess up on something and have it take longer to get my girl here.

    Personally, getting my wife here is so important that I wasn't willing to trust anyone else to do this whole process. If you look around VJ you'll see a lot of people complaining and mention that some of the screw-ups was due to their hired immigration lawyer/service. So far VJ guides, posts and members have been a great help in doing everything myself. And seems like most people here on VJ are filing it alone.... gave me some confidence.

    But if you can find a lawyer that comes through good recommendations/reviews and are willing to trust, it may be a more convenient option to pursue.

  2. Honestly, I think even applying for the tourist visa and paying the fee is a total waste of time. India has a very high rate of denials for tourist visa's. Not only that, but when you tell them you are married to a USC, you are clearly showing non-tourist intent, therefore committing fraud. If you tell them the truth about the I130 or K3 route, they will deny you anyway.

    I agree with Nanusia & Lukaszek... in most cases it's probably a waste of time and money. In our case, my wife had a pending visitor visa interview from before we met, so since she had already paid the fees, we're just taking a chance.

    However, I disagree that it is committing fraud, unless you lie in the interview. There have been others who successfully got the tourist visa after clearly stating that they have filed for K3, showing the officer the documentation and case number for the K3 and also proving that they intend to return to India for the interview. At that point it is up to the interviewing officer what he/she decides, very subjective decision.

    Another point to note, is that even after getting the visitor visa in hand, you are taking a chance at the Point of Entry into US where the officer at the airport can deny her entry inspite of having a visa in hand... which means she has to travel back to India...

    So consider everything, see if you can make a convincing case of why she would 'NEED' to return to India, and consider all risks before trying a tourist visa....

  3. I am a US citizen and I recently married an Indian national in India ~2months ago. I have filed an I130 and received the I-797 NOA just a few days ago. I want to bring my wife here quickly as she has no family there.

    I am thinking of starting the process for a K-3...

    My question is....Can my wife apply for a tourist visa while a K-3 case is processing? or will this cause problems?

    Also, can anyone tell me how long it would take at this time to obtain a visa via the K-3 process?

  4. Many people have mentioned that the time it takes to schedule an interview after NVC approval for either a K3 or a CR-1 varies by the Embassy.

    Any couples who can share their recent experience as it relates to getting a visa appointment (K3 or CR-1) in Mumbai after NVC approval?

    VJ timelines say 149 days for CR1 in Mumbai after NVC approval - that's almost 5 months alone! So going by the current stats that would be approx 3 months at the CSC + approx 3 months at the NVC + 5 months till interview in Mumbai = 11 months to get CR1!! Is this correct?

    On VJ it's mentioned that K1's take 101 days on average from NVC approval to interview, but no statistic info on K3.

    Damn freakin' worried!!

  5. All right, we're working on getting our I-130 package put together before I have to go back home in May, and I just had a few little questions I hope you guys can help me with. :)

    The first one is in regards to needing a copy of our marriage certificate. Does that mean we would just need a plain photocopy of it?

    Yep, all you need is a plain photocopy. If they require you to provide the originals for proof it would likely be at the time of the visa interview.

    And regarding question 22 on the I-130 form itself... since my husband will be filing this for me while I am home in Canada, do I just put N/A there?

    This is how it normally works for other countries, but for Canada I'm not sure if there are any advantages given the whole Visa Waiver Program - i.e. if it might be easier to come to US and then file an I-130 or such.

    Also, is there anything we should include in the package that's not on the checklist here: http://www.visajourney.com/forums/index.ph...mp;page=k3guide I just want to make absolutely sure we have everything we need in there before we send it off.

    Since you're filing now, you'll probably be using the new form. See Note 7 in the new I-130 form for other documents you'll need besides the marriage certificate. Download it from USCIS' website.

    Always helps to have a cover letter... ours went something like this:

  7. You can enter on the K-3. It is a multiple entry visa valid for two years. So you will not "need" advanced parole for two years. Our case is unusual in the amount of time it is taking. After two years your spouse will need to have advanced parole in hand prior to departing the US if she wishes to be allowed to return. Hopefully your spouse will have her greencard by then and it will not be necesssary. If she does not wish to ever leave the country she will not need one. But what if a family emergency arises. It takes time to get the AP.

