  1. Hi,

     

    Had a question and hoping this forum can help me this situation. 

     

    Bottom line, but see details below: exploring taking an expat job in Asia (not spouse's home country), and wondering how this affects the paperwork

     

    My wife (beneficiary) and I (USC) are under IR1/CR1. She already lives in the US with me and have applied to remove of conditional status. She was approved removal of conditions. Biometrics completed and waiting on interview. We've traveled briefly with the I-797.

    Technically, we can apply for N400 next February. 

     

    I'm considering taking a job assignment abroad in Asia with a time limit (2yrs).

     

    Is this possible without negatively affecting her status and future N400 application?

     

    I've read that ahe can apply for a re-entry permit before leaving, knowing that she'll be outside of the US for more than 1 year.

     

    Additional details:

    - We are keeping are home and car

    - Would have proof that the assignment is only for 2 years, with the intention to return to the US

     

    Are there other avenues i should explore, and other issues i need to consider?

  2. i also thought it was odd, because she had all paperwork regarding the procedure.

    the police department were she lives is somewhat incompetent.

    they wouldn't give a letter stating that there was no record, without the inspector being there which is not until later this week.

    there is no need for vehicle insurance, so that is not an option. thanks for the suggestion.

     

    my wife was asked to go to the medical office today regardless of having the report or not

    She is going to the follow-up appointment without it, and see what the process is.

    they only gave her one day to obtain the report, which is annoying.

  3. Hi VJ friends,

     

    i have a question that hopefully someone here has gone through a similar situation.

     

    My wife has gone through the Medical examination prior to the interview. 

    All the results came back ok, in terms of vaccinations, tests, etc.

     

    She had a vehicle accident about 3 years ago, in which she had to go through surgery for her arm. 

    she brought all operation paperwork, x-rays and letter from the surgeon confirming that she had a procedure done on her arm.

     

    the accident did not involve anyone else or damage to property, it was just herself and her car.

     

    the medical office is asking for the accident report from the police, which is not available in the police database.

     

    if the report cannot be obtained, what would be the process or implications in moving forward through the interview process?

     

    Interview date is coming up in about 2 weeks.

    I'm hoping to get interview letter soon (CR1), but looking ahead regarding health insurance issue this is what i'm planning to do.

    Hopefully someone has some insight if this is ok.

     

    I'm writing a letter in which i'm showing my current health insurance cost vs the cost of adding my spouse to my employer-provided health insurance.

    My I-864 financial documents can serve as an additional substantiation that i can afford the added costs.

    I've spoken with the health insurance company, and they've confirmed i'm able to add my spouse once she comes into the U.S. as a 'Life Event', regardless of enrollment period

  5. Probably not directly answering your question, but i missed the part of making copies of that sheet. So i just added blank sheets indicating the form No. and name and labeling each section.

    Also,  I did that for the I-130a, and still waiting for NOA2 (ECD beginning of June)

    Now i hope i don't get an RFE for that.

    Your timeline shows NOA1 Feb. 22.  NOA2 takes  6-10 months from that date, depending on your USCIS service center.  Then NVC, then consulate abroad for the interview, another 5 or 6 months depending on the country of origin.  It's a LONG process.  She won't have her CR-1 visa for about 14 months from NOA1--around April 2020 if all goes well.  So factor all of that into your plans.  Good luck!

    I'm just going by the hopefully realistic estimate VJ gives me for Potomac and no RFE's.

    This service center seems to be approving I-130's as early as January-2019. I understand other centers take longer to process the I-130's

  7. I have a question that I’m hoping this community could give me some feedback/comments on. I’ve read a few posts but nothing that would be similar to this specific case.

     

    I will be temporarily relocating to Puerto Rico due to work assignments for 6 months, next month.

    I’m (optimistically) anticipating my wife’s CR1 visa to be approved during the time I’m there. - NOA2 expected beginning of June.

    Once she has the visa, I want her to meet me there in PR for a few weeks to a month, more. This would be her POE.

    She would then go back to her country until my work assignment is finished and I’m back in mainland US. This is the time she would officially move to the US permanently, about 2 to 3 months later

     

    I’m having someone pick-up my mail back home, but would change the mailing address the USCIS has on file for me for NOA2, NVC paperwork, green card, etc. Or I could also have her give the new address at the POE for GC mailing.

    I’m aware that the CR1 visa is valid for approx. 6 months, and that I could wait a few weeks to pay NVC fees to delay the process if needed.

     

    Do we absolutely have to wait for the GC before she leaves PR, that way she enters the U.S. at a later date with no issues (2-3 months later)? or can she go back with the stamped visa in her passport?

    Should I expect any issues with CBP officers and interview at PR?

    Are there any other things/issues I should consider with this plan?
