  1. I’m sorry, I don’t have a copy of that letter handy. Like I said, make your letter apologetic, do not point the finger at them, begin sentences with “it is/was my understanding that...” or of that nature. Explain why you believe your case should be reopened. Include as much evidence as possible and thank them “in advance” for their consideration to reopen your case.

     

    After I filed the motion to reopen, my case was reopened and approved in 3 weeks.

    8 months into the process. We filed a motion to reopen the case, wrote a letter explaining why we felt it needed to be reopened without accusing them of course!!! It was a mistake on their part but I was careful not to point the finger at them. I used terms such as “It is our understanding that...” or I apologized for failing to comply with the initial petition by failing to provide all of the resquested documents, etc.. Our case was denied after failing to respond correctly to a RFE, which we did not. They ended up missing something in the RFE.

    After we filed the motion to reopen our case, the cheque was cashed within days, our case was reopened and approved within a few weeks.

  4. How did you all get an interview date?

    I am told interview date was provided to me by NVC.  I never received a letter or an email with an interview date.  The US Consulate website in my Country also advises that most Visa Applicants are scheduled for their interview by the NVC.

  5. Hi everyone,

    I’m currently in the process of applying for my k1 visa.

    My 6 year old son is the petitioner’s child. He was born in Canada and lived with the both of us throughout most of his life. 

    My fiance move to the US 2 years ago (he is a born US Citizen) with the intention that we would all move in the nearest future.

    we went throuhh the K1 Visa application for myself. We were never married before, but together for 10 years (8 first years both livong in Canada).

    My understanding is that our son does not need a K2 Visa as his father (the petitioner) is a US Citizen.

    Can anyone confirm this?

  6. Hi all!

    Finally got my NOA2 on February 25, everything was semt to the NVC Center and just got an email last night saying that it was sent to the US Embassy in my Country.

    I am able to login with my case number on nvc.state.gov website for updates and it says that my case is in Transit.

    my question is: how did you all find out your visa interview date? It says on the website that my interview date was provided to me by the NVC but it was not indicated in the email?

    Other internet tools are telling me I need to schedule an appointment?

    Just a little confused!

  7. @Apple Bee in the decision they are telling me I need to appeal or file a motion. I was told I could send a letter to the director but no news yet. We acted to the decision within days in case we still need to file an appeal or motion.

    Our case is pretty straight forward as we’ve been together for over 9 years we met and lived together for 7 years in Canada and have a 6 year old son together. As he has dual citizenship he moved first but we’re still waiting for an approval, it’s hard on all of us.

  8. Sorry guys, we received an RFE telling us to submit one (1) passport style photo of Ben ONLY, as well as responding to a question that had not been answered. We sent the requested photos of Ben and answered to the question.

    The decision came back denied, saying that we failed to provide the resquested pictures. 

    I assume that they are missing passport style photos of myself (Melanie), however there was no mention of myself in the RFE whatsoever.  Therefore it was our understanding that no additional documents were required to be submitted.

    I see that the initial petition requested for passport photos of the both of us (which we missed), but we would have thought that they would have included passport style photos of myself in the RFE. If they had, we would have sent them and everything would have been ok.