    As to timing on applying for AOS to be sucessful you will need to have an approved I-130. I would apply as soon as you are approved. However, there are no likely problems until she is six months out of status. Don't let that happen.

    I'm still a little confused here.... so by this you meant that I need to file for AOS as soon as NVC approves my I-130 (and might keep in on hold while the K3 comes through) but wait until she arrives in the US on a K3, right?

    EAD is a requirement to legally work. If you wife does not wish to work you need never apply.

    She will definitely be working, but you said something about this being an annual cost.... so for every year that she is waiting for AOS to be approved, we have to keep re-filing the EAD?

    So you are advocating submitting an I-485 on a K-3 visa knowing full well that it will be denied and the applicant will lose $385 dollars. Not nice.

    The I-130 does not have to be approved before the application to adjust status can be submitted. The I-130 does have to be approved before the application to adjust status can be approved.

  9. Thanks aussiewench! Appreciate you taking out time to provide such a detailed response. I am a little confused about some aspects still so will try and chime in below:

    A couple of things. If you find that the I-130 is approved before the I-129F and forwarded to NVC for you to continue the process to apply for an immigrant visa, chances are pretty good that you will interview for this visa over the K-3. Reason: even if the I-129F is approved whilst your I-130 petition is still at NVC; once your approved I-130 and visa case arrives at the consulate/embassy, it will over-ride the K-3 even if a K-3 interview is scheduled already.

    Got it... so preferably it works to my favor that the I-130 gets approved and forwarded to NVC before the I-129F as it leaves options open without me having to pay an extra $200 bucks for the I-824, right?

    Providing your file for the immigrant visa isn't held up in security checks for any great length of time at NVC, on average you are looking at 3-4 months to get through this stage. (sometimes quicker, sometimes longer). To roughly work out time frames further, find out how long it takes to have Immigrant visas scheduled as opposed to K visas. Some consulates will vary quite a deal between the two, others not.

    So I need to find out how long it takes for CR1 and K3 interviews to be set up at the Mumbai consulate once each is approved at the NVC. Any thoughts on how I go about doing this? Is this readily available on VJ somewhere? I remember someone mentioned on a post somewhere that from NVC approval to Mumbai consulate scheduling an interview for I-130 is 4 months?!

    Sometimes the CR-1 can be faster than the K-3. It also depends on what you want. The CR-1 grants your spouse permanent residency with the green card on entry. No adjustment of status and nothing to do until 90 days before the two year anniversary of having entered the US. The adjustment of status process can be a royal pain in the butt especially if the Office you have to file with is one that is taking 2-3 years. Its all up to you. You can check on the processing times for the Office that you will have to file AOS through, by checking on the USCIS site.

    Hmm, currently it says that CSC is processing AOS (I-485) for Aug 21st '06 which means its about 6 months processing time... and Employment Authorization (I-765) for Dec 4th '06, which means about 3 months processing time.

    So assuming I go with the K-3, and the K-3 gets processed 2 months (?) faster than the I-130, for my wife to be able to work it would work out as follows:

    K3 Timeline from visa approval: Atleast 3 months before she can work

    K3 Additional Cost: I-485 Filing fee ($325) + Biometrics Fee ($70) + I-765 Filing Fee ($180) = Total cost of $575 + Atleast 1 month opportunity cost

    Vs.

    I-130 Timeline: 2 months additional wait than K3 approval, but she can work immediately on arrival

    I-130 Additional Cost: None

    So based on this is it fair to assume that it is more cost effective and faster from an employment perspective to follow the I-130 path, assuming there are no hiccups in the process? Or am I making an error here?

    If your I-130 is held at the service center and the entry is made on the K-3, there is two options....to apply to adjust status in the US, or by filing the I-824 to have the I-130 transferred to NVC and then when complete and forwarded to the consulate, where one would return to the consulate for the immigrant visa. The processing time for the I-824 is showing 6 months so its not just a matter of filing the form/fee and it being automatically transferred.

