  1. Hi everyone,

     

    I am trying to put this in the Dominican Republic K1 area. I hope this is ok. I apologize in advance if I am wrong. I put this as a comment in the thread I'm about to refer to but then thought I should make a stand-alone post.

     

    I just got NOA2 (Yay!!). I read a post saying that for the Dominican Republic I do NOT need to wait for an NVC number to do the DS-160. (Exciting!! I hope this is right!)

     

    On the DS-160 it says to put in the application receipt/petition number. I have an "A" number but I only have ONE number that starts with three digits like the "help" bar says. It is the "WAC" number I've been using to track our petition the whole way along. Is this the one? I thought I'd have to put in her "A" number somewhere.

  2. Hi everyone! I recently got NOA2 in the mail!

    I'm filling out the DS-160. When it asks for "application receipt / petition number" it means the WAC number I've been using to track this petition, right? It is the only number I have that starts with 3 letters that is 13 letters long. Thank you in advance!     So to start just the I-129F and if they already met within the 2 yr requirement,  get the paperwork started asap. 

     

    You don't mention the birthday of the 18yr old but you don't want to drag feet as he needs to enter the US before he turns 21. With all the possible ways for things to get delayed don't wait another minute. 

    He JUST turned 18. I was hoping they would get married before that to make thing easier, but it didn't happen. Thank you, I will let them know! They have met a couple of times within the past two years.

  4. Hi! I got lots of great advice with the other post I made - thank you all! I have a few follow-up questions:

    Background: My sister is from the Dominican Republic (living there now) and is engaged to a USC living in the US. She has an 18 year old unmarried son. They are trying to figure out the best way for both my sister and her son to come to the US. I know it's best for them to make their own account but I offered to help with this website as English is my native language.


    K1 was recommended and they want to do that.

    1. If they file a K1 for my sister, how do they file a K2 for her son? If there is a guide for this, can someone link it for me? I can only find the K1 guide. There should be some place for him to submit passport pictures and such, though, right?

    2. With a k1, is the processing time for both sister and nephew the same, and is it roughly 1-1.5 years with no complications?

    3. If the time period is the same and K1 and K2 visas are granted at the same time can both sister and nephew fly to the US at different times if it's before the six months are up? 

     

    4. If they do get married, file CR1 and wait to file for nephew after she becomes a PR, that could mean a MUCH longer time period to wait for him- even though the CR1 visa is superior in some other ways, right?

    The marriage consummation date has no bearing on the child for immigration.  What is critical is the PD date of the I-130 application for the child.  That date has to be before the child turns 18.  The USC stepdad cannot submit the I-130 petition for the child until after he marries and consummates the marriage (meets).  Then he can submit the I-130s for the wife and child (one each).

     

    If there are any hick-ups -- delayed flight, not being able to complete the forms on time, get the I-130s properly filed, etc. -- then the child will age out.  And after marriage the K1 path will not be available.

     

    I almost never recommend a K1 over a CR1.  For this specific case, I reverse my normal trend and HIGHLY recommend the K1.

    After some more research I think it's actually the marriage date, not the PD date (as long as the child is under 21 before filing, and under 18 before the marriage takes place)

    Thank you. I don't think they can marry before the birthday, which is very soon. It is helpful to know this though.

    My sister is from the Dominican Republic (living there now) and is engaged to a USC living in the US. She has a 17 year old child about to turn 18 (unmarried). They are trying to figure out the best way to proceed with bringing my nephew to the US with my sister. I know it's best for them to make their own account but I offered to help with this website as English is my native language. I read the guides but have a few outstanding questions/wanted to be sure.

     

    Questions:
    1. If my sister and her fiance do a Utah Zoom marriage but do not meet in person before the child's birthday, does it still count as being married before the child turns 18 for the CR1 visa? They have met in person before this year, and will again later prior to filing if they go this route.

    2. If they do not marry before the child turns 18, can the child still follow my sister on a K1 (K2 for him) assuming it's before he turns 21?

    3. If they marry after my nephew turns 18, can my nephew still immigrate to the US with my sister if she gets a CR1? Would his stepdad apply for him with his mom or does his mom need to apply for him after she gets to the US?

    I would appreciate your help and recommendations. Thanks in advance!

    Are B2's currently processing in the Dominican Republic? (And if not, where do I look to check on their status?) Can a person submit a B2 application even if they aren't processing to wait in line for when they are processing again? I understand it's an uphill battle in the DR but she has a job, property and can afford the fee, so why not? We are hoping our relative comes for our wedding (next year-ish sometime whenever K1 is hopefully approved!) for a few weeks.

    I am a USC. I may petition my mother from the Dominican Republic to the US. I read the guides and am curious about the processing time. IR5 visas are immediately available once the petition is approved, right? Approximately how long will it take for the petition to be approved? I read "generally 6mos to a year", but can't find it on the visa bulletin. I have a few more questions and summarized below:
     

    1) Approximately how long will it take for the petition for my mom to be approved (assuming no difficulties)

     

    2) Also, if my mother were to come to the US and get her green card, will she immediately be eligible to petition her son (my brother) from the DR?

     

    3) If my brother is petitioned, do they do his background check immediately before they approve him or wait 6-7 years until his visa becomes available? I think the police report itself is filed when the priority date becomes current?

     

    4) If my mother were to come to the US, live here for a few years until my brother arrives, then change her mind and abandon her green card, will my brother also lose his eligibility for his green card?
