  1. Hi all,

     

    Need same advice, my wife got her police certificate but there is errors and to change that will take at least 2-3 weeks. So place of her current residence is not on what’s on the police certificate, so  does not match the address on her visa application. What’s on the police certificate is place where she was born but doesn’t current resident there but her parents do. Will the NVC accept the document and would this cause problem when she goes to interview.

    Thank you for quick reply. In her home country in each document they use three different language English, French and native language. Just have second  though if I actually do need to translate her birth certificate and police certificate since it’s write in three different language. What do you think.

    Sorry  if this this question has been asked before. So my wife and I are at NVC stage upload civil document. I have two questions 

    1)Can we use the same marriage certificate with same translation that was done when we were submitting our application I-130.

    2) We have to upload her birth certificate and police certificate/ clearance can the translation be any where (for example if she send me the document can it be translated here in U.S or has to be translated in her home country.

    Yes correct. @missileman my wife and I knew each other child hood , we kept contact and we fall in love and our parent arranged marriage for us. And I went to her home county got married which was first time seeing her again after 21 years but we were still talking to each other for 1 years before I asked to marry me . My question is should go visit her again before her interview with US Embassy.

    Ignore the I-129F letter, since your I-130 petition was approved, it will go to NVC, this takes two or three weeks.  After it gets to NVC, it takes another four to six weeks to assign an NVC case number, they will send an email with this number and instructions on what to do next, usually uploading documents, completing the visa application form, paying fees, all online via the CEAC website.  After your documents are all uploaded and fees paid, they typically take three weeks after that to review and approve them.  Then there's another wait while they schedule the interview abroad, that can be one or more months later depending on the embassy/consulate and how backed up they are.  Good luck with the rest of the process!

    No, the case now moves to the consulate via NVC and they will contact the beneficiary who will then fill out the DS260 to actually apply for the CR1 visa.  You can keep tabs on the progress, but I would wait for the 30 days before doing anything, and if after that time your spouse has not heard from the consulate, you can start looking into what is holding things up.

    This will be a CR-1/IR-1 case.....12-14 months from start to finish........if there are no hiccups.

    Do you know what I need to do for next step since now my application is approved. On the letter says to wait 30days for NVC to contact the beneficiary, I thought they will contact the petition first

    and here your topic says alien fiancee but CR1 (spouse)

    so,  which is it?

    I applied form I 130 before and My lawyer said I could apply form I 129 to make the process go faster so today I received two letter I-130 approval  and the second letter as I mention above.

    Can same one please explain to me. I received two letter from USCIS. One letter is my I-130 approval. The second letter  says you filed form I-129 f to classify the beneficiary as the spouse of a citizen of the United States pursuit to section 101(a)(15)(k)(ii) of the Immigration and Nationality act.

     

    In Visa petition proceedings, the burden of the proof upon the the petition. Matter of Brantigan ,11 I &N Dec.493 (BIA 1966). Based upon the evidence of the record it must be concluded that the petitioner failed to establish that the beneficiary is entitled to the classification sought.

     

    Does anyone know what the second letter means. I’m so worried.

    After the discussion here about a CO who is asking K1 interviewees for tax return transcripts at USEM - and finding out it is not hard to obtain them online - I decided to go ahead and get them and email to my fiance so she has them just in case. Used the IRS Get Your Transcript website and input all the stuff they needed and got a bounce-back that my mobile number was not verifiable. So I put it in again; tried different formats (hyphens, no hyphens, +1) and nada. They say they can't verify my cell phone number and I could fill out a user profile and get the transcripts in 10 days. 

     

    Interview is Thursday so that won't work.

     

    I did a little googling and sure enough, the two-step verification using a cell phone is locking a lot of people out of the instant download option. 

     

    So I did what I probably should have done to begin with and called by tax preparer and told her I needed tax return transcripts. She said she will email them to me this afternoon. 

     

    Just a heads-up for anyone else running into this issue. I will definitely let you know if my fiance is asked for them.

    You can go to any IRS office close to you, they can easily print it for you.