    So if I understood this correctly, in the first option we'd follow the process of adjusting status in the US which as calculated above would cost around $575... or we can file the I-824 which would cost $200 plus she would have to fly back to India for an interview at the consulate, so about $1300 for her roundtrip plane ticket....

    Hope that is not too mixed up. Not easy to always put some things into words.

    Absolutely agree, I'm having a hard time asking some of my questions so I'm sure its tough when trying to answer people on VJ. once again, thank you for helping.

    While I don't want to overanalyze stuff and money is not the biggest issue... the reason I'm asking all this is to understand timelines for my wife to be able to start working. We're trying to do some life planning, and if I'm going to go to MBA school full-time we want to see what's our best option to have atleast one income coming in to manage daily expenses :) while still reducing our time apart....

    Not really.

    IR1 and K3 are visas. The USCIS does not process visas. The USCIS processes the prerequisite petitions.

    If the I-129f petition is approved first the I-130 petition is not put on hold. It is processed to completion (approved or not approved). Then the USCIS holds on to it until it is needed for adjustment of status. Or, if the petitioner requests that it be sent on to the DoS, the USCIS will send it to the DoS.

Sorry to disappoint you but the wedding cost is not tax deductible, the money you sent are not tax deductible, even if you were married in 2006 you would not be able to deduct wedding cost and remit you sent out to India, the only break you would have is the married status and without your partner's income from india, that would help you out on your tax return, congrats on your wedding.

    Ok, having done that, how does the choice you make impact further...

    I understand so far that if you pursue with the K-3, then it might get processed faster than the I-130 (is this true?). So we'll be reunited sooner.....!

    But I just want to understand the flipside of making that choice -

    - how many months does it add to her getting a green card

    - how much additionally will it cost us (not just filing fees but any other hidden costs??)

    - how soon will she be able to work once she arrives here (i.e. other forms and processing that would slow things down)

  13. No, you're not missing anything. I think that's too much documentation. But, it works. Generally, all you would need to submit would be g-325a, 1 passport photo of you, 1 passport photo of spouse, form I-129F, marriage certificate, I-797C, and birth certificate of beneficiary, and copy of passport.

    I think you meant birth certificate of petitioner, right? The I-129F instructions do not request beneficiary's (foreign spouse') birth cert...

  14. :lol: I hope you are kidding! You can not deduct the cost of your wedding from your taxes... no matter where that wedding is.

    Also, weddings in the US tend to be a bit costly also.

    Nope don't want to deduct the cost of the wedding, but was wondering if there is anything I can deduct or do to take advantage of the fact that my expenses towards the marriage began in '06 since I can't file as 'married'... grasping at straws but trying to save some money!

    So this puts me in a tough spot. For my 2006 Tax return I will have to file as a 'Single' since the registration of the wedding happened in 2007. But is there any way to make some claims/deductions/etc to get some money back given that my expenses began in 2006? I sent money to India through banking channels so I have proof that money was sent for marriage purposes in 2006....

    Not sure if anyone has gone through this similar scenario, but as most people in India will agree that weddings are a costly affair and the expense begins 7-8 months prior to the actual wedding with deposits, reservations and the endless number of gift items that need to be accumulated for the bride-to-be and families of the couple to be married.

    In our case the expenses started off back in August '06 when we got engaged leading up to our wedding on Jan 25th 2007...

    So this puts me in a tough spot. For my 2006 Tax return I will have to file as a 'Single' since the registration of the wedding happened in 2007. But is there any way to make some claims/deductions/etc to get some tax money back given that expenses began in 2006? I sent money through banking channels so I have proof that money was sent to India for marriage purposes in 2006....

  18. I attached 4 copies of my addedum, it made sense to me to do so, since there are 4 copies of the G325A. I would guess it probably won't be an issue for the I130 since they've already sent your NOA1 though.

    Thanks riblet! I'll send in additional copies of the addendum as well to be safe...

    So just for clarification - if there was anything wrong with my I-130 packet, they would have sent me some other notice rather than the NOA1? Or will I only find out as we get closer and they might issue an RFE for whatever they see as missing?
